In accordance with subparagraph 7) of paragraph 1 of Article 6 of the Law of the Republic of Kazakhstan "On Aquaculture", I ORDER:

1. Approve the attached Rules for maintaining the Aquaculture information system.

2. The Committee of Fisheries of the Ministry of Agriculture of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. Control over the execution of this order is entrusted to the supervising Vice Minister of Agriculture of the Republic of Kazakhstan.

4. This order will enter into force on January 1, 2027 and is subject to official publication.

Rules for maintaining the aquaculture information system

Chapter 1. General provisions

1. These Rules for Maintaining an aquaculture information system (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 7) of paragraph 1 of Article 6 of the Law of the Republic of Kazakhstan "On Aquaculture" (hereinafter referred to as the Law) and define the procedure for maintaining an aquaculture information system.

2. The following concepts are used in these Rules:

1) aquaculture – activities related to the breeding and (or) maintenance, cultivation of aquaculture facilities;

2) aquaculture facilities – fish, aquatic mollusks and crustaceans that are bred and (or) kept and grown by aquaculture entities;

3) the authorized body in the field of aquaculture (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of aquaculture;

4) subjects of aquaculture – individuals and (or) legal entities engaged in activities related to the breeding and (or) maintenance, cultivation of aquaculture facilities;

5) entities ensuring the development of aquaculture – individuals or legal entities engaged in activities related to the production of feed for aquaculture facilities, as well as carrying out breeding and breeding work in the field of fish farming in accordance with the legislation of the Republic of Kazakhstan on livestock breeding;

6) the aquaculture information system is an information system of an authorized body designed to monitor and analyze the development of aquaculture, maintain a register of aquaculture entities and traceability of aquaculture facilities, including processed products, as well as to collect and generate data and information, and ensure digitalization in the field of aquaculture.

Chapter 2. The procedure for maintaining the aquaculture information system

3. The authorized body for monitoring and analyzing the development of aquaculture through the aquaculture information system conducts constant monitoring and analysis of information received by the authorized body.

4. The authorized body will further use the results of monitoring and analysis of aquaculture development to assess the state of aquaculture development in accordance with the Rules for Assessing the State of Aquaculture Development, approved by Order No. 289 of the Minister of Agriculture of the Republic of Kazakhstan dated September 11, 2025 (registered in the Register of State Registration of Regulatory Legal Acts under No. 36830).

5. The authorized body, through the aquaculture information system, maintains the register of aquaculture entities in accordance with Appendix 2 to the Rules for Maintaining the Register of Aquaculture Entities, approved by Order No. 296 of the Acting Minister of Agriculture of the Republic of Kazakhstan dated September 16, 2025 (registered in the Register of State Registration of Regulatory Legal Acts under No. 36882).

6. Subjects of aquaculture are provided with free access to the aquaculture information system, the opportunity to receive and use information from the aquaculture information system, with the exception of information constituting a commercial secret, as well as information containing state secrets and other secrets protected by the laws of the Republic of Kazakhstan.

7. The authorized body, in accordance with paragraph 9 of Article 10 of the Law, forms in the aquaculture information system a register of unscrupulous aquaculture entities engaged in commercial lake and (or) cage farming activities, in accordance with Annex 1 to these Rules.

8. Integration with e-government informatization facilities, state or other databases and (or) information systems is carried out in accordance with the Rules for the Integration of e-Government Informatization Facilities, approved by Order No. 123 of the Acting Minister of Information and Communications of the Republic of Kazakhstan dated March 29, 2018 (registered in the Register of State Registration of Regulatory Legal Acts under No. 16777).

9. For the purpose of traceability of aquaculture facilities, including its processed products, the aquaculture information system collects and generates the following data and information:

1) about the volumes and types of aquaculture products on the market of goods from the information system "Unified automated management system for the branches of the agro-industrial complex "e-Agriculture";

2) about the subjects of aquaculture, their details, the types of activities carried out by them from the state databases "Legal entities", "Individuals";

3) on the volumes and types of exported and imported aquaculture products from the Keden information system;

4) on measures of state stimulation of aquaculture from the state subsidy information system.

10. The aquaculture information system provides:

1) posting, registration and accounting of information, documents, materials in electronic form in compliance with the requirements of the legislation of the Republic of Kazakhstan on the protection of state secrets;

2) multi-user mode of access to information, documents, materials;

3) establishment of informational links (links) between information, documents, materials;

4) differentiation of access rights using the role model of differentiation of access rights to the functions of the aquaculture information system, information, documents, materials;

5) automatic maintenance of an electronic log of user actions in relation to information, documents, and materials, which records the time of actions, the success of changes, and information about the accounts of such persons.;

6) cryptographic protection of the transmission of information, documents, and materials over communication networks;

7) backup, storage (without time limit) and restoration of information, documents, materials, and software tools within no more than 24 hours after the failure of the aquaculture information system;

8) search functions for information, documents, and materials in the aquaculture information system;

9) automatic collection of information on the availability of information, documents, and materials in the aquaculture information system, including for one or more aquaculture entities.

11. The authorized body organizes the technical support of the aquaculture information system, which consists in the following:

1) management of access rights of users of the aquaculture information system (creation, modification, blocking, changing and restoring user accounts of the aquaculture information system);

2) verification of the full functioning and continuous monitoring of the software of the aquaculture information system;

3) verification and analysis for the presence of incorrect data contained in the aquaculture information system;

4) maintenance of the reference information of the aquaculture information system;

5) providing consulting support to users of the aquaculture information system at the regional level;

6) customer site support (monitoring the operation of the aquaculture information system at client workstations of users of the aquaculture information system);

7) collecting and transmitting comments and suggestions on making changes to the user interface of the aquaculture information system;

8) analysis of comments for their elaboration and elimination in the aquaculture information system;

9) provision of uploads and reports;

10) modification of the functionality of the aquaculture information system based on comments and suggestions from users of the aquaculture information system, problems that arise during the operation of the aquaculture information system.

12. To work in the aquaculture information system, you must have an account (login and password) obtained during registration and an electronic digital signature (hereinafter referred to as EDS).

13. To authenticate in the system, the user of the aquaculture information system must enter a username, password, and EDS.

14. The collection and processing of personal data is carried out with the consent of the subjects of aquaculture and subjects providing for the development of aquaculture in accordance with Article 6 of the Law of the Republic of Kazakhstan "On Personal Data and their protection".

15. Information protection in information and communication systems is provided by a set of organizational, programmatic and technical measures in accordance with the current legislation of the Republic of Kazakhstan.
