On Approval of the Rules for Financing and Carrying out Construction, Reconstruction, and Major Repairs of State Secondary Education Facilities

In accordance with subparagraph 37) of Article 5 of the Law of the Republic of Kazakhstan "On Education", I ORDER:
1. To approve the Rules for Financing and Carrying out Construction, Reconstruction, and Capital Repairs of State Secondary Education Facilities (hereinafter referred to as the Rules) in accordance with Appendix 1 to this order.
2. To invalidate the order of the Minister of Education and Science of the Republic of Kazakhstan, the order of the Minister of Education of the Republic of Kazakhstan and the Acting Minister of Education of the Republic of Kazakhstan, as well as the structural element of the order of the Minister of Education of the Republic of Kazakhstan according to the list in accordance with Appendix 2 to this order.
3. The Department of Investment Policy and Infrastructure Development of the Ministry of Education of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Education of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Education of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
4. Control over the execution of this order is entrusted to the supervising Vice Minister of Education of the Republic of Kazakhstan.
5. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.
6. Establish that:
1) starting from July 1, 2026, subitem 2) of paragraph 8, subitem 1) of paragraph 14 of the Rules apply as follows:
"2) during the construction of state secondary education facilities, determine their location and design capacity in accordance with the general development plan of the settlement in accordance with Article 76 of the Construction Code of the Republic of Kazakhstan;";
"1) determination of the land plot during the construction and reconstruction of state secondary education facilities in accordance with Article 18 of the Building Code of the Republic of Kazakhstan, including the requirements for the functional zoning of the territory of the settlement;";
2) starting from July 12, 2026, subparagraph 1) of paragraph 8 of the Rules is valid as follows:
"1) carries out an analysis of the need for construction, reconstruction and major repairs of state secondary education facilities, taking into account the criteria provided for in paragraphs 4 and 7 of these Rules and based on information from the digital system "National Educational Database" on the number of students, the forecast of the contingent, the design capacity of secondary education organizations, their actual occupancy, the presence of a shortage of students places, three-shift training, the accident rate of schools, the number of adapted buildings, data on the major repairs carried out by secondary education organizations;".

Rules for financing and carrying out construction, reconstruction and capital repairs of state secondary education facilities
Chapter 1. General provisions
1. These Rules for Financing and Carrying out Construction, Reconstruction and Capital Repairs of State secondary education Facilities (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 37) of Article 5 of the Law of the Republic of Kazakhstan "On Education" and determine the procedure for financing and carrying out construction, reconstruction and capital repairs of state secondary education facilities.
Chapter 2. The procedure for financing the construction, reconstruction and capital repairs of state secondary education facilities
2. Financing of construction, reconstruction and capital repairs of state secondary education facilities is carried out at the expense of local budgets, private investments, public-private partnerships and other sources not prohibited by the legislation of the Republic of Kazakhstan.
3. Financing of the construction and reconstruction of state secondary education facilities at the expense of budgetary funds is carried out according to the following criteria:
1) for the construction of state secondary education facilities:
eliminating the shortage of student places;
solving the problem of three-shift education in state secondary education facilities;
construction of public secondary education facilities in residential areas of settlements where they do not exist;
transfer (relocation) of state secondary education facilities located in adapted buildings to standard buildings;
construction of sports halls, assembly halls, canteens and a food hall, a library, including in adapted buildings;
2) for the reconstruction of state secondary education facilities:
bringing existing buildings of state secondary education facilities in line with the requirements of state regulations in the field of construction, sanitary and epidemiological welfare, safety, as well as accessibility for people with special educational needs;
increasing the design capacity of existing state secondary education facilities (including through extensions and/or add-ons) in order to reduce the shortage of student places and ensure the transition to a two-shift training regime;
changing the spatial planning and functional characteristics of existing buildings of state secondary education facilities (including through reconstruction and (or) redevelopment) in order to create sports, assembly halls, canteens and a food hall, a library, to improve learning conditions, including in adapted buildings.
4. The basis for the construction of public secondary education facilities is the need, confirmed by the following indicators:
1) current and projected shortage of student places;
2) the number of public secondary education facilities with three-shift education;
3) the number of emergency state secondary education facilities;
4) the number of state secondary education facilities located in dilapidated buildings;
5) the number of state secondary education facilities located in adapted buildings;
6) natural increase in students;
7) compliance of the provision of state secondary education facilities with the System of regional Standards for Settlements approved by Resolution of the Government of the Republic of Kazakhstan dated September 2, 2025 No. 710 (hereinafter referred to as the System of Regional Standards);
8) compliance with the Guaranteed state Standard of the network of educational organizations, depending on population density and remoteness of settlements, approved by Order of the Minister of Education and Science of the Republic of Kazakhstan dated May 6, 2022 No. 185 (registered in the Register of State Registration of Regulatory Legal Acts under No. 27968) (hereinafter referred to as the Standard of the network of educational organizations).
5. Data on the current shortage of student places is calculated by the local executive body using the formula:
Dc= P * Ss - K
where:
Dc – current shortage of student places in a locality;
P is the design capacity of existing secondary education facilities in a locality.;
Ss – shift ratio;
K is the current contingent of students in grades 1-11 (12) of secondary education facilities in the locality.
The shift ratio Ss is equal to:
for public secondary education facilities commissioned before 2003 – 1.5,
for public secondary education facilities commissioned after 2003 – 2;
for private secondary education facilities – 1.
6. The projected shortage of student places is calculated using the formula:
Dp = K * Segr - P * Ss - On
where:
Dp – projected shortage of student places for the current year in a locality;
Segr is the coefficient of increase in the number of students in a locality.;
On – the introduction of new student places by locality in the year of calculation of the deficit. When calculating the deficit of secondary education facilities for the second and subsequent years, facilities planned for commissioning in the previous year are accepted as commissioned;
Segr is determined by the following formula:
Segr = K / K1 + T
where:
K 1 – the number of students for the previous year in the locality;
T is the growth trend over the past five years, which is determined by the formula:
T = (Tpr+ Tpr 1 + Tpr 2)/3
where:
Tpr, Tpr 1, Tpr 2 – the trend of growth over the past five years in a locality.
The Tpr is determined by the following formula:
Tpr = K/K1 - K1/K2
Tpr 1 is determined by the following formula:
Tpr 1 = K1/K2 - K2/K3
Tpr 2 is determined by the following formula:
Tpr 2 = K2/K3 - K3/K4
where:
K1 – the number of students in the previous year in the locality;
K2 – the number of students in the year preceding the year K1 (two years ago before the reporting period) for the locality;
K3 – the student body preceding the year K2 (three years before the reporting period) for the locality;
K4 – the student body preceding the year K3 (four years before the reporting period) for the locality.
On – is determined by the following formula:
On = Sgov * Cc + Spr * Ss
The source of data on the current contingent of secondary education facilities (K) and the current design capacity of existing secondary education facilities (R) is Administrative data within the framework of educational monitoring, approved by Order No. 570 of the Minister of Education and Science of the Republic of Kazakhstan dated December 27, 2012 (registered in the Register of State Registration of Regulatory Legal Acts under No. 8369).
The data source for the introduction of new student places (On) is data from local executive authorities.
Sgov – design capacity of public secondary education facilities planned for commissioning;
Spr is the design capacity of private secondary education facilities planned for commissioning.
7. Financing of capital repairs of state secondary education facilities at the expense of local budgets is carried out according to the following criteria:
1) carrying out major repairs of state secondary education facilities with a high level of wear of 60% (sixty) or more on the basis of an expert opinion on the technical inspection of reliability and stability of buildings and structures in accordance with the Rules for the technical inspection of Reliability and Stability of buildings and structures approved by the Order of the Minister of National Economy of the Republic of Kazakhstan dated November 19, 2015 No. 702 (registered in the Register of State Registration of Regulatory Legal Acts under No. 12425) (hereinafter referred to as the Expert Opinion);
2) carrying out major repairs at state-owned secondary education facilities with a service life of more than fifty years, in which major repairs have not been carried out since commissioning, subject to an Expert opinion.;
3) carrying out major repairs at state secondary education facilities located in border settlements, if there is an Expert opinion.;
4) carrying out major repairs at state secondary education facilities in rural settlements where there are no other state secondary education organizations, subject to an Expert opinion.;
5) carrying out major repairs of state secondary education facilities with a high student workload of more than 100% (one hundred) of the design capacity, subject to an Expert opinion.;
6) carrying out major repairs of state secondary education facilities in the presence of an Expert opinion.
8. The local executive body shall take the following measures to finance the construction, reconstruction and capital repairs of state secondary education facilities:
1) analyzes the need for construction, reconstruction and major repairs of state secondary education facilities based on information from the National Educational Database information system, including data on the number of students, the projected contingent, design capacity, actual occupancy, the shortage of student places, three-shift training, as well as the technical condition of buildings, taking into account the criteria provided for in paragraphs 4 and 7 of these Rules;
2) during the construction and reconstruction of state secondary education facilities, determine their location and design capacity in accordance with the general development plan of the settlement in accordance with Article 47 of the Law of the Republic of Kazakhstan "On Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan";
3) determines the sources of financing for the construction, reconstruction and capital repairs of public secondary education facilities, including local budget funds, public-private partnership mechanisms, as well as other sources not prohibited by the legislation of the Republic of Kazakhstan (including extra-budgetary funds and private sector investments).
4) forms a List of educational facilities requiring construction, reconstruction and capital repairs for inclusion in the Development Plan of the region, the city of republican significance, the capital according to the Methodology for the development, implementation, monitoring and adjustment of the National Development Plan of the Republic of Kazakhstan, development plans of government agencies, regions, cities of republican significance, the capital, districts (cities of regional significance), approved by the order of I.O. The Minister of National Economy of the Republic of Kazakhstan dated December 1, 2025 No. 128 and sends it to the authorized body in the field of education for approval;
5) the draft list of educational facilities requiring construction, reconstruction and major repairs is considered by the authorized body in the field of education within a period not exceeding one month from the date of admission.
9. The authorized body in the field of education, based on the results of consideration of the list of construction, reconstruction and capital repairs of state secondary education facilities, decides on its approval or rejection, indicating the reasons.
10. In case of rejection of the list of construction, reconstruction and capital repairs of state secondary education facilities by the authorized body in the field of education, the local executive body takes measures to amend the list of construction, reconstruction and capital repairs of state secondary education facilities or substantiate disagreement with the authorized body in the field of education.
11. The calculation of the minimum threshold values of budget financing for the development of the infrastructure of state secondary education facilities is carried out according to the formula:
General = Construction 1,2,3... + Renovation 1,2,3... + Refitting 1,2,3…
where:
S building1,2,3 ... – the amount of expenses for the construction of state secondary education facilities aimed at eliminating the shortage of student places and replacing emergency facilities, determined on the basis of approved design and estimate documentation, which has a positive conclusion from a comprehensive non-departmental expertise, and (or) consolidated estimates.
Remont1,2,3 ... – the amount of expenses for capital repairs of state secondary education facilities, determined on the basis of approved design and estimate documentation, which has a positive conclusion from a comprehensive non-departmental expert examination, and (or) consolidated estimates.
F Equipment 1,2,3 ... – the total amount of funding required for the renovation and (or) modernization of the material and technical base of state secondary education facilities for the corresponding year.
The number of state secondary education facilities in a single year of a five-year period is calculated taking into account the provision of settlements with secondary education facilities according to the System of regional standards, the Standard of the network of educational organizations and the list of construction, reconstruction and capital repairs of state secondary education facilities approved by the local executive body.
12. The planning of the volume of minimum thresholds for budget financing for the development of the infrastructure of secondary education facilities and the execution of allocated budget funds is carried out in accordance with paragraph 4 of Article 80 of the Budget Code of the Republic of Kazakhstan.
Chapter 3. The procedure for the construction, reconstruction and overhaul of state secondary education facilities
13. The construction, reconstruction and major repairs of state secondary education facilities are carried out in accordance with the legislation in the field of architectural, construction and urban planning activities and state regulatory documents.
14. The local executive body carries out the following activities during the construction, reconstruction and overhaul of state secondary education facilities:
1) determination of the land plot during the construction and reconstruction of state secondary education facilities in accordance with Article 12 of the Law of the Republic of Kazakhstan "On Architectural, Urban Planning and construction activities in the Republic of Kazakhstan", including the requirements for the functional zoning of the territory of the settlement;
2) carrying out construction, reconstruction and capital repairs of state secondary education facilities in accordance with the Rules for the organization of development and passage of licensing procedures in the field of construction, approved by Order of the Minister of National Economy of the Republic of Kazakhstan dated November 30, 2015 No. 750 (registered in the Register of State Registration of Regulatory Legal Acts under No. 12684);
3) reconstruction and overhaul of state secondary education facilities based on the results of a technical survey in accordance with the Rules for conducting a technical survey of the Reliability and Stability of Buildings and Structures approved by Order No. 702 of the Minister of National Economy of the Republic of Kazakhstan dated November 19, 2015 (registered in the Register of State Registration of Regulatory Legal Acts under No. 12425);
4) material and technical support in accordance with the Standards for Equipping preschool, secondary education, and special education organizations with Equipment and Furniture, approved by Order No. 70 of the Minister of Education and Science of the Republic of Kazakhstan dated January 22, 2016 (registered in the Register of State Registration of Regulatory Legal Acts under No. 13272) (hereinafter referred to as the Standards of Equipment);
5) compliance with the safety requirements of students in accordance with the Instructions on the organization of anti-terrorist protection of facilities vulnerable to terrorism operating in the field of education of the Republic of Kazakhstan, approved by Order of the Minister of Education and Science of the Republic of Kazakhstan dated March 30, 2022 No. 117 (registered in the Register of State Registration of Regulatory Legal Acts under No. 27414), Fire Safety Rules, approved by the Order of the Minister of Emergency Situations of the Republic of Kazakhstan dated February 21, 2022 No. 55 (registered in the Register of State Registration of Regulatory Legal Acts under No. 26867), as well as the requirements of the Sanitary Rules "Sanitary and epidemiological requirements for educational facilities", approved by the Order of the Minister of Health of the Republic of Kazakhstan dated August 5, 2021 No. KR DSM-76 (registered in the Register of State Registration of Regulatory Legal Acts under No. 23890).
15. In the absence of sports, assembly halls, canteens and a food hall, a library, and sufficient space to accommodate classrooms, local executive authorities carry out work on the construction of additional buildings or reconstruction (extension, superstructure, redevelopment) of the existing building.
16. During major repairs of state secondary education facilities, repair and construction works are carried out to restore or replace worn-out building elements, increase the stability of buildings in earthquake-prone areas, eliminate malfunctions of all worn structures and parts, restore or replace them (except for the complete replacement of stone and concrete foundations, load-bearing walls and frames) with more durable and economical ones that improve performance indicators of buildings, taking into account economic feasibility, while improving the layout, increasing the number and quality of services, equipping with missing types of engineering equipment, landscaping of the surrounding area, insulation of buildings (work to improve the heat-protective properties of enclosing structures), replacement of engineering networks that are on the balance sheet of the building owner.
