In accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and socially responsible services", subparagraph 43) of Article 9-1 of the Law of the Republic of Kazakhstan "On the Protection, Reproduction and Use of Wildlife", paragraph 1 of Article 27 of the Law of the Republic of Kazakhstan "On Legal Acts" and subparagraph 426) of paragraph 15 of the Regulations on the Ministry Agriculture of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated April 6, 2005 No. 310 "Some issues of the Ministry of Agriculture of the Republic of Kazakhstan", I ORDER:

1. Approve:

1) rules for the provision of public services "Approval of the installation of fish protection devices for water intake and discharge facilities" in accordance with Appendix 1 to this order;

2) rules for the provision of the state service "Issuance of a certificate of origin of catch" in accordance with Appendix 2 to this order.

2. Invalidate them:

1) Order of the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan dated August 12, 2020 No. 188 "On approval of the Rules for the provision of public services in the field of wildlife" (registered in the Register of State Registration of Regulatory Legal Acts under No. 21087);

2) Order of the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan dated October 6, 2021 No. 398 "On Amendments to the Order of the Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan dated August 12, 2020 No. 188 "On Approval of the Rules for the provision of public services in the field of wildlife" (registered in the Register of State Registration of Regulatory legal acts No. 24694).

3. The Committee of Fisheries of the Ministry of Agriculture of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the official Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. Control over the execution of this order is entrusted to the supervising Vice Minister of Agriculture of the Republic of Kazakhstan.

5. This order shall enter into force sixty calendar days after the date of its first official publication.

Regulations for the public service "Approval of the installation of fish protection devices for water intake and discharge facilities"

Chapter 1. General provisions

1. These rules for the provision of public services "Coordination of the installation of fish protection devices for water intake and discharge facilities" (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan "On State and Socially Responsible Services" (hereinafter referred to as the Law) and subparagraph 43) of Article 9-1 of the Law of the Republic of Kazakhstan "On Protection, reproduction and use of wildlife and determine the procedure for the provision of public services "Coordination of the installation of fish protection devices for water intake and discharge facilities" (hereinafter referred to as the public service).

2. The following basic concepts are used in the Rules:

1) fish protection device - a device for preventing fish resources and other aquatic animals from entering water intake and discharge facilities;

2) the authorized body in the field of fisheries (hereinafter referred to as the authorized body) is the central executive body responsible for the protection, reproduction and use of fish resources and other aquatic animals, as well as inter–sectoral coordination within its powers.;

3) water intake facility - a complex of structures and devices for water intake from water bodies;

4) discharge facility - a culvert designed to discharge (pass) water from a reservoir to prevent its overflow, as well as for useful water passes into the lower reaches.;

5) the digital government web portal (hereinafter referred to as the portal) is a digital object that provides a "single window" of access to consolidated information posted by government agencies and other entities involved in the provision of public services, including the regulatory legal framework, as well as to government and other services provided in electronic form.;

6) an electronic digital signature (hereinafter referred to as EDS) is a digital record (set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.

3. The state service is provided by the territorial divisions of the Committee of Fisheries of the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the service provider) to individuals or legal entities (hereinafter referred to as the service recipient).

Chapter 2. The procedure for the provision of public services "Approval of the installation of fish protection devices for water intake and discharge facilities"

4. To receive a public service, the service recipient submits to the service provider an application for approval of the installation of fish protection devices for water intake facilities (hereinafter referred to as the application) through the portal in accordance with Appendix 1 to the Rules.

5. The requirements for fish protection devices for water intake and discharge facilities were approved by Order No. 221 of the Minister of Agriculture of the Republic of Kazakhstan dated May 31, 2019 (registered in the Register of State Registration of Regulatory Legal Acts under No. 18783) (hereinafter referred to as the requirements for fish protection devices for water intake and discharge facilities).

The list of basic requirements for the provision of public services is specified in Appendix 2 to the Rules (hereinafter referred to as the List).

6. When the service recipient submits an application through the portal, the status of acceptance of the application is displayed in the "personal account" of the service recipient, as well as a notification of the date and time of receipt of the result of the provision of public services.

The service provider receives a certificate of registration (re-registration) of a legal entity, information about the registration of an individual entrepreneur, or about the start of activity as an individual entrepreneur, or a document certifying the identity of an individual from state digital systems through the digital government gateway.

7. The interaction of the portal and digital systems is carried out in accordance with Article 83 of the Digital Code of the Republic of Kazakhstan.

8. On the day of receipt of the application, an employee of the service provider's office registers it in the digital system "State Database "E-Licensing" (hereinafter referred to as "E–Licensing") and sends it to the head of the service provider, who appoints the responsible employee.

If a service recipient applies after the end of working hours or on weekends and holidays, in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the Law of the Republic of Kazakhstan "On Holidays in the Republic of Kazakhstan", the application is accepted and the result of the provision of public services is issued on the following business day.

An employee of the office refuses to accept an application if there are expired documents. The refusal to accept the application is sent to the service recipient in the digital system "E-licensing".

The Service provider checks the completeness of the submitted documents within 2 (two) business days from the date of registration of the application.

9. If there are grounds for refusal to provide a public service, the service provider sends a reasoned refusal to provide a public service in accordance with Appendix 3 to the Rules, signed by an authorized person of the service provider to the "personal account" of the service recipient.

The service provider refuses to provide public services on the grounds specified in paragraph 9 of the List.

The service provider's refusal to approve the installation of fish protection devices for water intake facilities does not exclude the possibility of the service recipient submitting a second application after eliminating the comments reflected in the reasoned refusal to provide public services.

10. In the absence of grounds for refusal to provide a public service, the responsible structural unit, within 2 (two) business days from the date of registration of the application, draws up the result of the provision of a public service - approval of the installation of fish protection devices for water intake facilities in accordance with Appendix 4 to the Rules.

The result of the provision of public services is sent through the portal to the "personal account" of the service recipient in the "E-licensing" in the form of an electronic document certified by the EDS of the head of the service provider.

11. The service provider ensures that data is entered into the digital monitoring system for the provision of public services on the stage of provision of public services in accordance with the procedure approved by the Order of the Acting Minister of Transport and Communications of the Republic of Kazakhstan dated June 14, 2013 No. 452 "On Approval of the Rules for Entering Data into the information system for monitoring the provision of public services on the stage of provision of public services" (registered in the Register of State registration of regulatory legal acts under No. 8555).

12. The authorized body sends information about the changes and/or additions to the Rules to the operator of the portal's digital infrastructure.

Chapter 3. Procedure for appealing decisions, actions (inaction) of the service provider and (or) their officials on the provision of public services "Approval of the installation of fish protection devices for water intake and discharge facilities"

13. A complaint against the decision, action (inaction) of the service provider on the provision of public services is submitted to the head of the service provider, the department of the authorized body, the authorized body, to the authorized body for assessment and quality control of public services.

If a complaint is received in accordance with paragraph 4 of Article 91 of the Administrative Procedural Code of the Republic of Kazakhstan (hereinafter referred to as the CPC RK), the service provider sends it to the body reviewing the complaint (a higher administrative body and/or official), no later than 3 (three) working days from the date of receipt. The complaint by the service provider is not sent to the body reviewing the complaint (a higher administrative body and/or an official), in the event of a favorable act or administrative action that fully satisfies the requirements specified in the complaint.

14. The complaint of the service recipient in accordance with paragraph 2 of Article 25 of the Law is subject to consideration.:

by the service provider, department of the authorized body, authorized body – within 5 (five) business days from the date of its registration;

by the authorized body for the assessment and control of the quality of public services – within 15 (fifteen) working days from the date of its registration.

The period for consideration of the complaint by the service provider, the department of the authorized body in the field of fisheries, the authorized body, the authorized body for assessment and quality control of public services in accordance with paragraph 4 of Article 25 of the Law is extended for no more than 10 (ten) working days, if necessary.:

1) conducting an additional study or verification of the complaint or an on-site inspection;

2) getting more information.

In case of extension of the time limit for consideration of the complaint, the official authorized to consider complaints, within 3 (three) business days from the date of extension of the time limit for consideration of the complaint, informs the recipient of the complaint in writing (when filing a complaint on paper) or electronically (when filing a complaint electronically) about the extension of the time limit. consideration of the complaint, indicating the reasons for the extension.

15. Unless otherwise provided by law, an appeal to the court is allowed after a pre-trial appeal in accordance with paragraph 5 of Article 91 of the CPC RK.

Grounds for refusal to provide public services established by the laws of the Republic of Kazakhstan

1) establishing the unreliability of the documents submitted by the service recipient and the information contained therein for obtaining a public service; 2) in respect of the service recipient, there is a court decision (verdict) that has entered into legal force prohibiting activities or certain types of activities that require obtaining a certain public service; 3) in respect of the service recipient, there is a court decision that has entered into legal force, on the basis of which the service recipient is deprived of a special right related to receiving a public service.

Other requirements, taking into account the specifics of the provision of public services

The recipient receives the public service in electronic form through the portal, subject to the availability of an EDS.The service recipient has the opportunity to receive a notification on the procedure and status of the provision of public services in remote access mode through the portal's "personal account", the service provider's help desk, as well as the Unified Contact Center "1414", 8-800-080-7777.

Rules for the public service "Issuance of a certificate of catch origin"

Chapter 1. General provisions

1. 11. The service provider refuses to provide public services on the grounds specified in paragraph 9 of the List.

The service provider's refusal to provide a public service does not exclude the possibility of the service recipient submitting a second application after the elimination of the comments reflected in the reasoned refusal to provide a public service.

12. In the absence of grounds for refusal to provide a public service, the service provider issues a certificate of the origin of catch in the form approved by the Order of the Deputy Prime Minister of the Republic of Kazakhstan - Minister of Agriculture of the Republic of Kazakhstan dated July 8, 2016 No. 304 "On approval of the form of the certificate of origin of catch" (registered in the Register of State Registration of Regulatory Legal Acts No. 14117).

13. The service provider ensures that data is entered into the digital monitoring system for the provision of public services on the stage of provision of public services in accordance with the procedure approved by the Order of the Acting Minister of Transport and Communications of the Republic of Kazakhstan dated June 14, 2013 No. 452 "On Approval of the Rules for Entering Data into the information system for monitoring the provision of public services on the stage of provision of public services" (registered in the Register of State registration of regulatory legal acts under No. 8555).
