On approval of the Rules for the development, coordination and approval of the General Scheme of organization of the territory of the Republic of Kazakhstan

In accordance with subparagraph 66) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. To approve the attached Rules for the development, coordination and approval of the General Scheme of organization of the territory of the Republic of Kazakhstan.
2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for the development, coordination and approval of the General Scheme of organization of the territory of the Republic of Kazakhstan
Chapter 1. General provisions
1. These Rules for the Development, Coordination and approval of the General Scheme of Organization of the Territory of the Republic of Kazakhstan (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 66) of Article 24 of the Building Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and establish the procedure for the development, coordination and approval of the General Scheme of Organization of the territory of the Republic of Kazakhstan.
2. The following basic concepts and definitions are used in these Rules:
1) zoning of territories is the division of territories in urban planning into functional zones with the establishment of types of urban use of individual zones and possible restrictions on their use.;
2) objects of special regulation and urban planning regulation – objects of architectural, urban planning and construction activities, the implementation of which is difficult without establishing exceptions or making additions to the generally accepted rules (procedure) for the use of territories, the territory of a locality, a separate construction site;
3) The General Scheme of organization of the territory of the Republic of Kazakhstan (hereinafter referred to as the General Scheme) is an urban planning project of national importance containing a vision of long–term spatial development and a system of rational organization of the territory of the Republic of Kazakhstan to realize territorial competitive advantages and achieve sustainable development of the country;
4) the authorized body for architecture, urban planning and construction (hereinafter referred to as the authorized body) is the central executive body responsible for the management, as well as, within its competence, intersectoral coordination in the field of public administration of architectural, urban planning and construction activities.;
3. The general scheme is developed taking into account the scope and content of civil defense engineering measures approved by the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated October 24, 2014 No. 732 "On Approval of the scope and content of Civil Defense Engineering measures" (registered in the Register of State Registration of Regulatory Legal Acts No. 9922), as well as
conclusions of the master plan for integrated water resources management and basin plans for the protection and use of water resources.
4. Tasks of the General Scheme:
1) ensuring state regulation of the system of settlement and placement of productive forces;
2) establishment of the status, purpose and nature of the use of territories, taking into account the administrative-territorial structure of the Republic of Kazakhstan;
3) coordination of interregional and intersectoral state interests on programs of socio-economic and economic development through the implementation of architectural, urban planning and construction activities.
Chapter 2. The procedure for the development, coordination and approval of the General Scheme
5. The development of the General Scheme is provided by the authorized body. The general scheme is developed on the basis of documents of the State Planning System of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, as well as taking into account internal and external factors affecting the prospective organization of the territory of the Republic of Kazakhstan.
The General Scheme is adjusted in cases stipulated by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, amendments and additions to the documents of the State Planning System of the Republic of Kazakhstan in accordance with these Rules.
6. The development of the General Scheme within the framework of the state assignment is carried out by the republican state enterprise on the right of economic management in the field of state urban planning and cadastre, established by decree of the Government of the Republic of Kazakhstan, in accordance with paragraph 7 of Article 69 of the Code.
7. The authorized body draws up and approves the design assignment in accordance with Appendix 1 to these Rules, which defines the structure of the General Scheme, the procedure for obtaining initial data and approving the General Scheme.
8. The general requirements for the design assignment, as well as the development period, composition and content of the General Scheme are established by the Code and state regulatory documents in the field of architectural, urban planning and construction activities.
9. The general scheme is developed according to the state regulatory documents.
10. The general scheme is developed for a period of at least twenty years and is subject to monitoring at least once every five years by the authorized body.
11. In order to carry out monitoring and generate the monitoring result, the authorized body requests information from central government agencies on the implementation of documents of the State Planning System of the Republic of Kazakhstan.
Based on the monitoring results, a report is generated in accordance with Appendix 2 to these Rules, which is posted on the authorized body's Internet resource.
The main provisions of the General Scheme are subject to monitoring.
12. The general scheme includes:
1) the system of settlement and placement of productive forces;
2) development of social, recreational, engineering and transport infrastructures;
3) development of territories and objects of special regulation of national and interregional importance;
4) classification of territories by types of economic specialization and preferential use;
5) zoning with the definition of priorities and restrictions on its use in the implementation of urban development activities;
6) a set of measures to improve the environmental situation in the regions, preserve territories with objects of historical and cultural heritage and (or) protected landscape objects, as well as to protect territories from dangerous (harmful) effects of natural and anthropogenic, man-made phenomena and processes.
13. The development of the General Scheme is carried out in two stages:
1) the preparatory stage, which includes the collection of initial data, analysis and assessment of the territory of the Republic of Kazakhstan, identification of internal and external factors affecting the organization and effective use of the territory;
2) the design stage, which includes:
development of a project proposal for the organization of the territory of the Republic of Kazakhstan for the design periods, including:
the system of settlement and placement of productive forces, the development of social, recreational, engineering and transport infrastructures, the development of territories and objects of special regulation of national and interregional importance, zoning with the definition of priorities and restrictions on its use in urban development activities;
classification of territories by types of economic specialization and preferential use;
development of a set of measures to improve the environmental situation in the regions, preserve territories with objects of historical and cultural heritage and (or) protected landscape objects, as well as to protect territories
from dangerous (harmful) effects of natural and anthropogenic, man-made phenomena and processes.
14. A comprehensive urban planning examination of a draft General Scheme is carried out in accordance with the Rules for conducting a comprehensive urban planning examination of urban planning projects approved by the authorized body, in accordance with subparagraph 12) of Article 24 of the Code.
15. After conducting a comprehensive urban planning examination, the draft General Scheme is sent by the authorized body for approval to the interested state bodies. The deadline for consideration and approval of the draft General Scheme is ten working days from the date of receipt of the draft General Scheme.
16. The interested state bodies coordinate and/or provide reasonable comments to the authorized body.
17. If comments are provided by the interested state bodies, the finalized draft of the General Scheme is submitted by the authorized body for re-approval to the interested state bodies. The deadline for re-approval is five working days from the date of receipt of the draft General Scheme.
18. The main provisions of the General Scheme are approved by the Government of the Republic of Kazakhstan in accordance with subparagraph 2) of Article 23 of the Code.
19. The provision of approved General Schemes in digital form for entry into the database of the state urban planning cadastre is carried out in accordance with the Rules for Maintaining and providing information and (or) information from the State urban planning Cadastre of the Republic of Kazakhstan, approved by the commissioner in accordance with subparagraph 47) of Article 24 of the Code.
