On approval of the Rules of operation of the construction site

 In accordance with paragraph 5 of Article 137 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. Approve the attached Rules for the operation of the construction site.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for the operation of a construction site

Chapter 1. General provisions

     1. These Rules for the Operation of a Construction facility (hereinafter referred to as the Rules) have been developed in accordance with paragraph 5 of Article 137 of the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and determine the procedure for the operation of a construction facility.

     2. The following concepts are used in these Rules:

     1) warranty period – the period of operation of construction facilities established in accordance with the Code, the Civil Code of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan or an agreement during which the customer, contractor (general contractor) guarantees the preservation of the quality of the indicators of the construction facility in accordance with state regulatory documents, the construction project and the legislation of the Republic of Kazakhstan;

     2) construction project – design and estimate documentation containing the relevant requirements of the Code, as well as estimates for the organization and management of construction, engineering preparation of the territory, landscaping;

     3) a construction object is an object of an artificial environment in the form of a building or structure, which is the final result of construction activity.;

     4) operation of a construction facility is a stage of the life cycle of a construction facility, covering actions related to the use of the construction facility for its intended purpose during the estimated service life and in accordance with the safety level established by previously issued permits and regulations. It includes the stages of the construction site: maintenance and maintenance;

     5) the person responsible for the operation of the construction facility is the owner of the construction facility (including through a condominium), or persons who own the construction facility on another legal basis, or a person (individual entrepreneur or legal entity) engaged by the owners or persons who own the construction facility on another legal basis for the safe operation of the construction facility based on the contract for the operation of the construction site.

Chapter 2. Operating procedure of the construction site

     3. The operation of a constructed or reconstructed construction facility is allowed after the commissioning of this facility, except for the cases provided for in paragraph 3 of Article 136 of the Code.

     4. The operation of construction facilities is carried out in accordance with:

     their permitted use (purpose);

     requirements of the Technical Regulations "On the Safety of Buildings and Structures, Building Materials and Products", approved by the Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated June 09, 2023 No. 435 (registered in the Register of State Registration of Regulatory Legal Acts No. 32783) (hereinafter referred to as the technical regulations);

     design and estimate documentation.

     5. The operation of the construction site is carried out by the person responsible for the operation of the construction site.

     6. During the operation of the construction site, maintenance of the construction site, operational control over the technical condition of construction sites, and routine repairs of buildings and structures are provided.

     7. In order to ensure the safety of a construction site with a large number of people, it is planned to organize access control, including the use of access control and management systems.

     8. The person responsible for the operation of the construction facility shall keep a log of the operation of the construction facility in paper and (or) electronic form in accordance with Appendix 1 to these Rules, which contains information on the dates and results of inspections, control checks and (or) monitoring of their foundations, building structures, systems and networks of engineering and technical support, their elements, about the performed maintenance work on the construction site, about the ongoing repairs of the construction site, the dates and contents of the regulations issued by the state authorities on the elimination of violations detected during the operation of the construction site, information on the elimination of these violations.

     The electronic log of the construction site operation is maintained in compliance with the requirements of the Law of the Republic of Kazakhstan "On Electronic Document and Electronic Digital Signature".

Paragraph 1. Maintenance of the construction site

     9. Maintenance of a construction facility is carried out in order to maintain the stability parameters, reliability of construction facilities, as well as the serviceability of building structures, systems and networks of engineering and technical support, and their elements.

     10. Maintenance of a construction site includes the performance of routine maintenance work aimed at preserving the operational characteristics of building structures, systems and networks of engineering and technical support, their elements, as well as the elimination of defects and (or) damages identified during the operation of the construction site.

     11. The frequency and composition of maintenance work to be performed on the construction site and maintenance of the proper technical condition of the construction site (including necessary observations, inspections) are determined by the person responsible for the operation of the construction site, in accordance with state regulatory documents, the results of monitoring the technical condition of the construction site, based on the conditions of their construction, reconstruction, capital repairs and operation of the construction site, taking into account the instructions of the manufacturer of building structures, systems and networks of engineering and technical support, their elements.

     12. Unscheduled maintenance of a construction site is carried out when deviations from the proper technical condition are detected, as well as based on the results of operational control over the technical condition of construction sites.

     13. The standard scope of maintenance work for a construction facility is set out in appendix 2 to these Rules.

     14. The standard structure of the internal regulations for the operation of a construction facility is set out in Appendix 3 to these Rules.

     15. The identified defects and (or) damages are recorded in the construction site operation log with information on the date of detection of the defect and (or) damage, the date and method of its recommended and actual elimination.

     16. During the maintenance of a construction site, the safety of load-bearing and enclosing building structures, the serviceability of heating, ventilation, fire automation systems, water supply, sewerage, electricity supply and engineering support networks, their elements, as well as the operability of technological and elevator equipment are ensured.

     17. Maintenance work on a construction site is carried out using materials, products and equipment that meet the requirements of technical regulations and design estimates, without changing the design solutions and structural characteristics of the construction site.

     18. Maintenance of the construction site is carried out in compliance with the requirements of these Rules, taking into account the provisions of the construction contract, warranty obligations of the customer, contractor (general contractor) and design estimates.

Paragraph 2. Operational control over the technical condition of construction facilities

     19. Operational control over the technical condition of construction facilities is carried out during the operation of a construction facility by conducting periodic inspections, control checks and (or) monitoring the condition of foundations, building structures, systems and networks of engineering and technical support, their elements in order to assess the condition of structural and other characteristics of reliability and safety of construction facilities, systems and networks of engineering and technical support.technical support and compliance of the specified characteristics with the requirements of state regulatory documents, design and estimate documentation, as well as in accordance with the executive documentation.

20. Periodic inspections are carried out within the time limits established by technical regulations, state regulatory documents, design estimates or instructions from manufacturers of building structures, systems and networks of engineering and technical support, their elements, as well as additionally before and after the heating season, with a visual assessment of the condition of building structures, foundations, systems and networks of engineeringtechnical support, their elements, detection of defects and (or) damages, signs of deterioration of technical condition.

     21. Control checks are carried out when it is necessary to clarify the results of periodic inspections, when signs of an emergency are detected, as well as in cases provided for by state regulatory documents and design estimates.

     22. Monitoring of the condition of foundations, building structures, systems and networks of engineering and technical support, their elements is carried out in relation to construction sites:

     located in areas (zones) of increased seismic hazard;

     located in areas with special (extreme) climatic, geotechnical, or hydrogeological conditions, as well as in areas of environmental and man-made disasters, or affected by other adverse events and processes;

     unique ones;

     first and second levels of responsibility;

     in cases stipulated by the design and estimate documentation or the results of periodic inspections and (or) control checks.

     23. For engineering and technical support systems and networks, their elements related to sources of increased danger or having increased technological complexity (including elevator equipment, fire protection systems, gas supply, electricity and ventilation), separate regulations for the operation of a construction facility are being developed, approved by the person responsible for the operation of the construction facility, taking into account the requirements of technical regulations and state regulatory documents.

     24. Based on the results of operational control over the technical condition of construction facilities, the person responsible for the operation of the construction facility draws up an operational control report in any form, information about which is recorded in the operation log of the construction facility and used to make decisions on routine or major repairs.

     25. Defects and (or) damages identified during the operational control of the technical condition of construction facilities are subject to registration by defective acts drawn up in any form, with mandatory photo and (or) video recording, indicating the date, time and place of fixation, as well as a description of the nature and degree of the defect and (or) damage.

     26. Defective acts on building structures, systems and networks of engineering and technical support, and their elements of a construction site are drawn up by a commission composed of representatives of the person responsible for the operation of the construction site, and, if necessary, representatives of a design, expert or specialized organization.

Paragraph 3. Routine maintenance

     27. Current repairs are carried out in order to restore the operability and operational characteristics of building structures, systems and networks of engineering and technical support, their elements disrupted during the operation of the construction site, without changing their design solutions.

     28. Current repairs are carried out based on the results of operational control over the technical condition of construction facilities and include the elimination of defects and (or) damage, replacement and (or) restoration of individual elements of building structures of such construction facilities (with the exception of elements of load-bearing building structures), elements of systems and networks of engineering and technical support for such construction facilities.

     29. The current repairs are carried out taking into account the requirements of the technical regulations, state regulatory documents and design estimates approved during the construction of this construction facility.

     30. During the current repair, it is not allowed to change structural solutions, worsen the reliability and safety indicators of the construction site, as well as perform work related to major repairs or reconstruction.

     The scope of work on current repairs, major repairs or reconstruction is determined by state regulatory documents.

     31. The person responsible for the operation of the construction site shall begin routine repairs within thirty calendar days from the date of drawing up the operational control act.

     32. During the warranty period, all work to eliminate defects and (or) damages is carried out in accordance with the warranty obligations of the customer, contractor (general contractor), with the exception of the cases provided for in paragraph 3 of Article 122 of the Code, with mandatory recording in the construction site operation log.

     After the expiration of the warranty period, the maintenance is carried out by the person responsible for the operation of the construction site, independently or with the involvement of specialized organizations.

Typical scope of maintenance work for a construction facility

     1. Maintenance of a construction facility involves the implementation of a set of measures to maintain the stability parameters, reliability of construction facilities, as well as the serviceability of building structures, systems and networks of engineering and technical support, their elements, including:

     1) visual inspection of load-bearing and enclosing building structures, facades, roofs, foundations;

     2) control of precipitation and deformations of building structures, detection of cracks and damages;

     3) verification of compliance with operating modes (temperature, humidity, vibration);

     4) cleaning of building structures from pollution, cleaning and flushing of atmospheric water drainage systems;

     5) control of the anticorrosive condition of metal and reinforced concrete elements;

     6) carrying out small one-time works to eliminate defects, preparing facilities for seasonal loads (winter, floods, heavy rains).

     2. Maintenance of existing systems and networks of engineering and technical support, their elements include the following:

     1) heating, ventilation and air conditioning systems:

     inspection, control and adjustment of equipment;

     checking the pressure, temperature and tightness of the systems;

     cleaning filters, checking and adjusting automatic systems;

     lubrication and adjustment of moving components;

     checking emergency shutdown systems and fire automation systems.

     2) water supply and sewerage systems:

     visual inspection of pipelines, pumps, fittings;

     flushing and cleaning of filters, elimination of blockages;

     checking the tightness and pressure in the systems;

     monitoring of the condition of underground and surface engineering structures;

     venting, overpressure control, and maintaining cleanliness in chambers and ducts.

     3) power supply systems:

     inspection of overhead lines, supports and grounding devices;

     measurement of insulation and grounding resistance;

     checking the condition of insulators and tubular arresters;

     preventive lubrication, cleaning, oil refilling;

     load and voltage testing, transformer and equipment testing;

     repair of minor damages, monitoring of protective signs, conducting a riding inspection after accidents or bad weather.

     3. The maintenance of technological and production equipment includes:

     1) schedule inspection and visual monitoring of equipment condition;

     2) checking and lubrication of friction parts;

     3) monitoring the operation of bearings, actuators and fittings;

     4) elimination of dust, leaks of water, oil, gas, fuel oil;

     5) monitoring of fasteners, supports, position indicators of pipelines;

     6) monitoring the operation of the equipment in reserve.

     4. The maintenance of elevator equipment includes:

     1) visual inspection of elevator cabins, shaft doors, machinery and block rooms for visible defects (or) damages, foreign objects and signs of malfunctions;

     2) monitoring the operability of the main components and elements of elevator equipment, including drives, ropes, guides, braking devices, control and alarm systems;

     3) checking the serviceability of security devices, emergency communications and alarms, as well as dispatching facilities;

     4) monitoring compliance with the established operating modes of elevator equipment and its conditions of use;

     5) diagnostics, tests and inspections of elevator equipment by specialized organizations in accordance with the technical regulations and manufacturer's instructions.

Appendix 3 to the Rules of operation of the construction facility

The typical structure of the internal regulations for the operation of a construction facility

     1. The internal regulations for the operation of the construction facility provide:

     1) the procedure for access to the construction site, as well as to individual rooms, zones and parts of the construction site necessary for its operation;

     2) the procedure for the use of engineering and technical support systems and networks, their elements;

     3) the procedure for the use of common premises, common property of the construction site and other places of common use;

     4) the order of organization and execution of planned, unplanned and emergency work;

     5) the procedure for admitting employees, contractors and other persons to carry out maintenance of a construction facility, operational control over the technical condition of construction facilities, and routine repairs;

     6) the procedure for providing access to building structures, systems and networks of engineering and technical support, their elements, premises, technical floors, basements, roof and other areas necessary for the operation of the construction site;

     7) the procedure for performing work in the premises and other parts of a construction site that may affect the condition of load-bearing and enclosing building structures, engineering and technical support systems and networks, their elements, fire protection systems, and evacuation routes;

     8) the procedure for interaction of owners, users of premises, other legal owners, contractors and the person responsible for the operation of the construction site on the issues of the operation of the construction site;

     9) the procedure for notification of planned work, as well as the procedure for performing emergency and urgent work.;

     10) the procedure for reporting identified defects, damages, malfunctions, emergencies, smoke, fire and other circumstances affecting the safe operation of the construction site;

     11) the procedure for taking measures to prevent cluttering of escape routes, restrict access to engineering equipment, fire extinguishing equipment, shut-off valves, electrical panels and other technical elements of the construction site;

     12) the procedure for the collection, temporary storage and disposal of waste generated during the operation of a construction facility;

     13) other issues related to the organization of maintenance and safe operation of the construction site.
