In accordance with paragraph 2 of Article 32 of the Digital Code of the Republic of Kazakhstan, I ORDER:

1. To approve the attached Rules for the formation and maintenance of the register of trusted digital objects, as well as the definition of the types of digital objects to be included in the register.

2. To invalidate certain orders listed in accordance with the annex to this order.

3. The Committee of Digital Assets and Breakthrough Technologies of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the digital resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan after its official publication;

3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

4. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.

5. This order will enter into force on July 12, 2026 and is subject to official publication.

Rules for forming and maintaining a register of trusted digital objects, as well as determining the types of digital objects to be included in the register

Chapter 1. General provisions

1. These Rules for the formation and maintenance of the register of trusted digital objects, as well as the definition of the types of digital objects included in the register (hereinafter referred to as the Rules) have been developed in accordance with paragraph 2 of Article 32 of the Digital Code of the Republic of Kazakhstan and define the procedure for the formation and maintenance of the register of trusted digital objects, as well as the definition of the types of digital objects included in the register.

2. The following concepts are used in these Rules:

1) quasi-public sector entities – state-owned enterprises, limited liability partnerships, joint-stock companies, including the National Welfare Fund, national management holdings, national holdings, national companies of which the state is the founder, participant or shareholder, as well as subsidiaries, dependent and other legal entities affiliated with them in accordance with the legislative acts of the Republic of Kazakhstan, the Fund social health insurance, State Social Insurance Fund, non-profit organization, providing conditions for the activities of bodies, their organizations and participants of the Astana International Financial Center;

2) the commission is an advisory body for making recommendations when considering applications for inclusion (exclusion) of a digital object in (from) the register (a), as well as for making changes (additions) to the information contained in the register;

3) applicant – individuals and legal entities producing software on the territory of the Republic of Kazakhstan, with the exception of central government agencies, the capital, regions, cities of republican significance, foreign institutions of the Republic of Kazakhstan, local executive bodies of regions, districts, cities of regional significance, akims of districts in the city, cities of regional significance, towns, villages, rural districts, quasi-public sector entities;

4) the register of trusted digital objects (hereinafter referred to as the Register) is a list of digital objects that meet the criteria established by these rules.;

5) the unified nomenclature directory of goods, works and services (hereinafter referred to as the ENS TRU) is a classifier of goods, works and services used in all regulated purchases of the Republic of Kazakhstan for planning, accounting and analysis of procurement processes;

6) the authorized body in the field of digitalization (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of digitalization;

7) the "digital government" web portal is a digital object that provides a "single window" of access to consolidated information posted by government agencies and other entities involved in the provision of public services, including the regulatory framework, as well as to government and other services provided in electronic form.;

8) digital objects are an isolated element of the digital environment created, used or transmitted through digital technologies, possessing unique digital characteristics and allowing subjects of the digital environment to exercise ownership, use or disposal powers to the extent established by the legislation of the Republic of Kazakhstan;

9) electronic digital signature (hereinafter referred to as EDS) is a digital record (set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.

Software included in the Register of Trusted Software and Electronic Industry Products prior to the entry into force of these Rules shall be included in the Register of Trusted Digital Objects by the authorized body based on the results of its monitoring of the validity of documents submitted upon inclusion (updating) in the Register of Trusted Software and Electronic Industry Products.

Chapter 2. The procedure for the formation and maintenance of the Registry

3. The register is formed and maintained by the authorized body by including and excluding digital objects in (from) the Register(s), as well as making changes (additions) to information about them.

4. The register is maintained in accordance with the form set out in Appendix 1 to these Rules.

5. The register is formed and maintained on the basis of applications submitted by the applicant for the inclusion (exclusion) of digital objects in (from) the Register (a), as well as amendments (additions) to information about them in accordance with Appendices 2, 3, 4 to these Rules (hereinafter referred to as the application), with the attachment of documents defined by in paragraph 8.

6. The application is submitted through the Digital Government web portal www.egov .kz or www.elicense.kz (hereinafter referred to as the portal).

7. Digital objects are subject to inclusion in the Register if they meet the criteria of cybersecurity, reliability, localization and technical support.:

1) the exclusive property rights to software that is a digital object or part of a digital object belong to the applicant, are valid throughout the territory of the Republic of Kazakhstan and for the entire duration of the exclusive right;

2) compliance with the declared type of digital object and category according to the Classifier of Digital objects of the "digital government" (hereinafter referred to as the Classifier);

3) compliance of the digital object with the established cybersecurity requirements;

4) compliance of the digital object with the declared functional and operational characteristics;

5) the localization share of software that is a digital object or part of a digital object is at least 80%;

6) provision of the digital facility with technical support;

Inclusion in the Registry of a digital object is not allowed if its operation requires software (with the exception of open source software) that is not included in the Registry.

8. To include a digital object in the register of trusted digital objects, an application is submitted in accordance with Appendix 3 of these Rules, accompanied by the following documents confirming the compliance of the digital object:

1) availability of test reports with positive test results for compliance with cybersecurity requirements, issued in accordance with the procedure established by the Rules for Testing Digital Objects of the digital government and Critical digital Objects for Compliance with Cybersecurity Requirements;

2) documents confirming the calculation of the localization share in the software of at least 80% in accordance with the procedure for confirming the Kazakhstani software manufacturer for inclusion in the Register of Kazakhstani Producers;

3) information on the availability of the digital facility by the technical support service in the territory of the Republic of Kazakhstan in accordance with Annex 9 of these Rules;

4) documents confirming that the applicant has exclusive property rights to software that is a digital object or part of a digital object, and their validity on the territory of the Republic of Kazakhstan for the entire period of validity of the exclusive property rights:

an agreement on the transfer of exclusive property rights to the applicant from the author or other copyright holder who has such rights, or documents confirming that the applicant has received such rights as an official work;

9. When submitting documents through the portal, the status of the notification of acceptance of the application is sent to the "personal account".

10. The authorized body shall monitor the information and validity of the documents contained in the Register.

11. The exclusion of digital objects from the Register is carried out on the basis of:

1) an application submitted by the applicant for the exclusion of digital objects from the Register in accordance with Appendix 4 to these Rules;

2) monitoring the Registry in case of revealing the facts of providing false information, false documents, expired documents, and (or) loss of compliance with the criteria for including a digital object in the Registry established by these Rules.

12. The structural subdivision of the authorized body, after receiving the application and documents, accepts them, registers them and verifies the completeness of the submitted documents.

13. If the applicant submits an incomplete package of documents provided for in paragraph 8 of these Rules and (or) expired documents, the digital object does not match the declared type and category according to the Classifier, as well as does not meet the inclusion criteria provided for in paragraph 7 of these Rules, the authorized body refuses to accept the application.

14. When the applicant submits a complete set of documents, the authorized body sends it to the Commission for consideration to make recommendations.

15. Compliance with the criteria for the inclusion of a digital object, as well as the validity of making changes (additions) to the information contained in the Register, is established by the authorized body by examining the documents submitted by the applicant, taking into account the recommendations of the Commission on the criteria specified in paragraph 7 of the Rules.

Applications that do not meet the criteria set out in these Rules are subject to rejection.

16. If it is necessary to clarify the provisions of the documents submitted by the applicant, the authorized body initiates the hearing of the applicant.

17. The result of the examination of the application is sent to the applicant on the portal in the "personal account" in the form of an electronic document certified with an electronic digital signature, in accordance with appendices 5, 6, 7, 8.

18. The total period for reviewing documents and issuing results from the date of receipt and registration of the package of documents by the authorized body is 20 (twenty) business days.

19. Information about a digital object is entered into the Registry based on the results of the results.

20. The inclusion of digital objects in the Register is classified by type and purpose in accordance with the Classifier with the assignment of the codes of the ENS TRU in accordance with Annex 10 to these Rules.

21. The Register, as well as amendments and additions to the Register, are sent to the operator of the digital e-procurement system within 14 (fourteen) business days and are subject to publication on the official digital resource of the authorized body within 14 (fourteen) business days after the relevant decision is made.

22. The applicant, no later than 30 (thirty) calendar days before the expiration date of the documents provided for in paragraph 8, shall send to the authorized body an application in the form specified in Annex 2 to these Rules, with the submission of updated versions of the documents in order to verify the relevance of the information contained in the Register.

23. The decision on inclusion (exclusion) in (from) the register (a) of digital objects, as well as making changes (additions) to information about them, is made by the authorized body, taking into account the recommendations of the Commission on compliance with the criteria of paragraph 7 of these Rules.

24. The grounds for a reasoned refusal to the applicant are:

submission by the applicant of an incomplete set of documents, according to the list provided for in paragraph 8, and (or) expired documents, and (or) inconsistency of the digital object with the declared type and category according to the Classifier;

establishing the unreliability of the documents submitted by the applicant and (or) the data (information) contained therein.

25. The procedure for the formation and functioning of the Commission is determined by the regulations approved by the authorized body.

Chapter 3. Procedure for determining the types of digital objects to be included in the Register

26. The types of digital objects included in the Register of Trusted Digital Objects include the following digital objects:

1) software is a digital object, which is a set of codes prepared for use, implementing algorithms that ensure the performance of certain functions, processing, storage, reproduction and (or) transmission of digital data;

2) digital resources - a set of ordered digital data, digital records and software for their creation, storage, processing, display and distribution;

3) digital systems - a functionally connected complex of digital resources that uses digital infrastructure facilities to ensure the creation, collection, processing, storage and distribution of digital data, as well as automating the interaction of subjects of the digital environment and (or) providing services in the digital environment;

4) digital platforms are a digital object that provides access to services in the digital environment, data, services, goods (works, services) hosted by subjects of the digital environment, and allows them to interact with each other.

If a digital object contains several types of features, it should be assigned to the predominant type based on its main functional purpose.

The applicant indicates the type of digital object based on the information contained in the documents attached to the application confirming the compliance of the digital object with the criteria established by these Rules.
