On approval of the Rules of pedagogical support for minors requiring special attention in educational institutions

Order of the Minister of Education of the Republic of Kazakhstan dated April 29, 2026 No. 104-NK. Registered with the Ministry of Justice of the Republic of Kazakhstan on May 4, 2026 No. 38628

In accordance with subparagraph 3) of Article 20 of the Law of the Republic of Kazakhstan "On the Prevention of Offenses", I ORDER:

     1. To approve the attached Rules for the pedagogical support of minors requiring special attention in educational institutions.

     2. The Committee for the Protection of Children's Rights of the Ministry of Education of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Education of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order, submit to the Legal Department of the Ministry of Education of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Education of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules of pedagogical support for minors requiring special attention in educational institutions

Chapter 1. General provisions

     1. These Rules of pedagogical support for minors requiring increased attention in educational organizations (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 3) of Article 20 of the Law of the Republic of Kazakhstan "On the Prevention of Offenses" and determine the procedure for organizing and implementing pedagogical support for minors requiring increased attention in educational organizations.

     2. The following basic concepts are used in these Rules:

     1) the legal representatives of the child are the parents (parent), adoptive parents (adoptive parents), guardian or trustee, foster parent (foster parents), foster professional educator (foster professional educators), foster carer and other persons replacing them who, in accordance with the legislation of the Republic of Kazakhstan, provide care, education, upbringing, protection of rights and freedoms. legitimate interests of the child;

     2) pedagogical support for minors requiring increased attention is a set of individual social, psychological and pedagogical measures aimed at early identification of students requiring increased pedagogical attention and providing them with timely support.;

     3) the Prevention Council of an educational organization (hereinafter referred to as the Prevention Council) is a collegial body of an educational organization that carries out activities to identify and prevent offenses among minors, assign or not assign pedagogical support to minors who require increased attention.;

     4) neglected – a minor whose behavior is not monitored due to non-fulfillment or improper fulfillment of duties for his upbringing, education and (or) maintenance by parents or their legal representatives, or as a result of his unauthorized departure from home or organizations that perform functions to protect the rights of the child.;

     5) homeless – street child who does not have a place of residence;

Chapter 2. Identification of minors requiring increased attention

     3. Minors are subject to pedagogical support:

     1) not doing well in academic subjects;

     2) street children, street children, engaged in vagrancy, begging;

     3) grossly or repeatedly violating the charter and (or) internal regulations of an educational organization;

     4) systematically skipping classes for no good reason for four days or more during one month;

     5) who have committed an administrative and (or) criminal offense;

     6) alcohol users, energy drinks, psychoactive substances, electronic consumption systems (vapes), tobacco products;

     7) those suffering from gambling addiction (ludomania);

     8) pregnant women;

     9) who have been subjected to violence, abuse, bullying, or witnessed violence;

     10) those who have committed violence, abuse, bullying;

     11) graduates of special educational institutions;

     12) those who have committed antisocial behavior.

     4. The identification of minors who require increased attention is carried out in the educational process of the educational organization.

     5. The identification of minors requiring increased attention is carried out:

     1) classroom teachers, tutors, and teacher assistants;

     2) subject teachers;

     3) educational psychologists;

     4) social educators;

     5) the administration of the educational organization;

     6) based on information received from the authorized bodies of the crime prevention system, the legal representatives of the child, students and pupils.

Chapter 3. The procedure for the appointment of pedagogical support for minors requiring increased attention

     6. The issue of the appointment of pedagogical support for minors requiring increased attention is being considered at a meeting of the prevention council with the participation of the minor and his legal representatives.

     7. The Prevention Council consists of a chairman, a deputy chairman, members and a secretary.

     The chairman of the prevention Council is the head of the educational organization, the deputy chairman is the deputy head of the educational organization for educational work, the secretary of the prevention council is a social educator, and in case of his absence, a teacher–psychologist.

     8. The prevention council consists of a teacher-psychologist, classroom teachers, tutors, subject teachers and (or) other teachers numbering at least 7 (seven) people.

     The personal composition of the prevention council is approved by the order of the head of the educational organization annually no later than August 31 of the current calendar year.

     9. When considering the cases provided for in the sub-paragraphs 3), 5), 6), 7), 8), 9), 10), 11), 12) According to paragraph 3 of these Rules, by decision of the chairman, representatives of the internal affairs bodies, the body performing the functions of guardianship or trusteeship, the center are involved in the meeting of the prevention council. family support, a psychological support center, the regional commissioner for children's rights of the region, the city of republican significance, the capital, as well as a medical professional.

     The Deputy Chairman of the Prevention Council notifies the involved persons about the place, date and time of the prevention Council 3 (three) working days before the date of the prevention council.

     The persons involved participate in the meeting of the prevention council and make recommendations.

     10. Chairman of the Prevention Council:

     1) organizes the work of the prevention council, presides over and ensures the high-quality and timely fulfillment of the tasks and functions assigned to the prevention council;

     2) determines the place and time of meetings of the prevention Council;

     3) approves the work plan of the Prevention Council;

     4) monitors the quality and timely implementation of measures of the individual plan of preventive work with minors requiring increased attention (hereinafter referred to as IPPR);

     5) conducts explanatory work with legal representatives on issues of upbringing, education, and development of students and pupils of the educational organization.

     11. Deputy Chairman of the Prevention Council:

     1) in the absence of the Chairman, performs his duties;

     2) preliminarily examines the materials submitted for consideration by the prevention Council;

     3) invites legal representatives of a minor who requires special attention to a meeting of the prevention council.;

     4) assists the Chairman in the overall management of the activities of the prevention Council;

     5) develops a work plan for the prevention council and submits it to the Chairman for approval.

     12. Secretary of the Prevention Council:

     1) prepares materials and documents for the meeting of the prevention Council;

     2) formulates the agenda of the meeting of the Prevention Council;

     3) organizes the meeting of the prevention Council;

     4) notify the members of the upcoming meeting of the prevention Council;

     5) submits to the members of the prevention Council the materials necessary for the meeting.;

     6) keeps minutes of the meeting;

     7) carries out constant monitoring of the implementation of the decisions of the prevention Council.

     13. The Deputy Chairman of the Prevention Council annually, no later than August 31, develops and submits for approval to the Chairman of the Prevention Council a work plan in accordance with Annex 1 to these Rules.

     The Prevention Council's work plan includes deadlines, completion form, responsible persons, and activities.

     14. Meetings of the prevention Council are held as necessary, but at least 2 (two) once a month during the academic year, and are considered eligible if at least two thirds of its members are present.

     15. Functions of the Prevention Council:

     1) timely identification of minors who require increased attention and assistance to them;

2) assistance in adapting students and pupils to the conditions of the educational environment and increasing learning motivation;

     3) providing assistance to the child's legal representatives in the education and upbringing of minors who require increased attention;

     4) prevention of neglect, homelessness, offenses and antisocial actions of minors;

     5) providing social, psychological and pedagogical assistance to students and pupils of an educational organization.

     16. If information about a minor requiring special attention is received from the persons specified in paragraph 5 of these Rules, the secretary of the Prevention Council shall, within one (1) business day, register it in the register of information about minors requiring special attention and notify the legal representatives of the child.

     17. The Secretary of the Prevention Council, within two (2) business days from the date of registration of information about a minor requiring increased attention, together with the class teacher, tutor, and teacher-psychologist, performs an initial assessment of the child's situation in accordance with Appendix 2 to these Rules.

     18. The initial assessment of the child's situation is provided to the Deputy Chairman of the Prevention Council within 1 (one) working day after it is conducted.

     19. The Deputy Chairman of the Prevention Council shall, within one (1) business day from the date of receipt of the initial assessment of the child's situation, notify the child's legal representative of the place, date and time of the prevention council by sending a notification to the email address or phone number indicated in the student's or pupil's personal file.

     20. A meeting of the prevention council is held no later than 7 (seven) business days from the date of registration of information about a minor requiring special attention.

     21. In case of non-appearance of the child's legal representatives, the meeting of the prevention council is postponed for a period of 3 (three) working days.

     The Deputy Chairman of the Prevention Council notifies the child's legal representatives, members of the prevention Council, and involved persons of the place, date, and time of the repeated meeting of the prevention Council by sending a notification to the email address or phone number specified in the student's or pupil's personal file.

     Repeated failure of the child's legal representatives without valid reasons is not an obstacle to holding a meeting of the prevention council.

     22. At the meeting of the prevention Council, issues of the causes and conditions contributing to the occurrence of the circumstances specified in paragraph 3 of these Rules, issues of assigning pedagogical support to a minor requiring increased attention, based on an initial assessment of the child's situation, proposals from members of the prevention council, recommendations from invited persons, opinions from the legal representatives of the child and the minor requiring increased attention are considered.

     23. After studying the materials and listening to the participants, the prevention council decides whether or not to assign pedagogical support to a minor who requires increased attention.

     The decision of the prevention council on the appointment or non-assignment of pedagogical support to a minor requiring increased attention is made by a majority vote of the members present at the meeting and is formalized by the protocol. If the votes are equal, the vote of the chairman of the prevention Council is decisive.

     The minutes reflect the time and place of the meeting, the composition of the prevention council, the surname, first name, patronymic (if any) of the child to be considered, and the decision taken.

     The appointment of pedagogical support for a minor is made in the form of an IPPR, in accordance with Appendix 3 to these Rules.

     24. The Deputy Chairman of the Prevention Council explains the contents of the IPPR to the child's legal representatives.

     In the absence of the child's legal representatives at a meeting of the prevention Council, the IPPR is sent to the child's legal representatives by e-mail specified in the student's or pupil's personal file.

     25. Monitoring of the quality and timely implementation of IPPR measures is reviewed at meetings of the Prevention Council at least 1 (one) time per quarter during the academic year.

     26. In cases of changes in the behavior of a minor requiring increased attention or other circumstances, the IPPR is reviewed and adjusted by decision of the prevention council on the basis of a petition from the class teacher or tutor or a psychologist or social educator or the child's legal representative.

     27. If the legal representatives refuse to provide pedagogical support to a minor who requires increased attention, the educational organization submits the materials to the Commission on Juvenile Affairs and Protection of their Rights for further consideration.

     28. The materials are sent no later than 3 (three) business days from the date of the written refusal of the child's legal representatives from the pedagogical support of a minor requiring increased attention, and are issued by an official letter signed by the head of the educational organization.

Chapter 4. Grounds for termination of pedagogical support for minors requiring increased attention

     29. The decision to terminate the pedagogical support of a minor requiring increased attention is made at a meeting of the prevention council at the request of the deputy chairman or the child's legal representative based on the positive characteristics of the class teacher, educator, psychologist, social educator.

     30. In case of transfer of a minor requiring increased attention, who has been assigned pedagogical support, to another educational organization, the IPPR, as well as information about the preventive work carried out, are transferred to the educational organization at the new place of study, education in compliance with the requirements of the legislation of the Republic of Kazakhstan on personal data protection.

     The transfer of the IPPR and information about the preventive work carried out is carried out with the written consent of the legal representative.

     31. The appointment of pedagogical support does not entail legal consequences for a minor.

     32. Data on the pedagogical support of minors requiring special attention is confidential; information about such children is provided upon written requests from educational organizations, law enforcement agencies, the regional authorized body for the protection of children's rights of the Republic of Kazakhstan and the authorized body in the field of education, in accordance with the Law of the Republic of Kazakhstan "On Personal Data and their Protection".
