On approval of the Rules for maintaining and providing information and (or) information from the State Urban Planning Cadastre

 In accordance with subparagraph 47) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Rules for maintaining and providing information and (or) information from the state urban planning cadastre.

     2. To invalidate certain orders listed in accordance with the annex to this order.

     3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     5. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for maintaining and providing information and (or) information from the State urban planning cadastre

1. General provisions

     1. These Rules for Maintaining and Providing Information and (or) Information from the State Urban Planning Cadastre (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 47) of Article 24 of the Building Code of the Republic of Kazakhstan and determine the procedure for maintaining and submitting information and (or) information from the state urban planning cadastre.

     2. The basic concepts used in these Rules:

     1) executive geodetic survey – a diagram of the actual location of buildings, structures, and engineering communications on a land plot with reference to systems of precise coordinates and heights;

     2) cadastral plan of the territory – information displayed in graphic and textual form, information about the coordinates, area, boundaries and other characteristics of the object of architectural, urban planning and construction activities within the selected territories;

     3) the customer is an individual or a legal entity operating in accordance with the legislation of the Republic of Kazakhstan. Depending on the objectives of the activity, the customer may be the investor of the project (program), the customer (owner) or their authorized persons.;

     4) duty topographic plan is a digital cartographic basis that is an integral part of the state urban planning cadastre and contains information about architectural, urban planning and construction activities, engineering infrastructure, planned construction sites, landscaping and traffic facilities, and the transport network;

     5) the automated digital system of the state urban planning cadastre (hereinafter referred to as the ACCC) is a digital system of the state urban planning cadastre that provides collection, accounting, registration, entry (filling), processing, storage, access, provision of information and (or) information, display and dissemination of data from the state urban planning cadastre.

     3. The State Urban Planning Cadastre is intended to provide government agencies, individuals and legal entities with the necessary information about objects of architectural, urban planning and construction activities.

     4. The state urban planning cadastre is created in digital form according to the unified system of classification and coding of accounting units of the state urban planning cadastre of the republican, regional, district, basic levels in a three-dimensional coordinate system adopted in accordance with the Law of the Republic of Kazakhstan "On Geodesy, Cartography and Spatial Data".

     5. The State Urban Planning Cadastre contains information on quantitative and qualitative indicators, including urban planning regulations, cartographic, statistical and textual information on existing and planned, projected objects of architectural, urban planning and construction activities, urban planning and development of territories and settlements.

Chapter 2. The procedure for maintaining and providing information and (or) information from the State urban planning cadastre

Paragraph 1. The procedure for maintaining the State Urban Planning Cadastre

     6. The state urban planning cadastre is maintained according to a unified system of collection, processing, accounting, registration, registration (filling), inventory, storage and provision of information and (or) information on objects of architectural, urban planning and construction activities throughout the territory of the Republic of Kazakhstan.

     7. The sources of the initial information (information) for accounting, registration and updating of the state urban planning cadastre are:

     1) authorized body in the field of civil protection – information on emergency situations of a natural and man-made nature that have led to changes in the objects of the area, territories at risk of natural and man-made emergencies;

     2) authorized body in the field of architecture and urban planning – information about industrial facilities;

     3) authorized body in the field of education – information about educational facilities;

     4) authorized body in the field of science and higher education – information about the objects of science and higher education;

     5) authorized body in the field of healthcare – information about healthcare facilities;

     6) authorized body for the study of subsurface resources – data from the unified cadastre of the state fund of subsurface resources (deposits and manifestations of minerals of the Republic of Kazakhstan, background information);

     7) authorized body in the field of transport and communications – information in the field of construction and operation of transport infrastructure;

     8) authorized bodies in the field of protection and use of water resources, environmental protection, forestry – information on the ecological status of water and forest resources, specially protected natural territories;

     9) authorized bodies in the field of culture, physical culture and sports – information on cultural, sports and historical and cultural heritage sites;

     10) authorized body in the field of electric power industry – information about electric power facilities;

     11) local executive bodies (hereinafter referred to as MIO) of the capital, regions, cities of republican significance, cities of regional significance, districts – information in the field of construction, land relations, housing and communal services, education, healthcare, transport and communications, culture, sports and historical and cultural heritage of the Republic of Kazakhstan, as well as information on natural and man-made emergencies that have led to changes in terrain, subsurface, water resources, geology, forestry, environmental protection, and the electric power industry;

     12) Urban development of the capital, cities of republican significance, cities of regional significance, districts in the field of architecture and urban planning – materials on construction projects:

     architectural and planning assignment (hereinafter referred to as APZ);

     technical specifications (hereinafter referred to as technical specifications);

     schemes of routes of external engineering networks;

     M&E decision on reconstruction (redevelopment, re-equipment) of premises (individual parts) of existing buildings and structures related to changes in load-bearing and enclosing (external) structures, engineering systems and equipment;

     agreed draft design;

     certificate of acceptance into operation of facilities;

     act of demolition of a building object;

     other information in the field of architecture, urban planning and construction;

     13) Urban development of the capital, regions, cities of republican significance, cities of regional significance, districts in the field of architecture and urban planning – materials on urban development projects:

     topographic survey of the general plan of a settlement;

     topographic survey of the schemes of development and development of settlements (simplified master plan);

     topographic survey of the detailed planning project;

     approved urban planning projects for the development and development of settlements, their adjustments;

     14) state expert organization and expert organizations (upon request);

     expert opinions of urban development projects;

     conclusion of construction projects;

     geological survey data;

     15) subjects of natural monopolies, quasi-public sector, providing compulsory services to individuals and legal entities:

     information about the reserve; installed capacity and (or) capacity; availability of free and available capacities and (or) capacities; network capacity; location with a coordinate reference (indicating the street names of the locality); length; number of reserved capacities and (or) capacities and their booking dates; number of occupied the capacities and (or) capacities used in the technological process to provide services to end users, the throughput capacities of engineering networks that are on their balance sheet;

     schemes for the placement of networks and (or) other property used in the provision of regulated services with technical specifications in accordance with the annex to these Rules.

     16) industry digital systems – data from industry cadastres, registers, and data banks;

     17) Customers:

pre-design and project documentation;

     topographic surveys;

     executive geodetic surveys.

     8. The M&E in the field of architecture and urban planning maintains an on-duty topographic plan in the ACCC, which is updated and modified on an ongoing basis.

     On-duty topographic plans are kept in object form, taking into account the documentation reflecting the full life cycle of the object.

     9. The state urban planning cadastre is maintained by forming and updating, systematizing, summarizing, entering, registering information and (or) information received from the basic subjects of the state urban planning cadastre, including through the integration interaction of digital systems through the digital government gateway and the Smart Bridge integration services showcase and by building two-way secure communication channels.

     10. The State urban planning cadastre is divided by levels into:

     1) Republican;

     2) regional;

     3) district;

     4) basic (localities, including cities of national importance and the capital).

     11. The republican level of the state urban planning cadastre contains information and (or) information about:

     1) data from industry-specific digital systems and (or) resources on the use of territories (agricultural production, industry, water resources, industrial and investment projects, mineral resources, transport infrastructure, environmental conditions, energy supply, urban development projects);

     2) the state borders of the Republic of Kazakhstan and the borders of regions based on the data of the National Spatial Data Infrastructure;

     3) the database of the lower territorial levels of the state urban planning cadastre.

     12. The regional level of the state urban planning cadastre contains information and (or) information about:

     1) integrated schemes of urban planning of the territory of the regions;

     2) boundaries of regions and districts based on data from the National Spatial Data Infrastructure, as well as transport and engineering infrastructure between districts and district centers.

     13. The district level of the state urban planning cadastre contains information and (or) information about:

     1) integrated schemes of urban planning of the territory of districts;

     2) borders of districts and rural districts based on data from the National Spatial Data Infrastructure, as well as transport and engineering infrastructure between settlements.

     14. The basic level of the state urban planning cadastre contains information and (or) information about:

     1) spatial and attribute data on the base level structure:

     borders of territories of localities and their administrative divisions;

     buildings and structures;

     engineering infrastructure (electricity, gas, heat, water, sanitation, telecommunications and communications);

     hydrography and hydraulic engineering structures;

     reliefs;

     specially protected natural areas;

     transport infrastructure;

     landscaping facilities;

     2) source materials on urban planning and construction projects:

     topographic surveys of the general plan of the settlement;

     topographic surveys of the detailed planning project;

     APZ;

     that;

     diagrams of routes of external engineering networks;

     M&E decisions on reconstruction (redevelopment, re-equipment) of premises (individual parts) of existing buildings and structures related to changes in load-bearing and enclosing (external) structures, engineering systems and equipment;

     topographic surveys at the design stage;

     3) agreed draft designs;

     4) approved urban planning projects for the development and development of cities and rural settlements, their adjustments;

     5) executive geodetic surveys at the stage of acceptance of the construction site into operation;

     6) the act of commissioning of construction facilities;

     7) duty topographic plans.

     15. The Republican State enterprise on the right of economic management (hereinafter referred to as the Enterprise), within the framework of the state urban planning cadastre, provides:

     1) organization of information exchange activities, as well as data exchange with digital systems;

     2) providing authorized access to the GCC ADC;

     3) development and improvement of the GGC ADC;

     4) participation in the development and improvement of state regulatory documents on the management of the ACCC;

     5) maintenance and support of the GGC ADC;

     6) interaction with the basic subjects of the state urban planning cadastre and obtaining information (information) from them for accounting, registration and updating of the ACCC;

     7) formation of cadastral files (information);

     8) organization of work to protect information from unauthorized access in accordance with government regulations and documents;

     9) updating the data of the GCC ADC by filling in data and inventory of engineering networks and/or buildings (structures);

     10) design and survey work (engineering and geodetic surveys, creation of a digital planning framework) within the framework of the formation of the state urban cadastre (for own needs).

     16. The data of the state urban planning cadastre are subject to use when:

     1) development and implementation of urban planning and architectural and construction documentation, including urban planning projects;

     2) development and modification of objects of architectural, urban planning and construction activities;

     3) assessment of investment activity;

     4) the issuance of source materials and permits;

     5) implementation of architectural and construction control and supervision, environmental protection;

     6) provision of compulsory services to individuals and legal entities by subjects of natural monopolies, quasi-public sector in accordance with the Business Code of the Republic of Kazakhstan;

     7) urban planning as a tool for monitoring and accounting for the placement of architectural, urban planning and construction activities on the territory of an administrative-territorial unit;

     8) registration and de-registration of civil defense protective structures.

     17. The technical requirements for the provision of information and (or) information for the state urban development cadastre from the basic entities are provided for in the regulatory document on the maintenance of the State urban development cadastre of the Republic of Kazakhstan, approved by Order No. 201-NK of the Chairman of the Committee on Construction and Housing and Communal Services of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan dated November 2, 2022. maintaining the State urban Planning Cadastre of the Republic of Kazakhstan" (SN RK 9.01-01-2022 ).

     18. Methods of providing information and (or) information to the GCC ADCs from the basic subjects by:

     1) integration interaction of digital systems;

     2) authorized access to the GCC ADC;

     3) transfer of data to the state urban planning cadastre.

     19. The provision of information and (or) information is carried out by the basic subjects of the state urban planning cadastre (sources of initial information (information) defined in:

     sub-items 1), 2), 3), 4), 5), 6), 7), 8), 9), 10), 14) and 16) of paragraph 7 of these Rules, upon request;

     sub-item 11), 12), 13), 15) and 17) of paragraph 7 of these Rules, daily on an ongoing basis.

     20. The initial materials (topographic surveys) of master plans and detailed planning projects are entered into the state urban planning cadastre before conducting a comprehensive urban planning examination in accordance with the Rules for conducting a comprehensive urban planning examination of urban projects approved in accordance with subparagraph 12) of Article 24 of the Building Code of the Republic of Kazakhstan.

     21. Customers provide topographic surveys of construction sites to the state urban planning cadastre before conducting a comprehensive non-departmental examination of construction projects and executive geodetic surveys of the actual position of engineering networks and/or buildings (structures) before approving the acceptance certificate of the facility in *.dwg format.

     22. Registration of information and (or) information entered into the state urban planning cadastre by customers is carried out in accordance with the Rules for registration in the automated digital system of the state urban planning cadastre of urban planning projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities, approved in accordance with subparagraph 46) of Article 24 of the Building Code of the Republic of Kazakhstan. Registration is carried out according to the prices of goods (works, services) produced and (or) sold by a state monopoly entity, established in accordance with the second part of paragraph 2 of Article 64 of the Building Code of the Republic of Kazakhstan.

Paragraph 2. The procedure for submitting information from the State urban planning cadastre

     23. Information and (or) information entered into the state urban planning cadastre is submitted through the ACCC, upon application, in the form of:

     1) cadastral plan of the territory (copying);

     2) information and (or) information;

     3) access to information resources through the GCC ADC.

24. The submission of information from the state urban planning cadastre to state bodies, subjects of natural monopolies, and the quasi-public sector providing compulsory services to individuals and legal entities, as well as organizations providing public services, as well as organizations providing compulsory services, is carried out free of charge at the expense of budgetary funds provided for these purposes.

     The deadline for providing information from the date the Company receives the request is no more than 5 (five) business days.

     25. Information entered into the state urban planning cadastre is provided by the Enterprise upon reasoned requests from individuals and legal entities (owners, customers) on the basis of their written application, except for information representing state secrets in accordance with the Law of the Republic of Kazakhstan "On State Secrets".

     Information from the State urban planning cadastre that does not contain state secrets or other legally protected secrets is provided to interested individuals and legal entities on a fee basis.

     The deadline for providing information from the date of receipt of the request and payment by the Company is 5 (five) business days.

     26. The comparison of the materials of the developed detailed planning projects for compliance with the functional zones established by the approved master plans of settlements is carried out by the Customer through the ADC GGC.

     27. To form the state urban planning cadastre and compare the materials of engineering and geodetic surveys, the Company performs design and survey work in order to meet its own needs in accordance with paragraph 5 of Article 64 of the Building Code of the Republic of Kazakhstan.

     28. If the provision of the requested information is restricted or prohibited in accordance with the Law of the Republic of Kazakhstan "On State Secrets", or the requested information is not available in the state urban development cadastre, the Enterprise shall send the applicant a written notification within 3 (three) business days from the date of receipt of the request, containing a reasoned refusal to provide information or information about their absence.

     29. In case of disagreement with the results of a reasoned response, the applicant submits a complaint in accordance with paragraph 5 of Article 91 of the Administrative Procedural Code of the Republic of Kazakhstan.

     When considering a complaint in accordance with article 73 of the Administrative Procedural Procedure Code of the Republic of Kazakhstan, the applicant is notified of the preliminary decision, as well as the time and place (method) of the hearing for the opportunity to express a position on the preliminary decision.

     The notification of the hearing is sent to the applicant no later than 3 (three) business days before the deadline for submitting information. The hearing is held no later than 2 (two) business days from the date of notification.
