On Approval of the Rules for Monitoring State Support Measures for Private Entrepreneurship and their Recipients

In accordance with paragraph 2 of Article 93-1 of the Entrepreneurial Code of the Republic of Kazakhstan, I ORDER:
1. To approve the attached Rules for Monitoring State Support measures for Private Entrepreneurship and their Recipients.
2. The Department of Organization of Financing Processes and Financial Support Measures of the Ministry of Finance of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Finance of the Republic of Kazakhstan after the day of its first official publication;
3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Department of Legal Service of the Ministry of Finance of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
3. This order will enter into force on July 12, 2026 and is subject to official publication.

Rules for monitoring State support measures for private entrepreneurship and their recipients
Chapter 1. General provisions
1. These Rules for Monitoring measures of state support to Private Entrepreneurship and their Recipients (hereinafter referred to as the Rules) have been developed in accordance with paragraph 2 of Article 93-1 of the Entrepreneurial Code of the Republic of Kazakhstan and define the procedure for monitoring measures of state support to private entrepreneurship and their recipients.
2. The basic concepts used in these Rules:
1) basic requirements – requirements defined by the authorized body for budget execution within the framework of the rules for monitoring the use of state support measures for private entrepreneurship and their recipients;
2) the first level system – a registration system integrated with the systems of the second level of state support measures, containing a reference electronic register of applications from recipients of state support measures for private entrepreneurship, where, through final post-format and logical control, the recipient's compliance with state support measures for private entrepreneurship is determined by the basic requirements determined by the authorized budget execution body within the framework of the rules for monitoring the use of state support measures for private entrepreneurship and their recipients;
3) the central authorized body for budget execution is the central executive body responsible for the management, as well as, within the limits provided for by the legislation of the Republic of Kazakhstan, intersectoral coordination in the field of budget execution, accounting, budget accounting and budget reporting on the execution of the republican budget and, within its competence, local budgets, extra–budgetary funds;
4) the administrator of budget programs (hereinafter referred to as the administrator) is a state body responsible for planning, substantiating, implementing and achieving the results of budget programs, determined in accordance with the functions, powers and competencies assigned to it by the legislation of the Republic of Kazakhstan.;
5) the second-level system is an industry–specific state or non-state digital system through which applications are received from recipients of state support measures for private entrepreneurship, processed using format-logical control and the processed applications are transferred to the first level.;
6) a measure of state support for private entrepreneurship is a tool of state stimulation aimed at developing private entrepreneurship and creating favorable legal and economic conditions for the implementation of entrepreneurial initiatives in the Republic of Kazakhstan;
7) recipient of the state support measure (hereinafter referred to as the recipient) – citizens of the Republic of Kazakhstan, candace and non–governmental commercial legal entities engaged in entrepreneurial activities;
8) the operator of state support measures (hereinafter referred to as the operator) – a legal entity, branch or representative office that implements and (or) provides state support measures in the field of entrepreneurship established by the legislation of the Republic of Kazakhstan, as well as within the framework of civil law relations (including financial organizations and socio-entrepreneurial corporations), local executive bodies (akimats) in the field of state regulation of the development of the agro-industrial complex and rural areas authorized to finance specific recipients of subsidies on a gratuitous and non-refundable basis, carried out at the expense of budgetary funds, specialized organizations in accordance with the Resolution of the Government of the Republic of Kazakhstan dated July 7, 2006 No. 645 "On certain issues of support for the agro-industrial complex with the participation of specialized organizations";
9) the register of state support measures (hereinafter referred to as the register) is a unified state digital database that includes a register of certified state support measures and a register of applications for state support measures with data on provided state support measures by recipients, which is maintained through the registration system;
10) sectoral state bodies – state bodies exercising leadership in the relevant field (branch) of public administration;
11) registrar is a legal entity whose sole shareholder is the state, designated by the central authorized body for budget execution, which provides technical support for maintaining the register and monitoring the use of state support measures for private entrepreneurship and their recipients.;
12) an electronic digital signature (hereinafter referred to as EDS) is a digital record (set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.
Chapter 2. The procedure for monitoring state support measures for private entrepreneurship and their recipients
3. Monitoring of state support measures for private entrepreneurship and their recipients (hereinafter referred to as monitoring) is carried out by the central authorized body for budget execution.
4. Monitoring of recipients of state support measures for private entrepreneurship is carried out by determining the compliance of a private business entity with the basic requirements in the first-level system.:
1) at the initial stage, for the decision of the branch government body or operator on further consideration of the application for a state support measure in the second–level system.;
2) at the final stage – to make a decision on the payment to the recipient.
5. Technical support for monitoring is provided by the registrar within the framework of a two-tier system of state support for private entrepreneurship, including:
1) the first level is a registration system integrated with second–level systems containing a reference electronic register of applications from recipients of state support measures for private entrepreneurship, where, through final post-format and logical control, the recipient of state support measures for private entrepreneurship meets the basic requirements for private business entities applying for state support measures in accordance with Appendix 1 to these Rules.;
2) the second level is sectoral state or non–state digital systems through which applications are received from recipients of state support measures for private entrepreneurship, processed using format-logical control and the processed applications are transferred to the first level.
Second-level digital systems ensure that recipients of state support measures for private entrepreneurship consent to the use of information that constitutes a legally protected secret, as well as to the collection, processing, storage, unloading and use of personal data by the registrar.
6. As part of the technical support of monitoring by the registrar, the following are implemented::
1) services published on the showcase of Smart Bridge services, providing connection of industry-specific state or non-state digital systems of the second level to the system of the first level and automated data exchange between them;
2) Single Sign-On (SSO) technology is a mechanism that allows users who have been authorized in the first–level system to automatically access the second-level system without having to re-enter their login and password.
7. Monitoring is carried out in relation to:
1) measures of state support for private entrepreneurship;
2) recipients of state support measures for private entrepreneurship.
8. Monitoring of state support measures for private entrepreneurship is carried out through automatic verification of the following requirements:
1) availability of a state support measure for private entrepreneurship in the register;
2) the presence in the registry of a valid contract between the administrator and the operator for the transfer of budgetary funds to the recipient;
3) the sufficiency of funds in the administrator's or operator's account to cover obligations to pay state support measures.
9. Verification of private business entities for compliance with basic requirements is carried out automatically by integrating the first-level system with the digital systems of the department of the central authorized body for budget execution, which verify information on tax obligations, customs payments and digital systems of state and non-state organizations in the relevant industry.
10. Based on the results of the audit, the registrar sends an electronic notification to the branch government agency and (or) the operator on the compliance and (or) non-compliance of the private business entity with the basic requirements in accordance with Annex 2 to these Rules.
The branch government agency and (or) the operator, based on the registrar's notification, notify the private business entity of the results of the audit.
11. To make a decision on the payment of funds to the recipient, the first-level system re-checks the compliance of the private business entity with the basic requirements.
If the private business entity meets the basic requirements, within 3 (three) business days, the operator, based on the summary statement for the payment of funds, forms a payment order for the state treasury authorities to pay the funds to the recipient.
12. Information about the generated payment order, including the number and date of notification of the recipient's compliance and/or non-compliance with the basic requirements, is uploaded to the first-level system from the digital system of the state Treasury through their information interaction.
13. Operators making payments under the government support measure to the final recipient who does not have an account with the state treasury ensure that information about the generated payment order is transmitted to the first-level system through information interaction, including the number and date of notification of the recipient's compliance and/or non-compliance with the basic requirements.
14. If a private business entity does not meet the basic requirements, the operator and/or the administrator will not finance it.
15. The central authorized Body for budget execution ensures monitoring and formation of its results.
16. Based on the results of the monitoring, the central authorized body for budget execution provides the authorized body for entrepreneurship with access to the monitoring results through a registration system to analyze the effectiveness of government support measures for private entrepreneurship.
Appendix 1 to the Rules for Monitoring State Support for Private Entrepreneurship and their Recipients
Basic requirements for private business entities applying for government support measures
Basic requirements for private business entities applying for government support measures:
1) absence from the list of taxpayers declared bankrupt;
2) the absence in the list of unreliable recipients of state support measures formed by the relevant administrator or operator.
