On approval of the Rules for registration in the automated digital system of the State urban planning Cadastre of urban development projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities

In accordance with subparagraph 46) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. To approve the attached Rules for registration in the automated digital system of the state urban planning cadastre of urban development projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities.
2. Invalidate them:
1) Order of the Minister of Regional Development of the Republic of Kazakhstan dated June 16, 2014 No. 172/OD "On approval of the rules for registration in the database of the State Urban Planning Cadastre of urban development projects, pre-design and design (design estimates) documentation, as well as objects of architectural, urban planning and construction activities" (registered in the Register of State Registration of Regulatory Legal Acts under No. 9603);
2) Order of the Acting Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated July 1, 2023 No. 479 "On Amendments to the Order of the Minister of Regional Development of the Republic of Kazakhstan dated June 16, 2014 No. 172/OD "On approval of the Rules for registration in the database of the State Urban Cadastre of pre-design and design (design estimates) documentation, as well as objects of architectural, urban planning and construction activities" (registered in the Register of State Registration of Regulatory Legal Acts under No. 33020).
3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan.
4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
5. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules of registration in the automated digital system of the state urban planning cadastre of urban development projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities
Chapter 1. General provisions
1. These Rules for registration in the automated digital system of the State Urban planning cadastre of urban development projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 46) of Article 24 of the Building Code of the Republic of Kazakhstan and determine the procedure for registration in the automated digital system of the State urban planning cadastre (hereinafter referred to as the Rules). – ACCC) of urban planning projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities.
2. The purpose of registration is to take into account existing, under construction and projected objects of architectural, urban planning and construction activities.
3. Registration of pre–design and project documentation of individuals and legal entities is carried out on a paid basis by the republican state enterprise on the right of economic management, established by decision of the Government of the Republic of Kazakhstan (hereinafter referred to as the Enterprise) for the management of the state urban planning cadastre through the ACCCGK.
4. Registration (accounting) in the ACCC is subject to:
1) general plans of settlements, schemes of development and development of settlements (simplified master plan), their adjustments;
2) detailed planning projects and their adjustments;
3) topographic surveys of general plans of settlements, schemes of development and development of settlements (simplified master plan);
4) topographic surveys of detailed planning projects;
5) materials of engineering and geodetic surveys of construction sites (topographic survey at the design stage and executive geodetic survey at the stage of acceptance of the construction site into operation);
6) design and estimate documentation without an estimate section;
7) the act of acceptance of the construction site into operation;
8) the act of acceptance of the construction site into operation by the customer (owner, investor) independently;
9) the act of demolition of a construction site.
5. Accounting and registration agreements with the ACCC are concluded in accordance with the civil legislation of the Republic of Kazakhstan.
6. Information and (or) information classified as confidential or marked "for official use" is sent to the ACCC for accounting and registration in compliance with the requirements established by the legislation of the Republic of Kazakhstan.
7. The costs of registration in the ACCC of pre-design and design documentation, materials of engineering and geodetic surveys (topographic surveys of design documentation and executive geodetic surveys at the stage of acceptance of a construction object into operation) are determined according to the prices of goods (works, services) produced and (or) sold by a state monopoly entity in accordance with paragraph 3. Article 65 of the Building Code of the Republic of Kazakhstan.
Chapter 2. The procedure for registration of urban planning projects, pre-design and design estimates, as well as objects of architectural, urban planning and construction activities in the ACCC
Paragraph 1. Introduction of general plans of settlements, schemes of development and development of settlements (simplified master plan), detailed planning projects and their adjustments to the ACCC
8. In order to submit general plans of settlements, schemes for the development and development of settlements (simplified master plan), detailed planning projects (hereinafter referred to as urban planning projects) and their adjustments to the ACCC, the local executive body provides:
1) the document on the approval of the urban development project in the format – *jpg, *jpeg, *pdf;
2) text materials (explanatory note, technical and economic indicators) in the format – *pdf, *docx;
3) diagrams of an urban planning project with a coordinate reference in vector format – *mpk, in raster format – *jpg, *jpeg, *pdf;
4) a digital database in the regulatory structure with a coordinate reference in digital format - *gdb.
9. Consideration of urban planning projects is carried out for compliance with the requirements defined by the Rules for the development, coordination and approval of urban planning projects (master plans of settlements, detailed planning projects) approved by the authorized body for Architecture, Urban Planning and Construction in accordance with subparagraph 39) of Article 24 of the Building Code of the Republic of Kazakhstan., as well as state regulatory documents regarding the compliance of digital databases of urban planning projects (with a coordinate reference) with the regulatory structure and initial schemes.
10. The deadline for consideration of urban development projects by the Enterprise is 20 (twenty) working days from the date of their receipt.
Based on the results of consideration of urban development projects, if there are comments, a corresponding letter is sent to the local executive body about their non-compliance with the requirements provided for in paragraph 9 of these Rules, within the period provided for in part one of this paragraph.
After the identified comments are eliminated, the urban planning project is re-sent to the Enterprise for inclusion in the ACCC.
Based on the results of the review and confirmation of compliance with the format and structure of the data, the digital database of the approved urban development project is entered into the ACCC.
Paragraph 2. Registration of topographic surveys of urban development projects in the ACCC
11. To register topographic surveys of urban development projects with the ACCC, the customer or his authorized representative submits an application to the Enterprise with an attachment of a topographic survey of the urban development project, with a technical report with the approval of the balance holders of engineering networks.
Topographic surveys of urban development projects are provided in one of the digital vector formats *.dwg, *.gdb, *.mpk, *.tab.".
12. Consideration of the topographic survey of an urban development project is carried out for compliance with the requirements of state regulatory documents, a technical report, and approval of the balance holders of engineering networks.
13. The deadline for consideration and registration of topographic surveys of urban development projects is 20 (twenty) working days from the date of their receipt.
Based on the results of the review, in the absence of comments, the topographic survey of the urban development project is registered in the ACCC, with the assignment of a registration number and notification to the customer.
Based on the results of consideration of topographic surveys of urban development projects, if there are comments, the customer is notified of their non-compliance with the requirements provided for in paragraph 12 of these Rules, within the period provided for in part one of this paragraph.
After the comments are eliminated, the application for registration of a topographic survey of an urban development project is submitted again.
Paragraph 3. Registration of materials of engineering and geodetic surveys of construction sites in the ACCCGK
14. To register materials of engineering and geodetic surveys of construction sites in the ACCC, the customer or his authorized representative submits an application to the Enterprise with the application of a topographic survey at the design stage or an executive geodetic survey at the stage of acceptance of the construction site into operation with a technical report with the approval of the balance holders of engineering networks.
When registering materials of engineering and geodetic surveys of individual residential buildings in the ACCC, coordination of balance sheets of engineering networks is not required.
The materials of engineering and geodetic surveys of construction sites are sent in vector format (*.dwg).
15. The examination (desk check) of engineering and geodetic surveys of construction sites is carried out for compliance with the requirements of state regulatory documents, a technical report, and the approval of balance holders of engineering networks.
16. If it is necessary to clarify the data of engineering and geodetic surveys, a field survey is carried out by employees of the Enterprise or its branches with the preparation of field control acts, including:
checking the planning and altitude justification;
control measurements of point objects are carried out selectively.
The field survey is carried out in the cities of the republic.
17. The period of consideration and registration of materials of engineering and geodetic surveys of construction sites is 20 (twenty) working days from the date of their receipt.
Based on the results of the review, in the absence of comments, the materials of engineering and geodetic surveys of construction sites are registered in the ACCC, with the assignment of a registration number and notification to the customer.
Based on the results of consideration of engineering and geodetic surveys of construction sites, if there are comments, the customer is notified of their non-compliance with the requirements provided for in paragraph 15 of these Rules, within the period provided for in part one of this paragraph.
After the comments have been eliminated, the application for registration of engineering and geodetic survey materials for construction sites is submitted again.
Paragraph 4. Registration of design estimates and acts of demolition of construction sites in the ACCC
18. In order to register the approved design and estimate documentation without an estimate section in the ACCC, the customer or his authorized representative submits an application with the specified documentation attached. The design and estimate documentation without the estimate section is registered in the ACCC within 3 (three) business days, with the assignment of a registration number and notification of the customer.
19. The registration of the act of acceptance of the construction object into operation and the act of acceptance of the construction object into operation by the customer (owner, investor) is independently carried out by local executive bodies performing functions in the field of architecture and urban planning through the ACCC with the assignment of a registration number.
20. The registration of the act of demolition of a construction site is carried out by the local executive authorities for architecture, urban planning and construction, through the ACCC with the assignment of a registration number.
