On approval of the Rules for State certification in relation to military and special educational institutions implementing higher and (or) postgraduate education programs, regardless of departmental subordination

In accordance with subparagraph 2) Paragraph 3 of Article 55-1 of the Law of the Republic of Kazakhstan "On Education", subparagraph 85-1) of paragraph 15 of the Regulation on the Ministry of Science and Higher Education of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated August 19, 2022 No. 580 "On certain issues of the Ministry of Science and Higher Education of the Republic of Kazakhstan", I ORDER:

     1. To approve the attached Rules for conducting state certification in relation to military and special educational institutions that implement higher and (or) postgraduate education programs, regardless of departmental subordination.

     2. The Committee for Quality Assurance in the field of Science and Higher Education of the Ministry of Science and Higher Education of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Science and Higher Education of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Science and Higher Education of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules of state certification in relation to military and special educational institutions that implement higher and (or) postgraduate education programs, regardless of departmental subordination

Chapter 1. General provisions

     1. These Rules for conducting state certification in relation to military and special educational institutions implementing higher and (or) postgraduate education programs, regardless of departmental subordination (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 2) Paragraph 3 of Article 55-1 of the Law of the Republic of Kazakhstan "On Education" (hereinafter – The Law), subparagraph 85-1) of paragraph 15 of the Regulation on the Ministry of Science and Higher Education of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated August 19, 2022 No. 580 "On certain issues of the Ministry of Science and Higher Education of the Republic of Kazakhstan" and determine the procedure for state certification in relation to military, special educational institutions (hereinafter referred to as higher education institutions) implementing programs of higher and (or) postgraduate education, regardless of departmental subordination.

     2. The following concepts are used in these Rules:

     1) an educational program is a single set of basic characteristics of education, including the goals, results and content of learning, the organization of the educational process, ways and methods of their implementation, criteria for evaluating learning outcomes;

     2) cross–section of students' knowledge - assessment of students' academic achievements;

     3) learning outcomes – the amount of knowledge, skills, acquired, demonstrated by the student during the development of the educational program, and the values and attitudes formed.

Chapter 2. The procedure for state certification

     3. State attestation is carried out in relation to higher education institutions implementing higher and (or) postgraduate education programs, regardless of departmental subordination, once every five years by the department of the authorized body in the field of science and higher education (hereinafter referred to as the Authorized Body) in accordance with the Law and these Rules.

     The list of higher education institutions subject to state certification is approved by the Authorized Body with an indication of the terms of certification and posted on its official Internet resource.

     The first state certification is carried out in newly created higher education institutions that implement educational programs of higher and (or) postgraduate education, no later than one year after the first graduation of specialists.

     4. The main directions and objects of study during the state attestation are:

     1) the student body;

     2) human resources potential;

     3) material assets necessary for the implementation of educational programs (academic buildings, educational/scientific/specialized laboratory facilities, technical training facilities, software, conditions for students (meals, accommodation, medical care);

     4) library fund;

     5) educational, methodical, educational work;

     6) Professional practice (internship);

     7) scientific research work.

     5. The main subject of the state certification procedure is to determine the compliance of higher education institutions with the requirements of the Law, State mandatory standards of higher and postgraduate education, approved by Order of the Minister of Science and Higher Education dated July 20, 2022 No. 2 "On Approval of State Mandatory Standards of Higher and Postgraduate Education" (registered in the Register of State Registration of Regulatory Legal Acts under No. 28916) (hereinafter referred to as – State Educational Institution).

     6. The notification of the start of the state attestation is sent to the University one month before the start of the state attestation.

     The state certification is carried out within no more than 7 (seven) working days.

     7. The authorized body for conducting state attestation creates a commission for conducting an objective assessment of the educational activities of the University (hereinafter referred to as the Commission). The composition of the Commission is formed from among officials of the Authorized Body, representatives of the Republican state-owned Enterprise "National Testing Center" of the Ministry of Science and Higher Education of the Republic of Kazakhstan, state bodies and educational organizations, with the exception of representatives of the state body in whose departmental subordination the certified higher education institution is located, and representatives of the certified higher education institution.

     An official of the Authorized Body is appointed Chairman of the Commission on the basis of an order of the Authorized Body.

     Based on the requirements of the State Educational Standard, the Chairman of the Commission distributes tasks among the members of the Commission to study the areas of activity of the Higher School of Economics listed in paragraph 4 of these Rules.

     8. In its activities, the Commission is guided by the requirements of the State Educational Standard and the legislation of the Republic of Kazakhstan regulating the activities of the Higher Education Institution, depending on departmental subordination.

     9. In order to determine the compliance of the level of training of students in mastering educational programs provided for by the requirements of the State Educational Standard, the assessment of learning outcomes is carried out through a cross-section of knowledge of students graduating from bachelor's and master's degrees.

     The procedure for organizing and conducting a cross-section is determined by the Rules and Requirements for conducting a cross-section of students' knowledge, approved by Order No. 569 of the Minister of Science and Higher Education of the Republic of Kazakhstan dated November 8, 2023 (registered in the Register of State Registration of Regulatory Legal Acts under No. 33622).

     The results of the cross-section are one of the criteria for assessing the level of training of students and are attached to the materials of the state attestation.

     10. The Commission summarizes the results of control over all objects of study during the state attestation and forms an opinion on the results of the state attestation (hereinafter referred to as the Conclusion).

     The conclusion consists of information on the objects of study during state certification, given in paragraph 4 of these Rules, and also includes conclusions and suggestions.

     11. According to the results of the state attestation of the Higher School of Higher Education, one of the following decisions is made by a collegial decision of the Commission:

     1) certified if the educational activity of the University fully complies with the requirements of the State Educational Standard;

     2) it is not certified if the educational activity of the University does not meet the requirements of the State Educational Standard.

     12. The conclusion in two copies is signed by the Commission.

     The head of the Higher School of Economics shall sign the indicated copies of the Conclusion with a note on familiarization and receipt of one of the copies, and shall be stamped by the Higher School of Economics.

     If the head of the Higher School of Economics refuses to sign copies of the Report, the Commission draws up an appropriate act and one of the copies of the Report is submitted to the Higher School of Economics.

     13. On the final day of the state attestation, the Chairman of the Commission informs the University of the Conclusion.

     In case of disagreement with the Conclusion, the management of the Higher Education Institution submits a written justification to the Authorized Body within 3 (three) calendar days after the official announcement of the Conclusion.

     14. On the basis of the Conclusion (the results of consideration of the application of the Higher School of Economics for disagreement with the Conclusion, if any), an order of the Authorized Body is issued to recognize the Higher School of Economics as having passed or failed state certification, no later than 10 (ten) calendar days.

     15. If the University is recognized as not having passed the state certification, the order of the Authorized Body specifies the deadline for eliminating the identified violations of the State Educational Standard.

Within the period established by the order of the Authorized Body, the Higher Education Institution ensures the elimination of identified violations and submits information with supporting materials to the Authorized Body.

     16. Based on the analysis of the materials submitted by the Higher Education Institution in accordance with paragraph 15 of these Rules, the Authorized Body shall form a commission and conduct a repeat state certification, lasting no more than 5 (five) working days.

     The results of the repeated state attestation are formalized by the order of the Authorized Body on the recognition of the Higher School of Higher Education as having passed or failed the state attestation.

     The fact of non-certification of the University based on the results of repeated state certification is the basis for preventive monitoring with a visit to the University in accordance with the Business Code of the Republic of Kazakhstan.

     17. In case of disagreement with the results of the state attestation, the University has the right to appeal them in accordance with the procedure provided for by the Administrative Procedural Code of the Republic of Kazakhstan.

     18. Information on the passage or non-passage of the state attestation of higher education institutions is posted on the official website of the Authorized Body.
