On approval of the rules for the formation and form of the register of epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population

 In accordance with paragraph 3-2 of Article 36 of the Code of the Republic of Kazakhstan "On the Health of the people and the healthcare system", I ORDER:

     1. Approve the attached documents:

     1) Rules for the formation of the register of epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population;

     2) the form of the register of epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population.

     2. The Committee for Sanitary and Epidemiological Control of the Ministry of Health of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Health of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Health of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for the formation of the register of epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population

Chapter 1. General provisions

     1. These Rules for the formation of the register of epidemiologically significant subjects (facilities) in the field of sanitary and epidemiological welfare of the population (hereinafter referred to as the Rules) have been developed in accordance with paragraph 3-2 of Article 36 of the Code of the Republic of Kazakhstan "On Public Health and the Healthcare System" (hereinafter referred to as the Code) and determine the procedure for the formation and maintenance of the register of epidemiologically significant subjects (facilities) in the field of sanitary and epidemiological welfare of the population (hereinafter referred to as the Register).

     2. The purposes of forming and maintaining the Register are to record and systematize information about epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population (hereinafter referred to as subjects (objects) of control and supervision).

     3. The Register is formed and maintained by the territorial divisions of the state body in the field of sanitary and epidemiological welfare of the population (hereinafter referred to as the territorial divisions) in electronic format in the state and Russian languages according to the form of the Register of epidemiologically significant subjects (objects) in the field of sanitary and epidemiological welfare of the population, approved by this order.

     4. In the Register, subjects (objects) of control and supervision are distinguished by the types of activities carried out at the objects of control and supervision in accordance with the list of epidemiologically significant objects subject to state control and supervision in the field of sanitary and epidemiological welfare of the population, approved by Order of the Minister of Health of the Republic of Kazakhstan dated November 30, 2020 No. KR DSM-220/2020 "On approval list of products and epidemiologically significant facilities, subject to state control and supervision in the field of sanitary and epidemiological welfare of the population" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21710).

     5. Information and data on the Registers formed, as well as on amendments and (or) additions to them, are sent to the state body in the field of sanitary and epidemiological welfare of the population.

Chapter 2. The procedure for the formation and maintenance of the Registry

     6. The register is formed on the basis of information from the state electronic register of permits and notifications, the results of state control and (or) supervision, monitoring of accounting and reporting documentation, appeals from individuals or legal entities, information from mass media, information from government agencies and other organizations.

     7. The procedure for maintaining the Registry includes the following steps::

     1) identification of subjects (objects) of control and supervision to be included in the Register or excluded from the Register;

     2) updating (updating) the Registry content.

     8. Inclusion (exclusion) of subjects (objects) of control and supervision in the framework of updating (updating) the Register is carried out at least once every six months.

     9. Subjects (objects) of control and supervision financed from the state budget for food, accommodation, medical care, education, upbringing, and rehabilitation of children are marked in the Register as subjects (objects) of special control and supervision. The identification of subjects (objects) of special control and supervision is carried out in accordance with the procedure provided for in Chapter 3 of these Rules.

Chapter 3. Procedure for determining subjects (objects) of special control and supervision

     10. To determine the subjects (objects) of special control and supervision, the territorial unit carries out:

     1) sending a request by May 1 and December 1 to the central state bodies and local executive bodies of the region, cities of republican significance, and the capital for the provision of data and information on the receipt by the subject (object) of control and supervision of financing from the state budget for food, accommodation, medical care, education, upbringing, and rehabilitation of children on the corresponding calendar year;

     2) analysis of information and data from information systems of state bodies and (or) organizations regarding the allocation of funding from the state budget for food, accommodation, medical care, education, upbringing, and rehabilitation of children.

     11. Requests in accordance with subparagraph 1) In accordance with paragraph 10 of these Rules, they must be sent to authorized bodies in the fields of education, healthcare, tourism, culture, physical education and sports, as well as labor.

     12. The central state bodies and local executive bodies of the region, the city of republican significance, the capital, in accordance with paragraph 2 of Article 51-2 of the Code, within the time period specified in the request, provide the necessary information in accordance with the annex to these Rules.

     13. In case of allocation of funding from the state budget for food, accommodation, medical care, education, upbringing, and rehabilitation of children to the subjects (object) of control and supervision later than the deadline for submitting information, the central state bodies and local executive bodies of the region, the city of republican significance, and the capital, within three working days from the date of the decision to allocate additional funding they send the relevant information to the territorial divisions without waiting for a request.

     14. Based on the information received, as well as the results of the analysis of information and information system data, the employees of the territorial unit mark/exclude a mark in the Register as a subject (object) of special control and supervision on the basis of a memo approved by the head of the territorial unit (or the person performing his duties).

     15. Updating (updating) of information on subjects (objects) of special control and supervision is carried out within three working days from the moment of receiving information and revealing information and data based on monitoring results.
