On approval of the Rules for the formation and maintenance of the list of business entities engaged in the production (manufacture) and supply of building materials, products, structures, equipment for monitoring prices in construction

In accordance with subparagraph 8) of Article 24 of the Building Code of the Republic of Kazakhstan and subparagraph 2) paragraph 3 of Article 16 of the Law of the Republic of Kazakhstan "On State Statistics", I ORDER:
1. To approve the attached Rules for the formation and maintenance of a list of business entities engaged in the production (manufacture) and supply of building materials, products, structures, and equipment for monitoring prices in construction.
2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
4. This order will enter into force on July 1, 2026 and is subject to official publication.
5. To establish that from July 12, 2026:
Paragraph 16 is valid as follows:
"16. The department of the authorized body considers the application of the manufacturer or supplier using state digital systems and decides on its inclusion in the List or on changing information about it in the List within 10 calendar days from the date of receipt of the relevant application.".

Rules for the formation and maintenance of a list of business entities engaged in the production (manufacture) and supply of building materials, products, structures, and equipment for monitoring prices in construction
Chapter 1. General provisions
1. These Rules for the formation and maintenance of a list of business entities engaged in the production (manufacture) and supply of building materials, products, structures, and Equipment for monitoring Prices in Construction (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 8) of Article 24 of the Construction Code of the Republic of Kazakhstan and determine the procedure for the formation and maintenance of a list of business entities engaged in manufacture and supply of building materials, products, structures, and equipment for monitoring prices in construction.
2. The list of business entities engaged in the production (manufacture) and supply of building materials, products, structures and equipment for monitoring prices in construction (hereinafter referred to as the List) is formed and maintained by the department of the authorized body for Architecture, Urban Planning and Construction (hereinafter referred to as the department of the authorized body) in Kazakh and Russian.
3. The list is formed in order to ensure the most comprehensive coverage of the nomenclature of building materials, products, structures and equipment used in the estimated standards for monitoring prices in construction.
4. The following basic concepts are used in these Rules:
1) the authorized body for architecture, urban planning and construction is the central executive body responsible for the management, as well as, within its competence, intersectoral coordination in the field of public administration of architectural, urban planning and construction activities;
2) estimated regulatory documents (cost estimates) – estimated standards, cost estimates, indexes and other regulatory documents on pricing necessary to determine the estimated cost of construction, as well as manuals and methodological recommendations.
Chapter 2. The procedure for forming and maintaining the List
5. The list is formed based on:
1) publicly available information provided for in paragraphs 1), 2), 3), 4), 5) and 6) paragraph 13 of Article 28 of the Entrepreneurial Code of the Republic of Kazakhstan, received from the Bureau of National Statistics of the Agency for Strategic Planning and Reforms of the Republic of Kazakhstan (hereinafter referred to as the Bureau);
2) information on business entities received from the State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan (hereinafter referred to as the Committee);
3) information about business entities obtained from the Register of Kazakhstani Commodity Producers;
4) information about business entities received from business entities engaged in the production (manufacture) of building materials, products, structures and equipment for construction in the Republic of Kazakhstan (hereinafter referred to as manufacturers);
5) information on business entities received from business entities engaged in the supply of building materials, products, structures and equipment for construction in the Republic of Kazakhstan, their import from the member states of the Eurasian Economic Union, as well as import from third countries of building materials, products, structures and equipment to which the customs procedure of release for domestic consumption (hereinafter referred to as suppliers).
6. In order to form and maintain the List, the department of the authorized body annually, by October 1 of this year, provides the Bureau with a list of codes of building materials, products, structures and equipment included in the departmental (sectoral) national reference information on materials, products, structures used in construction by updating in the Digital service "National Reference Information". equipment and other construction resources approved in accordance with the Rules for the Development and Approval of Elements of National Reference Information, approved by the Order of the Chairman of the Agency for Strategic Planning and Reforms of the Republic of Kazakhstan dated September 26, 2024 No. 77 (hereinafter referred to as the classifier of construction resources).
7. The Bureau annually, by November 1 of the current year, provides the department of the authorized body and the Committee with publicly available information provided for in paragraphs 1), 2), 3), 4), 5) and 6) paragraph 13 of Article 28 of the Entrepreneurial Code of the Republic of Kazakhstan.
8. The Committee annually, by December 1 of the current year, submits to the department of the authorized body:
1) a list of business entities that are at the stage of bankruptcy or liquidation (termination of operations) and are subject to exclusion from the lists formed by the Bureau in accordance with paragraph 7 of these Rules;
2) the list of business entities engaged in the import of construction materials, products, structures and equipment from third countries to the Republic of Kazakhstan with codes according to the Classifier of products by types of economic activity corresponding to the codes of the General Classifier of types of economic Activity: 02 – "Forestry and logging", 08 – "Extraction of other minerals", 16 – "Production of wooden and cork products, except furniture; production of straw products and weaving materials", 19 – "Production of coke and petroleum products", 20 – "Production of chemical industry products", 22 – "Production of rubber and plastic products", 23 – "Production of other non–metallic mineral products", 24 – "Metallurgical production", 25 - "Manufacture of finished metal products, except machinery and equipment", 26 – "Manufacture of computers, electronic and optical equipment", 27 - "Manufacture of electrical equipment", 28 – "Manufacture of machinery and equipment not included in other groupings", 31 – "Manufacture of furniture", 35 – "Supply of electricity, gas, steam, hot water and air-conditioned air", 46 – "Wholesale trade, except for trade in cars and motorcycles", which are subject to the customs procedure for release for domestic consumption, with the exception of those at the stage of bankruptcy or liquidation (termination of operations).
The lists of business entities formed by the Committee include information on the name and identification number of business entities. For the business entities specified in subparagraph 2) of this paragraph, the list of business entities includes additional information about their residence and location (if any).
9. The information specified in paragraphs 7 and 8 of these Rules is generated as of October 1 of the current year and is provided electronically.
10. Information on business entities included in the register of Kazakhstani commodity producers is formed as of December 1 of the current year.
11. The department of the authorized body forms a List in accordance with Appendix 1 to these Rules and posts it on its Internet resource annually, no later than December 31 of the current year.
12. The department of the authorized body updates the List based on information from manufacturers and suppliers.
13. Manufacturers and suppliers send to the office of the authorized body an application for their inclusion in the List with an appendix:
1) information about the supplier (manufacturer) in accordance with Appendix 2 to these Rules.;
2) information about the registered legal entity, branch or its representative office.
14. The department of the authorized body includes the manufacturer or supplier in the List if it meets the following criteria:
1) the court has not initiated bankruptcy or liquidation proceedings against him;
2) its absence in the register of unscrupulous participants in public procurement and (or) in the register of unscrupulous participants in procurement, and (or) in the list of unreliable potential suppliers (suppliers) of the National Welfare Fund;
3) carrying out activities related to the production (manufacture) and (or) supply of building materials, products, structures and equipment, the codes of which are included in the classifier of building resources, for construction in the Republic of Kazakhstan.
15. The department of the authorized body makes changes to the List on the basis of an application received from a business entity for making changes to the information about it reflected in the List.
When changing the name, organizational and legal form, or location of a business entity, information about the registered legal entity, branch, or its representative office is attached to the application.
16. The department of the authorized body considers the application of the manufacturer or supplier using state information systems and decides on its inclusion in the List or on changing information about it in the List within 10 calendar days from the date of receipt of the relevant application.
17. The department of the authorized body shall send to the business entities included in the List, with the exception of the case provided for in paragraph 13 of these Rules, a notification on the provision of information about the supplier (manufacturer) provided for in Annex 2 to these Rules (hereinafter referred to as the notification on the provision of information). The notification of the provision of information is sent annually no later than 25 calendar days after the date of posting the List on the Internet resource of the department of the authorized body.
18. The notification of the provision of information is sent by registered mail with a notification of its delivery, or by telephone or telegram, text message to a cellular subscriber number or e-mail address.
The notification of the provision of information is sent to the place of registration and/or actual location indicated in the List.
19. The notification of the provision of information is considered to have been delivered properly in the following cases::
delivery of the notification of the provision of information to the head or employee of the business entity, who signs his receipt on the notification of delivery indicating his last name, initials and position;
recording of the delivery of the notification of the provision of information when it is sent using other means of communication.
If the addressee refuses to accept the notification of the provision of information, the person delivering or handing it over makes an appropriate note on the notification of the provision of information, which is returned to the office of the authorized body.
