On approval of the Rules for Labeling and traceability of saiga Antler derivatives by means of identification

In accordance with subparagraph 2) of Article 7-2 of the Law of the Republic of Kazakhstan "On Regulation of Trading Activities", I ORDER:
1. To approve the attached Rules for labeling and traceability of saiga derivatives by means of identification.
2. The Committee of Forestry and Wildlife of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order, submit to the Department of Legal Service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Ecology and Natural Resources of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for marking and traceability of saiga derivatives (horns) by means of identification
Chapter 1. General provisions
1. These Rules for Labeling and traceability of saiga derivatives (horns) by means of identification (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 2) of Article 7-2 of the Law of the Republic of Kazakhstan "On Regulation of Trade Activities" and define the procedure for labeling saiga derivatives (horns) and their further traceability in the territory of the Republic of Kazakhstan.
2. For the purposes of these Rules, the following abbreviations and definitions are used:
1) aggregation – ensuring the relationship of product labeling codes with the identification code of a group package, which is part of the identification tool applied to a group package when packing labeled goods into group packages, as well as ensuring the relationship of product labeling codes and (or) group packages with the identification code of a group package when packing into a group package, including when combining group packages in group packages of a higher level, in order to ensure that information about labeled goods is obtained without the need to open the package being created.;
2) hardware and software complex (hereinafter referred to as APC) – a set of software and hardware tools jointly used to solve problems of a certain type.;
3) withdrawal – the extraction of objects of the animal world (extraction, fishing, shooting, collection, slaughter) from the habitat of animals living in a state of natural freedom, their parts and derivatives on the basis of a permit for the use of wildlife or a permit for the use of fish resources and other aquatic animals;
4) locking and sealing device (hereinafter referred to as ZPU) is a device designed for fixing and sealing, the design of which is monoblock, includes a housing with a locking mechanism and a metal rope tightly fixed at one end in the housing, while the other end of the rope interacts with the locking mechanism during the sealing process, containing an identification device and designed for labeling of goods;
5) BIN – business identification number;
6) DataMatrix is a two–dimensional matrix barcode, which consists of black and white elements or elements of several different degrees of brightness, applied in the form of a square, placed in a rectangular or square group, designed to encode text or other types of data.;
7) data transmission protocol is a formalized set of technical specifications for the structure of information packets and the algorithm for exchanging information packets between data transmission network devices;
8) derivatives obtained in captivity or semi–captivity - saiga antlers formed as a result of natural death, planned and (or) forced slaughter, as well as other technological operations related to the maintenance and breeding of animals in a nursery;
9) saiga derivatives are products and objects obtained in whole or in part from saiga (Saiga tatarica), including its parts, derivatives and articles made from them, regardless of the degree of processing and form of presentation;
10) exporter of saiga derivatives (horns) – a legal entity authorized to export saiga derivatives (horns);
11) saiga nursery - a legal entity engaged in the breeding, maintenance and reproduction of saiga antelopes (Saiga tatarica) in captivity or semi-captivity;
12) the act of acceptance/transfer is an electronic document generated in the Central Office of the Ministry of Trade for the purpose of transmitting information on identification codes during the turnover of labeled goods in the territory of the Republic of Kazakhstan;
13) specialized organizations - state institutions for the protection, reproduction and sustainable use of wildlife and republican state enterprises for the protection, reproduction and sustainable use of wildlife, as well as the preservation and reproduction of Kazakh dog breeds;
14) identification code – a sequence of characters representing a unique combination of the code and the individual serial number of the product;
15) identification means – a unique sequence of characters in machine-readable form, represented as a bar code, or recorded on a radio frequency tag, or presented using another means (technology) of automatic identification;
16) withdrawal of marked goods from circulation – actions resulting in the termination of further turnover of marked goods, including the sale (sale) of marked goods to a foreign legal entity during export, disposal, damage or destruction of goods, irretrievable loss, other reasons suggesting the termination of further turnover of marked goods;
17) the marking code is a unique sequence of symbols consisting of a product identification code and a verification code generated by the Operator for the purposes of product identification and product group packaging;
18) marked product – a product on which, in accordance with these Rules, a means of identification is applied and reliable information about which (including information about the means of identification applied on it and (or) a material carrier containing the means of identification) is contained in the CA MPT;
19) The Unified Operator of labeling and traceability of goods (hereinafter referred to as the Operator) – a state-owned enterprise, joint-stock company, limited liability company, more than fifty percent of the voting shares (shares in the authorized capital) of which are directly or indirectly owned by the state, which develops, administers, maintains and maintains an information system for labeling and traceability of goods, including the development, maintenance and updating of the National Catalog of Goods, and other functions, stipulated by the legislation of the Republic of Kazakhstan;
20) commodity – derivatives of saiga antlers obtained as a result of extraction, natural death or seizure, classified according to HS code 050790000;
21) individual serial number of a product is a symbolic sequence that uniquely identifies a product, a group package within a product range;
22) the digital system of labeling and traceability of goods (hereinafter referred to as the CC MPT) is an information system designed to ensure the labeling of goods subject to mandatory labeling by means of identification and their further traceability during turnover;
23) turnover of goods – procurement, storage, transportation, receipt and transfer of goods, including their purchase and sale (sale) on the territory of the Republic of Kazakhstan;
24) relabeling of goods (hereinafter referred to as relabeling) is the re-application of a means of identification to goods, group packaging of goods due to the loss or damage of a previously applied means of identification;
25) participant in the turnover of goods – a legal entity that carries out the introduction into circulation, turnover and (or) withdrawal from circulation of labeled goods (specialized organizations, nurseries, exporters);
26) verification code – a sequence of characters formed as a result of the cryptographic transformation of the product identification code and allowing to detect the falsification of the identification code;
27) group packaging – packaging combining labeled goods, used for storing and transporting goods in order to protect them from damage during movement, and forming an independent transport unit;
28) the identification code of a group package is a unique combination of symbols for each individual group package, formed in accordance with the requirements provided for in Chapter 6 of these Rules.;
29) the register of documents of the CA MPT is a list of documents registered in the CA MPT, formed by a participant in the turnover of goods;
30) the register of authorized persons of participants of the CA MPT – the list of authorized persons of the participant of turnover of goods registered in CA MPT;
31) the register of means of identification of the MPT Central Office is a list of means of identification registered in the MPT Central Office by a participant in the turnover of goods;
32) register of participants in the turnover of goods of the MPT Central Committee – a list of participants in the turnover of goods registered in the MPT Central Committee;
33) the register of goods of the CA MPT is a list of goods registered in the CA MPT, formed by a participant in the turnover of goods;
34) authorized body – the central executive body responsible for the management of the protection, reproduction and use of wildlife, with the exception of fish resources and other aquatic animals, in the field of conservation and reproduction of Kazakh dog breeds, as well as inter-sectoral coordination within its powers;
35) electronic interaction interface – a description of the ways in which the software and hardware of a participant in the turnover of goods and the MPT CA interact;
36) an electronic digital signature (hereinafter referred to as EDS) is a set of electronic digital symbols created by means of an electronic digital signature and confirming the authenticity of an electronic document, its affiliation and the immutability of its content.;
37) Origin codes F and C are source codes according to the CITES classification used to identify horns obtained from animals born (F1 and subsequent generations) or bred (second and subsequent generations) in captivity or semi–captivity.
Chapter 2. Participants in the turnover of goods who carry out labeling by means of identification
3. A specialized organization and a nursery label the product before its initial paid or gratuitous transfer to a new owner or another person for the purpose of alienation to such a person or for subsequent sale, which makes it available for distribution and (or) use.
4. In case of loss or damage of the means of identification, the participant in the turnover of goods ensures the re-application of the means of identification to the goods, the group packaging of the goods supplied (sold) as part of the transaction.
5. Saiga nurseries label saiga derivatives (horns) obtained from animals of origin F or C.
Chapter 3. Technical conditions for the implementation of the activities of participants in the turnover of goods in the CA MPT
6. The conditions for carrying out the activities of a participant in the turnover of goods in the CA MPT are the presence of:
1) EDS;
2) an APC connected via communication channels to the MPT CA, which provides automated data transmission to the Operator in terms of receiving labeling codes, sending information on the use of labeling codes, followed by sending information to the MPT CA on the aggregation of identification tools (if aggregation is used), as well as information on the turnover and (or) withdrawal of labeled goods from circulation in the MPT CA in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource.
7. In the absence of AIC or lack of integration with the MPT CA, the participant in the turnover of goods sends information to the Operator through the personal account of the MPT CA.
Chapter 4. The procedure for registration of participants in the turnover of goods in the CA MPT
8. Registration of a participant in the turnover of goods in the MPT CA and granting him access to a personal account is carried out by the Operator on the basis of reliable information provided in electronic form and signed by the EDS of the participant in the turnover of goods.:
1) the BIN of the participant in the turnover of goods;
2) the legal (actual) address of the participant in the turnover of goods;
3) the code of the state revenue authority at the place of registration of the participant in the turnover of goods;
4) bank details of the participant in the turnover of goods (if there is a bank account);
5) type of participation in the turnover of goods (specialized organization, exporter and nursery);
6) contact details of the participant in the turnover of goods: e-mail address, phone number;
7) documents confirming the origin of the kept animals (acts of withdrawal, acts of offspring, acts of origin of generations F and C), as well as permits for keeping animals in captivity or semi-captivity (for nurseries).
9. The participant in the turnover of goods determines the persons authorized to provide and request information from the MPT Central Office on his behalf.
Authorized persons of a participant in the turnover of goods are authorized in their personal account by means of an EDS issued to an employee of this participant in the turnover of goods.
10. A participant in the turnover of goods is denied registration with the MPT CA in the following cases:
1) The BIN specified upon receipt of the EDS does not correspond to the information specified during registration with the MPT CA;
2) The participant in the turnover of goods has already been registered with the MPT CA.
11. According to the results of registration of a participant in the turnover of goods in the MPT CA, the Operator:
1) includes a participant in the turnover of goods in the register of participants of the CA MPT;
2) provides a participant in the turnover of goods with access to the personal account of the MPT CA.
Chapter 5. The procedure for the registration of goods in the CA MPT
12. Registration of the product in the MPT CA is carried out:
1) when goods are seized on the territory of the Republic of Kazakhstan by a specialized organization;
2) when obtaining derivatives of saiga antlers in nurseries;
3) participants in the turnover of goods in the process of turnover of goods when:
replacement of the means of identification due to its loss, damage or destruction (re-application of the means of identification to the product without removing the product from circulation);
the return of goods previously withdrawn from circulation by a participant in the turnover of goods, in the absence of a means of identification applied to it.;
13. To register saiga antler derivatives in the MPT CA, the turnover participant indicates the following information in the MPT CA:
1) Product name;
2) population;
3) the date of registration of the product;
4) Product labeling code;
5) length (in centimeters) of the saiga derivative (horns);
6) grade (1, 2, 3, 4) of saiga derivatives (horns);
7) responsible person (full name, position);
8) Source code of origin:
W – Wild — an animal captured or captured in the wild
R – Ranched — farmed from eggs or young animals harvested in nature;
C – Captive-bred animals — bred in captivity (under controlled conditions, at least second generation);
F – Born in captivity (F1 and subordinate) — An animal born in captivity, including the first generation (F1) and subsequent;
U – Source unknown — origin unknown;
I – Confiscations/seizures — seized (as a result of confiscation or illegal trafficking).
9) information on permits (a document in a prescribed form that entitles individuals and legal entities to use wildlife (with the exception of fish resources and other aquatic animals), as well as to export and sell extracted wildlife (with the exception of fish resources and other aquatic animals), their parts and derivatives, including number of hunting trophies);
10) acts of saiga breeding, acts of origin of generations F and C, acts of natural death, acts of planned or forced slaughter of animals, other technological documents confirming the origin of horns (for nurseries).
14. The operator refuses to register information about the product if the product with the specified product labeling code has already been registered with the MPT CA.
Chapter 6. Characteristics of the identification tool
15. The product identification tool is applied in the form of a two-dimensional Data Matrix barcode, suitable for machine reading, which is fixed on the horn of a saiga antler. The specified code is applied to the PO by laser engraving and assigned to each unit of the product, as well as to the group packaging of the product in order to ensure identification and traceability.
16. The product identification tool contains a labeling code that includes three groups of data, of which the first two groups of data form the product identification code.:
the first group consists of fourteen digits;
The second group consists of seven characters (numbers, lowercase and uppercase letters of the Latin alphabet, as well as special characters) and contains an individual serial number.;
The third group consists of eight characters (numbers, lowercase and uppercase letters of the Latin alphabet, as well as special characters) and contains the verification code.
17. The group packaging identification tool is provided in the form of a two-dimensional barcode in the Data Matrix format.
18. Identification tools meet the following requirements:
1) for group packaging, a module with a size of at least 0.254 millimeters is used.;
2) the probability of forgery by selecting a means of identification is less than one in 10,000;
3) The recognition and error correction function is equivalent to or higher than that of the Data Matrix ECC200.
19. The PO provides:
1) the integrity of the attachment on the saiga derivative (horn);
2) readability of information before the sale of goods to the consumer;
20. The MPT CA does not allow the repeated generation of the marking code contained in the identification tool.
Chapter 7. The procedure for the formation and application of identification tools
21. In order to ensure that goods are marked with a means of identification, a participant in the turnover of goods sends to the Operator through the MPT Central Office a request for a marking code in accordance with Annex 1 to these Rules (hereinafter referred to as the Request).
The labeling code is refused if the participant in the turnover of goods is not registered with the MPT CA.
22. From the moment the Request is registered with the MPT CA, the Operator:
1) emits (generates) the number of labeling codes specified in the Request using cryptographic protection algorithms based on data received from a participant in the turnover of goods;
2) includes the relevant product labeling codes in the register of means of identification of the CA MPT;
3) provides the participant in the turnover of goods with information on the composition of the issued labeling codes;
4) converts the marking codes into identification tools and applies them to the PO by laser engraving.
23. The PO is provided by the Operator to nurseries and specialized organizations for further attachment to the product, to the group packaging of the product.
24. The marking code service is recognized as provided by the Operator at the time of registration in the MPT CA of information on the use of the issued marking code by a participant in the turnover of goods.
25. The installation of a PO on the product, on the group packaging of the product during the production, turnover and return of goods on the territory of the Republic of Kazakhstan is carried out at the places of production or storage of such goods.
Chapter 8. The procedure for aggregating goods
26. After the goods are aggregated into a group package before being transferred to the next participant in the turnover of goods, the participant who carried out the aggregation submits information about the aggregation to the MPT CA in accordance with Annex 2 to these Rules.
27. When aggregating labeled goods into a group package, a PO is installed on such a package with the identification code of the group package, which indicates (aggregates) the means of identifying the goods placed in this package.
28. When labeling a group package, the composition of optional information fields applied to the group package is determined by the participant in the turnover of goods who packs the goods into the group package.
29. Group packaging is used to combine goods, as well as to consolidate other smaller group packages into one group package.
30. In the case of the transfer of group packages of goods to another group package, the participant in the turnover of goods submits information on aggregation to the MPT Central Office in accordance with Appendix 2 of these Rules.
31. At the same time, the disbandment of all packages containing the seized item is recorded in the MPT CA.
32. If a participant in the turnover of goods submits information to the MPT Central Office about the turnover or withdrawal from circulation of a part of the marked goods in a group package, the disbandment of packages containing products withdrawn from packages is recorded in the MPT Central Office.
33. After receiving information about the aggregation or modification of the composition of the group package provided for in this chapter, the operator ensures that they are reflected in the register of means of identification, as well as the availability of this information to the participant in the turnover of goods in the CA MPT.
Chapter 9. The procedure for submitting information to the CA MPT during the turnover of labeled goods in the territory of the Republic of Kazakhstan
34. The introduction of goods into circulation in the territory of the Republic of Kazakhstan is the primary paid or gratuitous transfer of the marked goods from a specialized organization, nursery to an exporter or a foreign buyer.
35. Turnover of labeled goods produced in the territory of the Republic of Kazakhstan and (or) imported into the territory of the Republic of Kazakhstan after the date of introduction of mandatory labeling of goods by means of identification in the Republic of Kazakhstan, established by Order of the Acting Minister of Trade and Integration of the Republic of Kazakhstan dated September 27, 2024 No. 343-NK "On determining the list of goods subject to labeling" (it is registered in the Register of State Registration of Regulatory Legal Acts for No. 35129), it is carried out with mandatory transmission of information on their implementation to the Central Committee of the Ministry of Transport.
36. In case of paid or gratuitous transfer of marked goods to a new owner, a participant in the turnover of goods forms an Act of Acceptance / Transfer in accordance with Annex 3 to these Rules, signs its EDS and sends it to the Central Office of the Ministry of Trade for obtaining a registration number, no later than the day of sale of goods.
37. Acceptance of the goods is carried out by a participant in the turnover of goods by signing an Act of acceptance / transfer within 15 (fifteen) business days from the date when the actual acceptance of the goods was carried out, which is signed by the EDS and transferred to the MPT CA.
38. In case of discrepancies in the acceptance of goods, the recipient participant in the turnover of goods forms a correction report with the identified discrepancies, and sends it to the sender participant in the turnover of goods, who carried out the shipment, to make appropriate changes and sign the correction act of the EDS.
39. The withdrawal of the Acceptance/ Transfer Certificate by the sender is carried out within 20 (twenty) business days after the date of registration with the MPT CA, but until the moment of confirmation by the recipient, without registration of a new act, except for the case provided for in the first part of this paragraph.
40. The correction report with the identified discrepancies contains the following information:
1) Sender's USERNAME;
2) Recipient's BIN;
3) list of identification codes for accepted goods;
4) a list of product identification codes, information on which is missing from the Act of acceptance / transfer (if any);
5) details of the Acceptance/Transfer Certificate.
41. The acceptance/transfer certificate is issued in electronic form, except for the case when a participant in the turnover of goods issues a paper Acceptance/Transfer Certificate upon confirmation of information on the Operator's Internet resource about the impossibility of issuing an Acceptance/Transfer Certificate to the MPT Central Office due to technical errors in the MPT Central Office.
42. After the elimination of technical errors, the Acceptance/ Transfer Certificate, issued earlier on paper, must be entered by the supplier into the MPT Central Office within 1 (one) business day from the date of elimination of technical errors in the MPT Central Office, but no later than the day the goods are transferred to third parties.
43. The change of the owner of the marking code in the MPT CA is carried out on the basis of information confirmed by both parties from the Act of Acceptance / Transfer to the MPT CA.
44. When the marked goods are withdrawn from circulation, the participant in the turnover of goods, no later than 3 (three) business days following the day of withdrawal of the goods from circulation, submits to the CA MPT a notification of withdrawal of the goods in accordance with Annex 4 to these Rules, indicating the appropriate reason.
45. Upon return of the marked goods by the buyer and in other cases of return of the goods, the participant in the turnover of goods shall re-enter such goods into circulation for its further sale and (or) transfer and send to the Operator a notification of the re-entry into circulation of the specified goods in accordance with Annex 5 to these Rules.
46. Information on the re-entry of goods into circulation is sent to the Operator within no more than 3 (three) business days from the date of occurrence of the grounds for re-entry of goods into circulation.
47. When the product is returned to circulation with an undamaged means of identification, the product is not re-labeled.
48. When the goods are returned to circulation with a damaged means of identification, or without a means of identification (if it is not possible to identify the goods), the participant in the turnover of goods shall re-register the goods in accordance with Chapter 5 of these Rules.
Chapter 10. The procedure for submitting information by a participant in the turnover of goods to the MPT CA
49. A participant in the turnover of goods submits information to the MPT Central Office through information and communication technologies and electronic interaction interfaces developed by the Operator, or through the personal account of the MPT Central Office.
50. Information sent by a participant in the turnover of goods to the MPT CA is signed by the EDS of the participant in the turnover of goods.
51. When carrying out the commissioning, turnover and withdrawal of marked goods from circulation, the submission of information to the CA MPT is carried out by the participant in the turnover of goods sequentially.
52. The transfer of information about a group package by a participant in the turnover of goods is considered equivalent to the transfer of information about each unit of goods contained in a group package according to the data of the MPT CA.
53. All documents and information sent by a participant in the turnover of goods to the MPT Central Office in accordance with the terms of the electronic interaction interface published on the Operator's Internet resource and received by the Operator are subject to reflection in the MPT Central Office.
54. The operator refuses to accept information provided by a participant in the turnover of goods in the Central Office of the MPT, in cases where:
1) the information provided contains incorrect information provided for in these Rules;
2) the information is not signed by an EDS or signed by a person who does not have the authority to sign it on behalf of a participant in the turnover of goods.
55. The participant in the turnover of goods is notified of the receipt of the submitted information and its entry into the MPT CA or of the refusal to accept the information by sending a corresponding message.
The date of submission of information to the MPT CA is the date recorded in the personal account of the MPT CA.
56. The fact that a participant in the turnover of goods has performed actions to submit information to the MPT Central Office is confirmed by a notification of acceptance of information to the MPT Central Office.
These messages are automatically generated by the MPT CA and sent to the participant in the turnover of goods in electronic form when the information transmitted is recorded in the MPT CA.
57. The participants in the turnover of goods who provide the information are responsible for the completeness, reliability and timeliness of the information sent to the MPT CA.
58. In order to monitor the turnover of labeled goods, the Operator ensures that the following information is available in the MPT CA:
1) about the participants in the turnover of goods;
2) on goods subject to mandatory labeling by means of identification;
3) about the labeling codes transferred to the participants in the turnover of goods;
4) about the turnover of labeled goods and their withdrawal from circulation.
59. The operator, within the framework of the MPT CA, organizes and ensures the maintenance of the following registers of the MPT CA:
1) the register of documents of the CA MPT;
2) the register of participants in the turnover of goods of the CA MPT;
3) the register of authorized persons of participants in the turnover of goods of the CA MPT;
4) the register of goods of the CA MPT;
5) the register of means of identification of the MPT CA.
60. In the event of a change in the previously submitted information, the participant in the turnover of goods, within 3 (three) business days from the date of the change, sends information about the change in the specified information to the Operator via the MPT Central Office.
Chapter 11. Access to information posted in the MPT CA
61. The operator develops and places on the Internet a mobile application for participants in the turnover of goods, which provides the following features:
1) reading the identification tool;
2) transfer of information contained in the identification tool from the MPT CA;
3) receiving information about the product being checked from the MPT CA.
62. The information generated during the traceability process and contained in the MPT CA is information with limited access and is provided only to the following persons in the following cases:
1) a participant in the turnover of goods in terms of information about transactions with goods made by this participant in the turnover of goods;
2) specialized organizations and nurseries in terms of statistical and analytical information on labeled goods;
3) state bodies authorized to make such a request for the purpose of fulfilling the tasks and performing the functions assigned to these state bodies in accordance with the legislation of the Republic of Kazakhstan;
4) consumers in terms of information about the characteristics of the goods or the seller of the goods contained in the CA MPT.
