On approval of the Rules for the formation and maintenance of the State bank of construction projects and the provision of standard projects and design estimates

In accordance with subparagraph 68) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. Approve:
1) Rules for the formation and maintenance of the state bank of construction projects and the provision of standard projects and design estimates, in accordance with Appendix 1 to this order;
2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.
2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.
3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for the formation and maintenance of the state bank of construction projects and the provision of standard projects and design estimates
Chapter 1. General provisions
1. These Rules for the Formation and maintenance of the state bank of construction projects and the Provision of standard projects and Design Estimates (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 68) of Article 24 of the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code).
2. These Rules define:
the order of formation and management of the state bank of construction projects;
the procedure for providing standard projects and design estimates for linking from the state bank of construction projects.
3. The following concepts are used in the Rules:
1) user – persons who carry out construction at the expense of public investments;
2) the State Bank of Construction Projects (hereinafter referred to as the state bank) is a digital resource containing standard projects and design estimates for the construction of new construction facilities that have received a positive conclusion from a comprehensive non-departmental expert examination of construction projects.;
3) catalog - a list of standard projects and design estimates placed in the state bank;
4) the operator of the state bank is a state expert organization engaged in the formation and management of the state bank of construction projects, as well as the submission of standard projects and design estimates for linking from the state bank of construction projects.
4. The purpose of the formation and management of the state bank is to provide users with standard projects and design estimates posted in the state bank for linking. The use of standard projects and design estimates for other purposes is not allowed.
5. The main directions of functioning of the state bank are:
creating, maintaining, and ensuring the availability of the catalog;
provision of standard projects or design estimates.
6. The State Bank is a part of the portal for organizing the development and examination of projects based on the "one–stop shop" principle (hereinafter referred to as the Portal).
7. The property rights of the author(s) to works of architecture and urban planning created at the expense of public investments belong to the authorized body for architecture, urban planning and construction and the state expert organization for the formation and maintenance of the state bank of construction projects, as well as the presentation of standard projects and design estimates developed at the expense of public investments.
Chapter 2. The procedure for the formation and maintenance of the state bank of construction projects and the provision of standard projects and design estimates
8. Standard projects and design estimates for the construction of new construction facilities developed at the expense of public investments are subject to placement in the state bank.
9. The final version of the design and estimate documentation, developed and agreed upon according to an individual plan for the phased development and approval of design and estimate documentation for the construction of individual facilities requiring special regulation and (or) urban planning regulations, is subject to placement in the state bank, after issuing a positive conclusion of a comprehensive non-departmental expertise at the final stage.
10. Are not subject to placement in the state bank:
1) standard projects or design estimates that have received a negative conclusion from a comprehensive non-departmental expert examination;
2) design and estimate documentation for construction projects, the implementation of which is not provided for at the expense of public investments;
3) standard projects or design estimates marked with secrecy or marked "for official use";
4) projects of linear structures, engineering and (or) transport infrastructure;
5) Civil defense projects;
6) Space infrastructure projects;
7) Bank projects;
8) construction projects involving:
major repairs of construction sites or restoration of buildings and structures;
reconstruction, expansion, modernization or technical re-equipment of the operated construction facilities;
postutilization of construction sites, with the exception of demolition of emergency construction sites;
conservation (deconservation) of construction-in-progress facilities, the construction of which has been suspended.
11. After issuing a positive conclusion of a comprehensive non-departmental expertise on standard projects and design estimates, such standard projects and design estimates are checked by the operator of the state bank within 3 (three) working days for their compliance with paragraphs 8 and 10 of these Rules, according to the results of which the operator of the state bank places their final versions on the Portal.
12. According to the standard projects and design estimates included in the state bank, a catalog of standard projects and design estimates is formed, containing the following information about the project: name, customer, project organization, number and date of the positive conclusion of the comprehensive non-departmental examination of the project, technical and economic parameters.
13. To gain access to the state bank's catalog, the user must register on the Portal and sign an agreement on the procedure for working with standard projects and/or design estimates by means of an electronic digital signature.
14. To receive a standard project or design estimates for binding, posted in the catalog of the state bank, the user sends a notification on the Portal about the need to provide a standard project or design estimates, which is certified by an electronic digital signature.
15. The issuance of a standard project or design estimates for linking, posted in the state bank, is carried out automatically through the User's personal account on the Portal.
The user is sent an electronic version of a set of standard design or design estimates in their final version, certified by an electronic digital signature of experts responsible for the relevant sections (part) of the project.
16. The provision of a standard project or design estimates for linking from the state bank to users is carried out by a state expert organization free of charge.
17. Standard projects and design estimates received from the state bank are subject to updating and alignment with the current state regulatory documents by the customer.
18. The positive conclusions of the comprehensive non-departmental expertise on design and estimate documentation are placed in the state bank for a period of at least three years.
Standard projects are placed in the state bank and stored permanently.
19. Standard projects or design estimates for which previously issued opinions have been withdrawn on the grounds provided for in Article 115 of the Code are subject to exclusion from the state bank.

2. Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated December 25, 2020 No. 678 "On Amendments to the Order of the Minister of National Economy of the Republic of Kazakhstan dated November 19, 2015 No. 705 "On Approval of the Rules of the Unified State Electronic Bank of Pre-design and Design (Design Estimates) Documentation for the Construction of Facilities Financed by the State investments and funds of quasi-public sector entities" (registered in the Register of State Registration of Regulatory Legal Acts No. 21948).
3. Subparagraph 2) of paragraph 1 of the Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated November 11, 2022 No. 625 "On Amendments and Additions to Certain Orders of the Ministry of National Economy of the Republic of Kazakhstan" (registered in the Register of State Registration of Regulatory Legal Acts No. 30589).
