In accordance with paragraph 7 of Article 75 of the Digital Code of the Republic of Kazakhstan, I ORDER:
1. Approve the attached documents:
1) Rules for establishing compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the digital Government mobile application;
2) Compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the Digital Government mobile application.
2. The Public Services Committee of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the established legislative procedure, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan;
3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for establishing compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the Digital Government mobile application
1. These Rules for Establishing compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the Digital Government mobile application (hereinafter referred to as the Rules) have been developed in accordance with paragraph 7 of Article 75 of the Digital Code of the Republic of Kazakhstan (hereinafter referred to as the Rules). – The Code) and define the procedure for establishing compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the digital Government mobile application.
2. The following basic concepts are used in these Rules:
1) the authorized body in the field of digitalization (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of digitalization;
2) the "digital government" web portal is a digital object that provides a "single window" of access to consolidated information posted by government agencies and other entities involved in the provision of public services, including the regulatory framework, as well as to government and other services provided in electronic form.;
3) the mobile application of the "digital government" is a software product installed and launched on a cellular subscriber device and providing access to government services and services provided in electronic form via cellular communications and the Internet.
3. The authorized body analyzes the requests of individuals and legal entities in order to identify other services that are subject to mandatory access to them through the Digital Government web portal and/or the digital Government mobile application.
4. The compliance criteria for other services to ensure mandatory access to them through the digital government web portal and/or the digital government mobile application shall be established by the authorized body based on the results of the analysis provided for in paragraph 3 of these Rules, based on the demand for the service, its social significance, as well as the possibility of providing the service in electronic form..
5. According to the results of the analysis, the authorized body:
1) determines the circle of persons entitled to provide other services;
2) defines the list of requirements of the legislation of the Republic of Kazakhstan in the fields of cybersecurity and personal data and their protection.
6. When analyzing appeals from individuals and legal entities, the authorized body takes into account the number of recipients of other services during one calendar year.
Based on the average number of service recipients of other services, the authorized body establishes the minimum number of service recipients as one of the criteria for compliance with other services to ensure mandatory access to them through the digital Government web portal and/or the digital Government mobile application.

Compliance criteria for other services provided in electronic form to ensure mandatory access to them through the Digital Government web portal and/or the Digital Government mobile application
1. Other services provided in electronic form are subject to mandatory access through the Digital Government web portal and/or the Digital Government mobile application if they meet the following criteria:
1) are provided by persons who are not government agencies, quasi-public sector entities, or individuals or legal entities providing public services in accordance with the legislation of the Republic of Kazakhstan;
2) they do not contain signs and criteria of a state function or service included in the Register of State Services and are provided in electronic form.;
3) are residents of the Republic of Kazakhstan who have exclusive rights to the digital object that implements the service;
4) a digital facility that implements services has a certificate of compliance with cybersecurity requirements of at least four (4) levels of trust or positive test protocols for compliance with cybersecurity requirements.;
5) do not lead to unauthorized collection, storage and leakage of personal data of the service recipient;
6) do not contain information promoting the forcible seizure or retention of power, forcible change of the foundations of the constitutional system of the Republic of Kazakhstan, undermining national security, as well as leading to a violation of public order and harming the health of citizens and the morals of society;
7) demand, confirmed by the provision of at least fifty other services within one calendar year.
