On approval of the Rules for Financing projects in the field of waste management

Resolution of the Government of the Republic of Kazakhstan dated August 26, 2026 No. 762

 In accordance with subparagraph 17) of paragraph 1 of Article 388 of the Environmental Code of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan DECIDES:

     1. To approve the attached Rules for Financing Projects in the field of waste management.

     2. This resolution comes into effect on September 8, 2026 and is subject to official publication.

Rules for financing waste management projects

Chapter 1. General provisions

     1. These Rules for Financing Waste Management Projects (hereinafter referred to as the Rules) define the procedure and conditions for the operator to finance extended obligations of producers (importers) of waste management projects from money deposited into its bank account from producers and importers in accordance with paragraph 1 of Article 388 of the Environmental Code of the Republic of Kazakhstan.

     2. For the purposes of these Rules, waste management projects include projects aimed at developing a waste management system, including:

     1) creation, construction, reconstruction, modernization and expansion of waste accumulation infrastructure at the place of their formation;

     2) creation, construction, reconstruction, modernization and expansion of waste collection infrastructure, including separate waste collection;

     3) creation, construction, reconstruction, modernization and expansion of waste transportation infrastructure;

     4) creation, construction, reconstruction, modernization and expansion of waste recovery infrastructure, including preparation for reuse, recycling and waste disposal;

     5) creation, construction, reconstruction, modernization and expansion of waste disposal infrastructure, including waste disposal and burial.

Chapter 2. Procedure and conditions for financing waste management projects

     3. The operator of extended obligations of producers (importers) (hereinafter referred to as the operator) provides a loan to the joint Stock company "Industrial Development Fund" (hereinafter referred to as the fund) for a total amount of up to 54000000000 (fifty–four billion) tenge in the period 2026-2028 for subsequent financing of local executive bodies or subordinate organizations of the local executive body (hereinafter referred to as the MIO) for the creation, construction, reconstruction, modernization and expansion of waste disposal infrastructure, including waste disposal and burial (hereinafter referred to as – creation, construction, reconstruction, modernization and expansion of municipal solid waste landfills) under the following conditions:

     1) the interest rate on the loan is 0.01% (zero point one hundredth of a percent) for the entire term of the loan;

     2) The loan term is up to 10 (ten) years.;

     3) repayment of the principal debt – once a year with a grace period for repayment of the principal debt of no more than 1 (one) year from the date of conclusion of the loan agreement between the operator and the fund and the right to partial or full early repayment on the initiative of the fund;

     4) payment of interest on the loan is a one–time payment for the entire term of the loan.;

     5) the loan is provided without collateral;

     6) other terms of the loan agreement are determined by agreement of the parties in accordance with the legislation of the Republic of Kazakhstan.

     4. The loan is provided by the operator to the fund in installments based on the application of the fund and the decision of the authorized body of the fund on approval of financing of the relevant M&E project.

     5. The money returned to the operator as a result of repayment of the loan by the fund is accumulated in the operator's bank account and used for subsequent financing of projects for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste in accordance with the procedure established by these Rules.

     6. The Fund enters into loan agreements with M&E on the following basic terms:

     1) the interest rate on the loan is no more than 3% (three percent) per annum;

     2) The loan term is up to 10 (ten) years.;

     3) repayment of the principal debt – once a year with a grace period for repayment of the principal debt of no more than 1 (one) year from the date of conclusion of the loan agreement between the fund and the M&E and the right to partial or full early repayment;

     4) Loan interest is paid once a year.;

     5) The loan is granted without collateral, provided that the M&E confirms the availability in the relevant local budget of the money necessary for servicing and repayment of the loan, or the M&E's commitment to include such expenses in the local budget for the relevant financial years in accordance with the procedure established by the budget legislation of the Republic of Kazakhstan.;

     6) other terms of the loan agreement are determined in accordance with the requirements of the fund and (or) by agreement of the parties in accordance with the legislation of the Republic of Kazakhstan.

     7. An M&E loan for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste is provided in the presence of design and estimate documentation that has received a positive state expert opinion in accordance with the procedure established by the legislation of the Republic of Kazakhstan, within the costs directly related to the construction of a solid waste disposal facility provided for in the relevant sections of the design and estimate documentation.

     8. Financing of projects for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste is carried out in the presence of an existing infrastructure for sorting solid household waste, which ensures the processing of the volume of waste generated in the territory for which the construction of the landfill is envisaged, or documents confirming the implementation of measures to create such infrastructure.

     In the absence of a functioning solid waste sorting infrastructure, the M&E represents:

     1) the decision of the Ministry of Economic Development on the implementation of a project to create a solid waste sorting facility or another document confirming the adoption of measures to create such an object;

     2) information about the land plot, the planned capacity of the facility and the timing of its commissioning;

     3) documents confirming the sources of financing for the construction of a solid waste sorting facility.

     9. The money provided in accordance with these Rules for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste is used exclusively for these purposes and is not subject to use for the construction, reconstruction, modernization and equipping facilities for sorting solid household waste, as well as for the creation and supply of engineering and transport infrastructure to landfills. disposal of solid household waste.

     10. Financing of the increase in the cost of the project is carried out by the M&E at the expense of the relevant local budget and (or) other sources not prohibited by the legislation of the Republic of Kazakhstan. The loan amount approved by the fund cannot be increased.

     11. Financing by the M&E Fund is carried out in the following order:

     1) The MIO sends to the fund an application for financing a project for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste, accompanied by a project passport, design estimates that have received a positive conclusion from the state expert examination, documents provided for in paragraph 8 of these Rules (if necessary), as well as other documents determined by the fund (project passport It is drawn up in accordance with the annex to these Rules and contains general information about the project and the applicant, the purpose and description of the project., the main technical characteristics of the facility, information on the cost of the project and the structure of its financing, the list of facilities, works and equipment financed by borrowed funds, the main indicators of the design and estimate documentation, information on the positive conclusion of the state expertise and the timing of the project);

     2) The fund, within 10 (ten) business days from the date of receipt of the application and documents, reviews them and sends them to the authorized body in the field of environmental protection.;

     3) The authorized body in the field of environmental protection, within 10 (ten) working days from the date of receipt of the application and documents, submits the draft for consideration by the interdepartmental commission for the review of projects for the construction of solid waste disposal facilities (hereinafter referred to as – commission) to confirm the need for the project, its focus on improving the environment and achieving targets in the field of solid waste management, provided for in the Concept for the Transition of the Republic of Kazakhstan to a "green economy", approved by Decree of the President of the Republic of Kazakhstan dated May 30, 2013 No. 577;

     4) the authorized body in the field of environmental protection, within 5 (five) business days from the date of the commission's decision, sends the fund a letter with a positive decision of the commission or a reasoned refusal attached (if a reasoned refusal is received, the fund, together with the M&E, finalizes the documents and resends them for consideration in accordance with subparagraph 2) of this paragraph of the Rules, or sends a reasoned refusal of financing to the MIO);

5) if the Commission makes a positive decision, the Fund shall, within 30 (thirty) business days from the date of receipt of the letter provided for in subparagraph 4) this paragraph, reviews the draft and documents submitted by the MIO, verifies them for compliance with the requirements of these Rules, conditions and requirements of the fund, used in financing relevant projects (based on the results of the review and upon confirmation of the project's compliance and the submitted documents with the specified requirements, the fund sends the operator a letter on the project's compliance with the fund's requirements, accompanied by the commission's decision, project passport and information on the projected amount of project financing for the relevant financial year);

     6) The operator, within 7 (seven) business days from the date of receipt of the documents provided for in subparagraph 5) of this paragraph of the Rules, includes the projected amount of financing in the relevant section of the operator's investment policy and sends it for approval to the authorized body in the field of environmental protection.;

     7) the authorized body in the field of environmental protection, within 10 (ten) business days from the date of receipt of the operator's investment policy, coordinates it or sends the operator a reasoned refusal to approve it (in case of receipt of a reasoned refusal, the operator eliminates the reasons for the refusal within 3 (three) business days and re-sends the operator's investment policy for approval to the authorized body in areas of environmental protection);

     8) The operator, within 5 (five) business days from the date of receipt of the approval provided for in subparagraph 7) of this paragraph of the Rules, concludes a loan agreement with the fund for the amount of the approved amount of financing.;

     9) The Fund provides a loan to an M&E for the implementation of a project for the creation, construction, reconstruction, modernization and expansion of landfills of solid household waste under the conditions provided for in paragraph 6 of these Rules.

     12. Control over the targeted use of funds allocated for the implementation of projects in accordance with these Rules is carried out by the fund and the operator.
