In accordance with subparagraph 32-1) of Article 13 of the Law of the Republic of Kazakhstan "On Geodesy, Cartography and Spatial Data" and subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services", I ORDER:

     1. To approve the attached Rules for issuing an opinion on the conformity of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems.

     2. The Department of Geodesy and Spatial Data of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for issuing an opinion on the conformity of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems

Chapter 1. General provisions

     1. These Rules for issuing an opinion on the conformity of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems (hereinafter referred to as – The Rules) were developed in accordance with subparagraph 32-1) of Article 13 of the Law of the Republic of Kazakhstan "On Geodesy, Cartography and Spatial Data" and subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services" and determine the procedure for issuing an opinion on the compliance of topographic, geodetic, cartographic, aerial photography materials with established state or local coordinate reference systems.

     2. The following concepts are used in these Rules:

     1) altitude reference system – a reference system for determining the heights of points on the Earth's surface relative to the initial leveled surface;

     2) the authorized body in the field of geodesy, cartography and spatial data (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of geodesy, cartography and spatial data;

     3) geodetic base – a set of points fixed on the ground, the position of which is determined on the basis of geodetic measurements in a single coordinate reference system.;

     4) Gravimetric reference system – a reference system for determining absolute or relative measurements of gravity acceleration;

     5) local coordinate reference system – the coordinate reference system of the projection, established in relation to a limited territory not exceeding the border of the administrative-territorial unit of the Republic of Kazakhstan;

     6) Cartographic projection is a mathematically defined way of displaying the Earth's surface;

     7) coordinate transformation – the transition from one coordinate reference system to another coordinate reference system, which are based on the same datums.;

     8) coordinate transformation – the transition from one coordinate reference system associated with one datum to another coordinate reference system with another datum;

     9) service recipient – individuals and legal entities, branches and representative offices of legal entities who have the right and (or) intention to apply for a state or socially responsible service or who receive a state or socially responsible service or who have received the result of providing a state or socially responsible service to realize their rights, freedoms and legitimate interests with the provision of appropriate tangible or intangible benefits;

     10) conclusion – a document confirming the compliance of the materials of topographic, geodetic, cartographic, aerial photography works with established state or local coordinate reference systems.;

     11) the state reference system is a set of state coordinate, altitude and gravimetric reference systems extending over the entire territory of the Republic of Kazakhstan.

     3. Issuing an opinion on the compliance of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems is a public service (hereinafter referred to as a public service) and is provided by the Republican State Enterprise under the right of economic management "National Center for Geodesy and Spatial Information" of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan (hereinafter referred to as the service provider).

     4. The authorized body in the field of geodesy, cartography and spatial data, within three working days from the date of approval or amendment of the subordinate regulatory legal act defining the procedure for the provision of public services, updates information on the procedure for its provision and sends it to the Unified Contact Center, the operator of the digital infrastructure of the digital government.

Chapter 2. The procedure for issuing an opinion on the conformity of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems

     5. The list of basic requirements for the provision of public services (hereinafter referred to as the List) is set out in Appendix 1 to these Rules.

     6. The public service provided for in these Rules is provided free of charge.

     7. The materials of topographic and geodetic, cartographic, and aerial photography works for compliance with established state or local coordinate reference systems are submitted for review after completion of field and desk work - before entering information into the state land cadastre, the unified state cadastre of real estate.

     8. When drawing up and issuing an opinion on the compliance of topographic, geodetic, cartographic, and aerial photography materials with established state or local coordinate reference systems, the Kazakhstan Earth Coordinate Reference Frame of 2023 (Qazaqstan Terrestrial Reference Frame 2023, QazTRF-23) is used, established in accordance with Resolution of the Government of the Republic of Kazakhstan dated March 14, 2023 No. 208 "On the Establishment of State reference systems and cartographic projections".

     9. In order to receive a public service, service recipients send to the service provider an application for an opinion in the form of an electronic document (hereinafter referred to as the application), in accordance with Appendix 2 to these Rules.

     10. Applications for an opinion, as well as the materials attached to them containing information constituting state secrets, are considered in accordance with the requirements of the Law of the Republic of Kazakhstan "On State Secrets" and other regulatory legal acts of the Republic of Kazakhstan in the field of protection of state secrets.

     11. Applications for an opinion, as well as the materials attached to them containing official information of limited distribution, are considered in compliance with the requirements of the legislation of the Republic of Kazakhstan on the protection of official information of limited distribution.

     12. On the day of receipt of the application in accordance with Appendix 2 to these Rules, an employee of the service provider's office verifies the completeness of the submitted documents and information in accordance with item 9 of the List, accepts and registers them, and also submits it to the responsible structural unit of the service provider.

     If the service recipient provides an incomplete package of documents and information in accordance with item 9 of the List, the employee of the service provider's office refuses to accept the application.

If the recipient applies after the end of working hours, on weekends and holidays, the application is accepted and the results of the provision of public services are issued on the next working day following it.

     13. The deadline for issuing an opinion from the date of submission of the application by the service recipient is 10 (ten) business days.

     14. The responsible employee of the structural unit of the service provider (hereinafter referred to as the responsible employee), within 7 (seven) business days from the date of registration of the application, checks whether the submitted materials of topographic, geodetic, cartographic, and aerial photography works comply with the state or local coordinate reference systems established in the territory of the Republic of Kazakhstan.

     15. The verification of materials includes the following steps::

     1) checking the completeness of the submitted materials;

     2) Metadata and documentation analysis;

     3) checking the coordinate reference system used;

     4) control of the parameters of the cartographic projection;

     5) Coordinate transformation analysis;

     6) evaluation of the accuracy of the coordinate reference.

     16. The coordinate data is checked by:

     1) attribute information analysis;

     2) comparisons with control and reference data;

     3) the use of specialized software tools for processing geodetic and spatial data.

     17. The conformity of spatial data with the state or local coordinate reference systems QazTRF-23 is assessed by comparing it with reference orthophotomaterials. At the same time, orthophotographs with a resolution of 0.2 m are used for the territories of cities and settlements, orthophotomosaics with a resolution of 1 m are used for the rest of the territory, the maximum permissible deviations should not exceed half the pixel size of the corresponding reference material (0.10 m and 0.50 m, respectively), and the decision on compliance is made based on a quantitative analysis of these deviations without the use of subjective ratings.

     18. Based on the results of the audit, the responsible employee forms an electronic decision within 1 (one) business day to issue an opinion in accordance with Annex 3 to these Rules or a reasoned refusal to provide public services in accordance with Annex 4 to these Rules, which is sent for approval and verification to the head of the service provider.

     The head of the service provider verifies the electronic solution and signs it using an electronic digital signature within 1 (one) business day.

     When the grounds for refusal to provide public services are identified, the service provider notifies the service recipient of the preliminary decision to refuse to provide public services, as well as the time and place (method) of the hearing for the opportunity to express the position of the service recipient on the preliminary decision.

     The notification of the hearing is sent no later than 3 (three) business days before the end of the period for the provision of public services. The hearing is held no later than 2 (two) business days from the date of notification.

     The notification is sent to the subscriber's cellular communication device by number or e-mail address, or by other means of communication that ensure the recording of the notification.

     The hearing procedure is conducted in accordance with the Administrative Procedural Code of the Republic of Kazakhstan (hereinafter referred to as the APPC).

     The service recipient submits or expresses an objection to the preliminary decision of the service provider no later than 2 (two) business days from the date of its receipt.

     Based on the results of the hearing, the service provider decides whether to issue an opinion or a reasoned refusal to provide public services.

Chapter 3. Procedure for appealing decisions, actions (omissions) of the service provider and (or) its officials on the provision of public services

     19. The decision, action (inaction) of the service provider, as well as its officials, may be appealed in a pre-trial and (or) judicial procedure in accordance with the APPC.

The public service provided for in these Rules is provided free of charge.

8

Work schedule

1) service provider – from Monday to Friday from 8.00 to 17.30 hours, with a lunch break from 13.00 to 14.30 hours, except for weekends and holidays, in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the Law of the Republic of Kazakhstan "On Holidays in the Republic of Kazakhstan" (hereinafter – the Law on Holidays).The acceptance of the application and the issuance of the result of the provision of public services is set from 8.30 a.m. to 5 p.m. with a lunch break from 1 p.m. to 2 p.m.Public services are provided on a first-come, first-served basis, without prior appointment and expedited maintenance; 2) portal – around the clock, with the exception of technical interruptions due to repair work (if the recipient applies after the end of working hours, on weekends and holidays, according to the labor legislation of the Republic of Kazakhstan and Article 5 of the Law on Holidays, the application is accepted and the result of the provision of public services is issued on the next working day following it).

Grounds for refusal to provide public services and their subspecies (if any), established by the laws of the Republic of Kazakhstan

1) establishing the unreliability of documents submitted by the service recipient to receive a public service and (or) the data (information) contained therein; 2) in respect of the service recipient, there is a court decision (verdict) that has entered into legal force prohibiting activities or certain types of activities requiring public services; 3) in respect of the service recipient, there is a court decision that has entered into legal force, on the basis of which the service recipient is deprived of a special right related to receiving a public service; 4) lack of consent of the service recipient, provided in accordance with Article 8 of the Law of the Republic of Kazakhstan "On Personal Data and their Protection", for access to personal data of limited access required for the provision of public services; 5) non-compliance with established state or local coordinate reference systems and the requirements of regulatory legal acts in the field of geodesy, cartography and spatial data.
