On approval of the Rules for labeling and traceability of motor oils

Order of the Minister of Energy of the Republic of Kazakhstan dated January 30, 2026 No. 44-n/k. It was registered with the Ministry of Justice of the Republic of Kazakhstan on February 2, 2026, No. 37926.

 In accordance with subparagraph 2) of Article 7-2 of the Law of the Republic of Kazakhstan "On Regulation of Trading Activities", I ORDER:

     1. Approve the attached Rules for Labeling and Traceability of Motor Oils (hereinafter referred to as the Rules).

     2. The Department of Petrochemistry and Technical Regulation of the Ministry of Energy of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Energy of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Department of Legal Service of the Ministry of Energy of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1), 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Energy of the Republic of Kazakhstan.

     4. This order shall enter into force sixty calendar days after the date of its first official publication, with the exception of Chapter 11 of the Rules, which will enter into force on February 1, 2027.

Rules for labeling and traceability of motor oils

Chapter 1. General provisions

     1. These Rules for Labeling and Traceability of Motor Oils (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 2) of Article 7-2 of the Law of the Republic of Kazakhstan "On Regulation of Trade Activities" (hereinafter referred to as the Law) and define the procedure for labeling motor oils by means of identification and their further traceability in the territory of the Republic of Kazakhstan.

     2. The following definitions and abbreviations are used in these Rules:

     1) aggregation is a set of actions aimed at establishing a logical relationship between the identification codes of individual units of labeled goods and the identification code applied to a group or transport package, in order to enable tracking of the enclosed contents without opening the specified package.;

     2) hardware and software complex – a set of software and hardware tools jointly used to solve problems of a certain type related to labeling and traceability of goods;

     3) data transmission protocol is a formalized set of technical requirements for the structure of information packets and the algorithm for exchanging information packets between data transmission network devices;

     4) The EAEU is the Eurasian Economic Union;

     5) importer – a participant in the turnover of motor oils, importing motor oil into the customs territory of the EAEU in accordance with the customs legislation of the EAEU and (or) the customs legislation of the Republic of Kazakhstan, as well as importing motor oil into the territory of the Republic of Kazakhstan from the territory of another EAEU member state;

     6) transport package – a package combining consumer packages of labeled motor oil and (or) group packages and used for storing and transporting motor oil in order to protect it from damage during movement and forming an independent transport unit;

     7) the transport package identification code is a unique combination of symbols for each individual transport package, formed in accordance with the requirements provided for in Chapter 6 of these Rules.;

     8) application code is a prefix consisting of a set of 2 (two) or more characters located at the beginning of an element line and uniquely defining the purpose and format of the data field following the prefix.;

     9) turnover of motor oils – importation into the Republic of Kazakhstan, storage, transportation, receipt and transfer of motor oil, including its purchase and sale on the territory of the Republic of Kazakhstan;

     10) a participant in the turnover of motor oils is an individual entrepreneur or a legal entity that is a resident of the Republic of Kazakhstan and carries out the commissioning and (or) turnover and (or) withdrawal from circulation of labeled motor oil;

     11) motor oil – products belonging to the commodity group "Motor oils" according to the codes of the unified commodity nomenclature of foreign economic activity of the Eurasian Economic Union 2710 19 820 0, 3403 19 100 0, 3403 19 900 0, 3403 99 000 0, and included in the List of goods subject to labeling, determined by the order of the Acting Minister of Commerce and Integration of the Republic of Kazakhstan dated September 27, 2024 No. 343-NK (registered in the Register of State Registration of Regulatory Legal Acts under No. 35129) (hereinafter referred to as the List of Goods);

     12) manufacturer – an individual entrepreneur or a legal entity, resident of the Republic of Kazakhstan, engaged in the production of motor oils for subsequent sale;

     13) identification code – a sequence of characters representing a unique combination of the product code (GTIN - Global Trade Item Number) and the individual serial number of the product unit;

     14) means of identification – the engine oil labeling code in machine-readable form, presented as a two-dimensional matrix barcode for application to consumer and (or) group packaging, or to a label located directly on consumer packaging or group packaging of engine oil;

     15) decommissioning of labeled motor oils – sale (sale) of labeled engine oil to an individual for personal consumption through a cash register with the function of recording and (or) transmitting data, registered in accordance with the Order of the Minister of Finance of the Republic of Kazakhstan dated February 16, 2018 No. 208 "On certain issues of the use of cash registers" (registered in the Register of State Registration of Regulatory 16508), seizure (confiscation), disposal, damage, destruction, irretrievable loss and other reasons suggesting the cessation of further turnover of engine oil;

     16) marked engine oil – engine oil on which, in accordance with these Rules, a means of identification is applied, reflecting reliable information (including information about the means of identification applied on it and (or) a material carrier containing the means of identification) in the information system of labeling and traceability of goods;

     17) the labeling code is a unique sequence of symbols consisting of a product identification code and a verification code, formed by a Single operator of labeling and traceability of goods for the purpose of identifying consumer packaging of motor oil;

     18) individual serial number of a product is a symbolic sequence that uniquely identifies a product unit within a product range;

     19) the information system of labeling and traceability of goods is an information system designed to ensure the labeling of goods subject to labeling by means of identification and their further traceability in the process of turnover;

     20) a single operator of labeling and traceability of goods (hereinafter referred to as the Operator) – a state-owned enterprise, joint-stock company, limited liability company, more than fifty percent of the voting shares (shares in the authorized capital) of which are directly or indirectly owned by the state, which develops, administers, maintains and maintains an information system for labeling and traceability of goods, including the development, maintenance and updating of the National Catalog of Goods, and other functions, stipulated by the legislation of the Republic of Kazakhstan;

     21) register of documents of the information system of labeling and traceability of goods – a list of documents registered in the information system of labeling and traceability of goods, formed by participants in the turnover of motor oils;

     22) register of means of identification of the information system of labeling and traceability of goods – a list of means of identification registered in the information system of labeling and traceability of goods by participants in the turnover of motor oils;

     23) register of goods of the information system of labeling and traceability of goods – a list of goods registered in the information system of labeling and traceability of goods formed by participants in the turnover of motor oils;

     24) register of participants in the turnover of goods of the information system of labeling and traceability of goods – a list of participants in the turnover of motor oils registered in the information system of labeling and traceability of goods;

     25) register of authorized persons participating in the information system of labeling and traceability of goods – a list of authorized persons registered in the information system of labeling and traceability of goods participating in the turnover of motor oils;

     26) verification code – a sequence of characters formed as a result of the cryptographic transformation of the product identification code and allowing to detect the falsification of the identification code;

     27) group packaging – packaging that combines a certain number of consumer packages of motor oil;

28) consumer packaging – packaging intended for the primary packaging and sale of motor oil to the end user;

     29) electronic interaction interface – a description of the ways of interaction between the hardware and software of participants in the turnover of motor oils and the information system for labeling and traceability of goods;

     30) an electronic digital signature is a set of electronic digital symbols created by means of an electronic digital signature and confirming the authenticity of an electronic document, its affiliation and the immutability of its content;

     31) ASCII – American Standard Code for Information Interchange (American Standard Code for Information Exchange) is a method of encoding information in which numeric codes correspond to printed and non–printed characters.;

     32) ASCII 232 (FNC1) – ASCII Function 1 Symbol Character (control function symbol 1), a special symbol that indicates that the encoded sequence is the GS1 code;

     33) DataMatrix is a two–dimensional matrix barcode, which consists of black and white elements or elements of several different degrees of brightness, applied in the form of a square, placed in a rectangular or square group, designed to encode text or other types of data.;

     34) DataMatrix ESS200 is a version of DataMatrix that uses error prevention and recovery technology for corrupted information, enabling recovery of the entire sequence of encoded information in cases where the code contains up to 30 percent damage, which has an error rate of less than 1 per 10 million scanned characters.;

     35) GCP – Global Company Prefix (Global Company Prefix) – the international company number (prefix) assigned to the company in the Global Standards 1 (GS1) system;

     36) GPC – Global Product Classification (Global Product Classifier) – a system classifying products into categories based on their main characteristics, as well as describing their relationships with other products;

     37) GS1 – Global Standards 1 is an international organization in the field of standardization of accounting and bar coding of logistics units;

     38) GS1-128 is a barcode format of the global organization for Standardization GS1, designed to transfer information about cargo between enterprises;

     39) GTIN – Global Trade Item Number (Global Trade Unit Number) is a global identification number assigned to a group of goods by the national (regional) GS1 organization in accordance with established GS1 system standards, for the purpose of its unambiguous identification in the global economic space, and used as a product code in the information system for labeling and traceability of goods;

     40) SSCC – (Serial Shipping Container Code) is the serial code of the transport package, which is a unique identifier for cargo traceability in the supply chain, conforming to international GS1 standards.

Chapter 2. Participants in the turnover of motor oils who carry out labeling by means of identification

     3. The manufacturer marks the engine oil produced in the territory of the Republic of Kazakhstan with a means of identification before its initial paid or gratuitous transfer to a new owner or another person for the purpose of alienation to such a person or for subsequent sale, which makes it available for distribution and (or) use.

     The importer ensures that motor oils produced outside the territory of the Republic of Kazakhstan are marked with a means of identification before being imported into the territory of the Republic of Kazakhstan or before being placed under customs procedures for release for domestic consumption or reimportation.

     4. The requirements for labeling motor oils by means of identification do not apply to the cases specified in Article 8 of the Agreement on Labeling Goods by Means of Identification in the Eurasian Economic Union dated February 2, 2018, ratified by the Law of the Republic of Kazakhstan dated March 1, 2019.

Chapter 3. Technical conditions for the activities of participants in the turnover of motor oils in the information system of labeling and traceability of goods

     5. The conditions for carrying out the activities of participants in the turnover of motor oils in the information system of labeling and traceability of goods are the presence of:

     1) electronic digital signature;

     2) a hardware and software complex connected via communication channels to the information system for labeling and traceability of goods, which provides automated data transmission to the Operator in terms of obtaining labeling codes, sending information about the use of labeling codes, followed by sending information about the aggregation of identification tools (when using aggregation), as well as information about putting it into circulation, the turnover and (or) withdrawal of marked engine oil from circulation in the information system for labeling and traceability of goods in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource.

     In the absence of such a hardware and software package or the lack of integration with the information system for labeling and traceability of goods, the participant in the turnover of motor oils sends information to the Operator through the personal account of the information system for labeling and traceability of goods.

     6. A participant in the turnover of motor oils engaged in the retail sale of motor oils, except for the conditions established by paragraph 5 of these Rules, ensures the availability of:

     1) a cash register machine with the function of recording and (or) transmitting data;

     2) a scanning device that can be connected to a cash register machine for reading identification tools;

     3) an agreement concluded with the fiscal data operator on the transfer of information on the decommissioning of labeled motor oils using a cash register for each unit of engine oil sold.

     7. Manufacturers and Importers of Motor Oil:

     1) carry out their own registration in the information system of labeling and traceability of goods prior to the start of activities related to the introduction into circulation and (or) turnover of labeled motor oils;

     2) carry out registration of engine oil subject to labeling by means of identification in the information system of labeling and traceability of goods;

     3) ensure that the hardware and software complex (if available) is ready for information interaction with the information system for labeling and traceability of goods in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource.;

     4) enter in real time into the information system of labeling and traceability of goods information on the labeling of motor oil subject to labeling by means of identification, as well as information on the introduction into circulation, turnover and (or) withdrawal from circulation of labeled motor oil in accordance with Chapters 10-13 of these Rules.

     8. Participants in the turnover of motor oils engaged in the wholesale sale of motor oils:

     1) carry out their own registration in the information system of labeling and traceability of goods in accordance with Chapter 4 of these Rules from the date when it becomes necessary to carry out activities related to the turnover of motor oil subject to labeling by means of identification;

     2) ensure that the hardware and software complex (if available) is ready for information interaction with the information system for labeling and traceability of goods in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource;

     3) enter in real time into the information system of labeling and traceability of goods information on the introduction into circulation of marked engine oil, which is subject to labeling by means of identification (if necessary), as well as information on the turnover and (or) withdrawal from circulation of marked engine oil in accordance with Chapters 10-13 of these Rules.;

     9. Participants in the turnover of motor oils engaged in the retail sale of motor oils:

     1) carry out their own registration in the information system of labeling and traceability of goods in accordance with Chapter 4 of these Rules prior to the start of activities related to the decommissioning and re-commissioning of labeled engine oil;

     2) ensure that the hardware and software complex (if available) is ready for information interaction with the information system for labeling and traceability of goods in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource;

     3) scan and recognize identification devices for the ability to read the two-dimensional DataMatrix code.;

     4) enter into the information system of labeling and traceability of goods information on the introduction into circulation of marked engine oil, which is subject to labeling by means of identification (if necessary), as well as information on the turnover and (or) withdrawal from circulation of marked engine oil, in accordance with Chapters 10-13 of these Rules.

Chapter 4. The procedure for registration of participants in the turnover of motor oils in the information system of labeling and traceability of goods

     10. Registration of participants in the turnover of motor oils in the information system for labeling and traceability of goods and providing them with access to a personal account is carried out by the Operator on the basis of reliable information entered into the information system for labeling and traceability of goods.

     11. The participant in the turnover of motor oils determines the persons authorized to provide and request information in the information system of labeling and traceability of goods on his behalf.

12. According to the results of registration of a participant in the turnover of motor oils in the information system of labeling and traceability of goods, the Operator within 24 (twenty-four) hours:

     1) sends the registration information to the email address specified during registration;

     2) includes a participant in the turnover of motor oils in the register of participants in the information system of labeling and traceability of goods;

     3) provides a participant in the turnover of motor oils with access to the personal account of the information system for labeling and traceability of goods.

Chapter 5. Procedure for registration of motor oil in the information system of labeling and traceability of goods

     13. Registration of motor oil in the information system of labeling and traceability of goods is carried out:

     1) in the production of motor oil on the territory of the Republic of Kazakhstan by the manufacturer (including motor oils produced under contract production and (or) from foreign raw materials placed under the customs procedure of a free customs zone or under the customs procedure of a free warehouse);

     2) for the production of motor oil outside the territory of the Republic of Kazakhstan – by the importer (before importation into the territory of the Republic of Kazakhstan).

     14. To register engine oil in the "Engine Oil" category, a participant in the motor oil turnover indicates the following information in the product labeling and traceability information system:

     1) individual identification number or business identification number of a participant in the turnover of motor oils;

     2) full product name;

     3) information about the shelf life;

     4) information about the trademark, the mark of treatment and conformity;

     5) information about the manufacturer and the manufacturer of the goods;

     6) Product code GTIN;

     7) product classification code by type of economic activity;

     8) the code of the commodity nomenclature of the EAEU foreign economic activity;

     9) GPC code;

     10) brand;

     11) purpose of the product;

     12) declaration of compliance of engine oil with the requirements of the EAEU technical regulations or the requirements established by the legislation of the Republic of Kazakhstan;

     13) Engine oil viscosity grade;

     14) volume;

     15) the unit of volume measurement.

     15. With respect to goods from the list of commodity nomenclature of foreign economic activity of the EAEU, specified in subparagraph 11) of paragraph 2 of these Rules and included in the List of goods, it is necessary to be guided by both the code of the commodity nomenclature of foreign economic activity of the EAEU and the name of the goods.

     16. Registration of information about engine oil in the information system of labeling and traceability of goods is not carried out in the following cases:

     1) the engine oil with the specified product code GTIN has already been registered in the product labeling and traceability information system;

     2) the GTIN product code, according to the GS1 information resource, is not subject to use by a participant in the turnover of motor oils;

     3) The GTIN product code does not exist according to the GS1 information resource.

     17. Based on the results of engine oil registration, the Operator, within 3 (three) business days from the date of entering information about engine oil into the information system for labeling and traceability of goods, includes the submitted information in the register of goods of the information system for labeling and traceability of goods and sends information about the registration of the specified product in the information system for labeling and traceability of goods to the participant in the turnover of motor oils.

Chapter 6. Characteristics of the identification tool

     18. The motor oil identification tool is applied in the form of a two-dimensional DataMatrix GS1 barcode suitable for machine reading on consumer and (or) group packaging, or on a label located directly on consumer packaging and (or) group packaging and containing an identification tool by a method that does not allow the identification tool to be separated without damaging the identification tool. The identification tool cannot be applied to structurally removable parts of consumer packaging without damage.

     When packing labeled motor oils in a group package, if necessary, an identification device is applied to such a package with an aggregation of means of identifying goods placed in such a package.

     The technical conditions for the quality of applying the means of identification to consumer and (or) group packaging, or to a label located directly on consumer packaging or group packaging are:

     printing using the DataMatrix ESS200 error correction method;

     using ASCII encoding.

     The size of the identification tool is determined by the participant in the turnover of motor oils independently. At the same time, the identification tool must be machine-readable.

     19. The consumer and group packaging identification tool contains a labeling code that includes four data groups, of which the first two data groups form the engine oil identification code, while:

     There is a GS1 ASCII 232 (FNC1) symbol at the beginning of the marking code line;

     The first group of data is identified by the application code "01" and contains a GTIN, which consists of fourteen numeric characters.;

     The second group of data is identified by the application code "21" and contains the individual serial number of the engine oil unit, which consists of a numeric or alphanumeric sequence (letters of the Latin alphabet), as well as special characters (! ” % & ’ * + - . / _ , : ; = < > ?). A special separator character with the code 29 in the ASCII symbol table is used as the final character for this group.;

     The third group of data is identified by the application code "91" and contains the verification key, which consists of numbers, lowercase and uppercase letters of the Latin alphabet.

     The fourth group of data is identified by the application code "92" and contains a verification code that consists of a numeric or alphanumeric sequence (letters of the Latin alphabet, as well as special characters (!” % & ’ * + - . / _ , : ; = < > ?).

     20. The transport package identification code is provided to the participant in the turnover of motor oils in the form of a one-dimensional barcode conforming to the international standard GS1-128 in accordance with GOST ISO/IEC 15417-2013 "Information Technology. Automatic identification and data collection technologies. Barcode Symbolism specification Code 128", with a unique identifier of the transport package in the form of the Serial Shipping Container Code (SSCC code) and is identified by the application code AI=’00’. The composition of the transport package identification code is determined by the participant in the turnover of motor oils, which aggregates motor oils into transport packaging.

     21. Identification tools in the barcode format provide:

     1) the probability of forgery by selecting a means of identification is less than 1 (one) in 10,000 (ten thousand);

     2) The recognition and error correction function at or above the DataMatrix ECC200 level.

     22. The information system for labeling and traceability of goods does not allow for the re-generation (generation) of the labeling code contained in the identification tool applied to consumer packaging and (or) group packaging of motor oil or on a label located directly on the product packaging or group packaging.

Chapter 7. The procedure for the formation of identification tools

     23. To ensure the labeling of motor oil by means of identification, a participant in the turnover of motor oils sends a request for labeling codes to the Operator through the information system for labeling and traceability of goods (hereinafter referred to as the request).

     The marking code is refused in the following cases::

     1) the participant in the turnover of motor oils is not registered in the information system of labeling and traceability of goods;

     2) the submitted identification code was previously registered in the information system of labeling and traceability of goods;

     3) the GTIN product code is not registered in the register of goods of the information system for labeling and traceability of goods and/or is not subject to use by a participant in the turnover of motor oils who has declared it;

     4) The GTIN product code does not correspond to the "Motor Oils" product group.

     24. From the moment of registration of the request in the information system of labeling and traceability of goods, the Operator within 4 (four) hours:

     1) emits (generates) the number of labeling codes specified in the request using cryptographic protection algorithms based on data received from a participant in the turnover of motor oils;

     2) includes the relevant identification codes in the register of means of identification of the information system of labeling and traceability of goods;

     3) provides the participant in the turnover of motor oils with information on the composition of the issued labeling codes.

     25. A participant in the turnover of motor oils, no later than 30 (thirty) calendar days from the date of receipt of the labeling code, converts it into a means of identification, ensures that it is applied to consumer and (or) group packaging, or to a label located directly on consumer packaging or group packaging of motor oil, and transmits information about identification codes contained in the means of identification applied to the engine oil.

     Labeling codes, information on which has not been transmitted to the information system for labeling and traceability of goods in accordance with the requirements and within the time limits provided for in this paragraph of the Rules, are canceled.

26. The service for providing a marking code (identification means), the cost of which is determined in accordance with subparagraph 7) of Article 7-2 of the Law, is paid for by a participant in the turnover of motor oils before entering into the information system of labeling and traceability of goods information on the application of an identification means to engine oil, converted from the corresponding labeling code, on the basis of an agreement concluded with The operator.

     The service for providing the marking code (means of identification) is recognized as provided by the Operator at the time of registration in the information system of labeling and traceability of goods of information on the application of means of identification on engine oil, transmitted to the information system of labeling and traceability of goods in accordance with the requirements provided for in this chapter of the Rules.

Chapter 8. The procedure for applying identification tools

     27. The identification means are applied to consumer and (or) group packaging, or to a label located directly on consumer packaging or group packaging during the production and turnover of motor oil in the territory of the Republic of Kazakhstan, at the places of production or storage of motor oil, and upon import before the actual crossing of the state border of the Republic of Kazakhstan, before being placed under customs procedures for release for domestic consumption or reimport.

     28. Engine oil is marked by applying a means of identification to consumer and (or) group packaging, or on a label located directly on consumer packaging or group packaging and containing a means of identification by printing or labeling.

     The identification tool is not printed on a transparent wrapping film or on any other external wrapping material, nor is it overlaid with other information.

Chapter 9. The order of aggregation of motor oils

     29. A participant in the turnover of motor oils submits information on the aggregation of packages to the information system for labeling and traceability of goods before transferring the aggregated package to the next participant.

     30. When aggregating labeled motor oils into a transport package, if necessary, the transport package identification code is applied to such a transport package with the aggregation of identification means placed in such a package. When labeling a transport package, the composition of the optional information fields applied to the transport package is determined by the participant in the turnover of motor oils that pack motor oils into the transport package.

     Transport packaging is used to combine motor oils, as well as to consolidate other smaller transport packages into one transport package.

     31. When transferring group and (or) transport packages of motor oils to another transport package, a participant in the turnover of motor oils provides information on aggregation to the information system for labeling and traceability of goods.

     32. After receiving the information about the aggregation, the operator ensures that they are reflected in the register of means of identification, as well as the availability of this information to the participant in the turnover of motor oils in the information system for labeling and traceability of goods.

Chapter 10. The procedure for submitting information to the information system of labeling and traceability of goods when introducing labeled engine oil into circulation in the territory of the Republic of Kazakhstan

     33. The introduction of engine oil into circulation in the territory of the Republic of Kazakhstan is:

     1) in the production of motor oil on the territory of the Republic of Kazakhstan – the primary paid or gratuitous transfer of labeled motor oil from the manufacturer to a new owner or another person for the purpose of alienation to such a person or for subsequent sale, which makes it available for distribution and (or) use, or as a result of sending information about application of the marking codes contained in the means of identification applied to the engine oil;

     2) when importing motor oil into the territory of the Republic of Kazakhstan – based on the results of entering information on the import of motor oil into the information system of labeling and traceability of goods.

     34. A participant in the turnover of motor oils, who imports motor oil into the territory of the Republic of Kazakhstan, enters information on the import of motor oil into the information system of labeling and traceability of goods.

     35. The entry of information on the import of motor oil into the territory of the Republic of Kazakhstan into the information system of labeling and traceability of goods is made in electronic form, except for the case when a participant in the turnover of motor oils draws up and sends such information on paper when confirming information on the Operator's Internet resource about the impossibility of entering information into the information system of labeling and traceability of goods due to technical errors in the information system of labeling and traceability of goods.

     After the elimination of technical errors, the entry into the information system of labeling and traceability of goods of information on the import of motor oil into the territory of the Republic of Kazakhstan, previously sent in hard copy, is subject to entry by the importer into the information system of labeling and traceability of goods within 1 (one) business day from the date of elimination of technical errors in the information system of labeling and traceability of goods, but no later than the day the engine oil is transferred to third parties.

     IZPI's note!      Chapter 11 is effective from 02/01/2027 in accordance with paragraph 4 of this order.

Chapter 11. The procedure for submitting information to the information system of labeling and traceability of goods during the turnover of labeled motor oils in the territory of the Republic of Kazakhstan

     36. The turnover of labeled motor oils produced in the territory of the Republic of Kazakhstan and (or) imported into the territory of the Republic of Kazakhstan, after the date of introduction of labeling of motor oil by means of identification in the Republic of Kazakhstan, established by the List of Goods, is carried out with the transfer of information about their turnover to the information system of labeling and traceability of goods.

     37. In case of a paid or gratuitous transfer of marked motor oil to a new owner, a participant in the turnover of motor oils enters information about their turnover into the information system for labeling and traceability of goods, no later than the day of sale.

     38. Acceptance of motor oil is carried out by a participant in the turnover of motor oils by confirming information about the turnover of the specified goods within 15 (fifteen) business days from the date of registration of information about their turnover in the information system of labeling and traceability of goods.

     39. Information about the turnover of motor oil is entered in electronic form, except for the case when a participant in the turnover of motor oils forms out information about the turnover on paper when confirming information on the Operator's Internet resource about the impossibility of entering information about the turnover into the information system for labeling and traceability of goods due to technical errors in the information system for labeling and traceability of goods.

     After the elimination of technical errors, the turnover information previously issued on paper must be entered by the participant in the turnover of motor oils into the information system for labeling and traceability of goods within 1 (one) business day from the date of elimination of technical errors in the information system for labeling and traceability of goods, but no later than the day the goods are transferred to third parties.

     40. The change of the owner of the labeling code in the information system of labeling and traceability of goods is carried out on the basis of information confirmed by both parties on the turnover of engine oil in the information system of labeling and traceability of goods.

Chapter 12. The procedure for submitting information to the information system for labeling and traceability of goods during the decommissioning of labeled motor oils

     41. A participant in the turnover of motor oils engaged in the retail sale of labeled motor oil shall withdraw it from circulation only upon confirmation of information about its acceptance in the information system for labeling and traceability of goods by scanning and recognizing the means of identification applied to consumer and (or) group packaging, or on a label located directly on consumer packaging or group packaging. packaging, technical devices connected to the cash register, registered in accordance with the Order of the Minister of Finance of the Republic of Kazakhstan dated October 24, 2025 No. 626 "On certain issues related to the use of cash registers" (registered in the Register of State Registration of Regulatory Legal Acts under No. 37238) (hereinafter referred to as Order No. 626).

     Information about the identification code contained in the identification device applied to consumer and (or) group packaging, or on a label located directly on consumer packaging or group packaging, is included in the receipt of the cash register machine generated by the cash register machine.

     42. The withdrawal of labeled engine oil from retail sales is carried out on the basis of information on the sale of labeled engine oil transmitted to the information system of labeling and traceability of goods by a participant in the turnover of motor oils for each commodity unit sold.

43. When the marked engine oil is withdrawn from circulation for reasons other than retail sale, the participant in the engine oil turnover, no later than 3 (three) business days following the day of withdrawal of the engine oil from circulation, submits to the information system of labeling and traceability of goods information on the withdrawal of engine oil from circulation, indicating the appropriate reason.

     44. Legal entities and individual entrepreneurs who purchase engine oil for use for purposes unrelated to the subsequent sale of these goods accept engine oils from the seller to the buyer, and submit them to the information system within no more than 3 (three) business days following the day the marked engine oil is withdrawn from circulation. labeling and traceability of goods, information about the decommissioning of engine oil.

Chapter 13. Procedure for submitting information to the information system for labeling and traceability of goods during the re-introduction of labeled motor oils

     45. When the consumer returns the marked engine oil, the participant in the turnover of engine oils:

     1) performs the re-entry of such goods into circulation for its further sale and (or) transfer;

     2) performs procedures for returning the check of the cash register machine in accordance with the technical requirements of the cash register machines of Order No. 626.

     46. For the re-entry into circulation of engine oil previously withdrawn from circulation for reasons other than those specified in paragraph 42 of these Rules, a participant in the turnover of engine oils enters information about the re-entry into circulation of the specified engine oil into the information system of labeling and traceability of goods.

     47. Information on the re-introduction of engine oil into circulation is sent to the Operator within no more than 3 (three) business days from the date on which the grounds for re-introduction of engine oil arise.

     48. When the engine oil is returned to circulation with an undamaged means of identification, the engine oil is not re-labeled.

Chapter 14. The procedure for submitting information by a participant in the turnover of motor oils to the Operator

     49. The information provided by a participant in the turnover of motor oils to the Operator of the information system for labeling and traceability of goods is carried out through information and communication technologies through electronic interaction interfaces developed by the Operator, or through the personal account of the information system for labeling and traceability of goods.

     50. When carrying out the introduction into circulation, turnover and withdrawal from circulation of labeled motor oil, the submission of information to the information system for labeling and traceability of goods is carried out by the participant in the turnover of motor oils sequentially.

     The transfer of information about transport packaging and (or) group packaging by a participant in the turnover of motor oils is considered equivalent to the transfer of information about each unit (consumer package) of motor oil contained in transport packaging and (or) group packaging according to the information system of labeling and traceability of goods.

     51. All documents and information sent by a participant in the turnover of motor oils to the information system for labeling and traceability of goods in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource and received by the Operator are subject to reflection in the information system for labeling and traceability of goods.

     52. The operator refuses to accept information provided by a participant in the turnover of motor oils into the information system for labeling and traceability of goods if the information provided contains incorrect information provided for in Chapters 4, 5, 7, 9-14 of these Rules.

     53. The date of submission of information to the information system of labeling and traceability of goods is the date recorded in the personal account of the information system of labeling and traceability of goods.

     54. The participants of the motor oil turnover who provide the information are responsible for the completeness, reliability and timeliness of the information sent to the information system for labeling and traceability of goods.

     55. In order to monitor the turnover of labeled motor oils, the Operator ensures that the following information is available in the product labeling and traceability information system:

     1) about a participant in the turnover of motor oils;

     2) about the engine oil subject to labeling by means of identification;

     3) identification codes transmitted to a participant in the turnover of motor oils;

     4) about the turnover of labeled engine oil and its withdrawal from circulation.

     56. The operator, within the framework of the information system for labeling and traceability of goods, organizes and ensures the maintenance of the following registers of the information system for labeling and traceability of goods:

     1) the register of documents of the information system of labeling and traceability of goods;

     2) the register of participants in the turnover of motor oils of the information system of labeling and traceability of goods;

     3) the register of authorized persons of participants in the turnover of motor oils of the information system of labeling and traceability of goods;

     4) the register of goods of the information system of labeling and traceability of goods;

     5) the register of means of identification of the information system of labeling and traceability of goods.

     57. If the previously submitted information is changed, the participant in the turnover of motor oils, within 3 (three) business days from the date of the change, sends information about the change of the specified information to the Operator via the information system for labeling and traceability of goods.

Chapter 15. Access to information posted in the product labeling and traceability information system

     58. The operator develops and places a free mobile application on the Internet for free use, which provides the following features:

     1) reading the identification tool;

     2) transfer of information contained in the identification tool from the information system of labeling and traceability of goods;

     3) obtaining information about the checked engine oil from the information system of labeling and traceability of goods;

     4) sending information about possible violations of the requirements of these Rules by the user of the mobile application to the information system for labeling and traceability of goods.

     59. The information generated during the traceability process and contained in the product labeling and traceability information system is information with limited access and is provided only to the following persons in the following cases:

     1) a participant in the turnover of motor oils in terms of information about transactions with goods made by this participant in the turnover of motor oils;

     2) state bodies authorized to make such a request for the purpose of fulfilling the tasks and performing the functions assigned to these state bodies in accordance with the legislation of the Republic of Kazakhstan;

     3) to consumers in terms of information about the characteristics of goods, the manufacturer or seller of goods contained in the information system of labeling and traceability of goods.
