In accordance with paragraph 2 of Article 22-1 of the Law of the Republic of Kazakhstan dated February 16, 2012 "On military service and the status of military personnel"
I DECREE:
1. The Administration of the President of the Republic of Kazakhstan and the National Security Committee of the Republic of Kazakhstan shall conduct an extraordinary certification of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan by December 31, 2013.
2. To form the Higher Attestation Commission under the President of the Republic of Kazakhstan for the extraordinary attestation of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the Commission).
3. Approve the attached: 1) Regulations on the Commission; 2) the composition of the Commission; 3) Rules for the extraordinary certification of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan.
4. The National Security Committee of the Republic of Kazakhstan shall take other measures arising from this Decree.
5. This Decree shall enter into force from the date of signing.

1. General provisions
1. This Regulation defines the legal status and powers of the Higher Attestation Commission under the President of the Republic of Kazakhstan for conducting extraordinary attestation of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the Commission). 2. In its activities, the Commission is guided by The Constitution, legislative acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, including the Rules for the extraordinary attestation of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as military personnel) and these Regulations.
2. Tasks of the Commission
3. The tasks of the Commission are: 1) to conduct an extraordinary attestation of: Deputy Directors of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the Border Guard Service); heads of main departments; deputy heads of the General Staff; deputy heads of main departments; heads of regional departments; deputy heads of regional departments; head of the Academy of the Border Service; heads of departments (in as part of the General Staff, main departments); heads of departments (independent); deputy chiefs of staff of regional departments; heads of border detachments; heads of border control detachments; heads of individual checkpoints; commandant of a separate border commandant's office; division commanders of border ships and boats; commander of 1 air base; deputy commander of 1 air base; commander of 730 separate communications regiment; 2) organization and coordination of the extraordinary certification of military personnel.
3. Rights of the Commission
4. The Commission has the right: 1) to request the necessary information from state bodies and organizations on issues within the competence of the Commission; 2) to involve, as necessary, officials, specialists of state bodies and representatives of interested organizations on issues within the competence of the Commission; 3) to hear attested military personnel at meetings of the Commission, as well as representatives of government agencies and other organizations on issues within the competence of the Commission.
4. Organization of the Commission's activities
5. The Chairman of the Commission: 1) carries out the general management of the Commission's activities; 2) determines the place and time of the Commission's meetings; 3) chairs the Commission's meetings; 4) gives binding instructions to the members of the Commission. 6. The members of the Commission shall participate in the discussion of issues considered at the meeting of the Commission and shall have the right to make proposals on the schedule of the Commission's work. 7. The Secretary of the Commission organizes the meetings of the Commission and does not have the right to vote. 8. A meeting of the Commission is considered competent if it is attended by at least two thirds of its members. The Commission's decisions are made by a simple majority of votes. In case of equality of votes, the vote of the Chairman of the Commission is decisive. 9. The decision taken by the Commission is formalized by a protocol signed by the Chairman of the Commission. 10. The working body of the Commission is the Secretariat of the Security Council of the Republic of Kazakhstan.

Rules for the extraordinary certification of military personnel under the contract of the Border Service of the National Security Committee of the Republic of Kazakhstan
1. General provisions
1. These Rules define the procedure for conducting extraordinary attestation of military personnel under the contract of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan (hereinafter referred to as military personnel).
2. Organization of preparation for the extraordinary attestation
2. The main evaluation criteria for the extraordinary attestation are: 1) the ability of military personnel to perform their duties and the results of their professional activities; 2) the level of theoretical knowledge and practical skills. Additional criteria for evaluating certified military personnel, taking into account the specifics and responsibilities assigned to them, are determined by the Chairman of the National Security Committee of the Republic of Kazakhstan (hereinafter - KNB). 3. The extraordinary certification includes a number of successive stages: 1) carrying out preparatory activities; 2) determination of professional aptitude: testing for knowledge of the legislation of the Republic of Kazakhstan (including the charters of the Armed Forces, other troops and military formations of the Republic of Kazakhstan, regulatory legal acts of the National Security Committee in areas of activity regulating combat and special training); passing standards for combat training (fire, drill, physical training, protection from weapons of mass destruction) 3) psychological and sociological research, including using polygraph equipment*; 4) an interview with a serviceman conducted by the attestation commission, taking into account the evaluation criteria and certification stages (unsatisfactory results of the serviceman based on the results of the stages provided for in subparagraphs 1) - 3) are not grounds for exclusion from the interview); 5) making a decision by the attestation commission. 4. The personnel units of the Border Guard Service of the National Security Committee shall notify military personnel of the dates of the extraordinary attestation no later than twenty calendar days before its start. 5. The head of a serviceman subject to extraordinary attestation draws up his service record in accordance with Appendix 1 to these Rules and sends it to the appropriate personnel department no later than five working days before the date of the meeting of the attestation commission.

3. The Attestation Commission

6. Attestation commissions are divided into: 1) The Higher Attestation Commission under the President of the Republic of Kazakhstan (hereinafter referred to as the Commission), the position and composition of which are approved by the President of the Republic of Kazakhstan; 2) the Central Attestation Commission of the National Security Committee, which is chaired by the First Deputy Chairman of the National Security Committee. The position and composition of the Central Attestation Commission of the National Security Committee are approved by the Chairman of the National Security Committee; 3) the Attestation Commission of the National Security Committee Border Service, which is chaired by one of the Deputy Directors of the National Security Committee Border Service. The position and composition of the attestation commission of the KNB Border Guard Service are approved by the Deputy Chairman of the KNB, the Director of the Border Guard Service; 4) attestation commissions of the regional departments of the KNB Border Guard Service, chaired by the Deputy Directors of the KNB Border Guard Service. The regulations and the composition of the attestation commissions of the regional departments of the National Security Committee's Border Service are approved by the Deputy Chairman of the National Security Committee, the Director of the Border Service.; 5) attestation commissions of the military units of the Border Guard Service of the National Security Committee, the chairmen of which are determined from among the heads of the main departments, their deputies, heads of departments (independent), deputy heads of regional departments of the Border Guard Service of the National Security Committee. The position and composition of the attestation commissions of the military units of the National Security Committee Border Service are approved by the Deputy Chairman of the National Security Committee, the Director of the Border Service. 7. The attestation commission must include at least seven members, one of whom is the chairman.; a secretary who does not have the right to vote. The members of the attestation commission participate in its work without the right of replacement. 8. The certification commissions include military personnel of the National Security Committee's Border Guard Service, employees and military personnel of National Security Committee units and bodies, as well as, if necessary, representatives of the Armed Forces, law enforcement and other state bodies of the Republic of Kazakhstan who have passed an extraordinary attestation in a higher attestation commission. 9. The Secretary of the attestation Commission organizes its meetings. The secretary of the attestation Commission, with the exception of the Higher Attestation Commission under the President of the Republic of Kazakhstan, is a representative of the personnel department. 10. The members of the attestation commission must hold an equal and/or higher position in relation to the military personnel subject to attestation. 11. Decisions of the attestation commission are made by a simple majority of votes of the total number of members of the attestation commission present at the meeting. In case of equality of votes, the vote of the chairman of the attestation commission is decisive. 12. A meeting of the attestation commission is considered competent if at least two thirds of its members are present.
4. Carrying out the certification
13. Schedules for the stages of the extraordinary attestation of military personnel are approved by the chairmen of the attestation commissions. 14. The determination of professional suitability and the conduct of psychological and sociological research are carried out in accordance with the order of the Chairman of the National Security Committee. 15. At the meeting of the attestation commission, an interview is conducted with the military personnel being certified. Military personnel who were absent from the meeting of the attestation commission for valid reasons undergo an extraordinary attestation upon entering service. Military personnel who have failed to attend a meeting of the attestation commission twice without valid reasons are recommended for dismissal in accordance with the procedure established by the Law of the Republic of Kazakhstan dated February 16, 2012 "On Military Service and the Status of military personnel" (hereinafter referred to as the Law). 16. Based on the results of the interview, the attestation commission makes one of the following decisions: 1) corresponds to the position held and is recommended for nomination to a higher position; 2) corresponds to the position held; 3) does not correspond to the position held and is recommended for demotion; 4) does not correspond to the position held and is recommended for rotation; 5) does not correspond to the position held and is recommended for dismissal. In case of failure to meet the standards for determining professional aptitude and obtaining a test score below the threshold provided for in subparagraph 2) In accordance with paragraph 3 of these Rules, the attestation commission shall take one of the decisions provided for in paragraphs 3), 4) and 5) of this paragraph. 17. The decision of the attestation commission shall be formalized within five working days by a protocol, which shall be signed by the chairman and members of the attestation commission present at its meeting, unless otherwise specified by the Regulations on the Commission. 18. The personnel department submits the decision of the attestation commission to the military personnel's attestation list in accordance with Appendix 2 to these Rules. The certification sheets of military personnel are approved by the chairmen of the certification commissions. The military personnel are familiarized with the certification sheet no later than ten working days from the date of its approval. 19. Military personnel who have not passed an extraordinary attestation and (or) refused to continue military service in the Border Guard Service of the National Security Committee in other, including lower-level positions, are subject to dismissal in accordance with the procedure established by Law.
5. Appeal against the decision of the attestation Commission
20. Decisions of the Commission or the relevant attestation commission may be appealed in accordance with the procedure established by Law.

Personal qualities (sociability, ability to work with staff and citizens, psychological stability, ability to self-improvement, leadership, etc.). 7. The final assessment of the serviceman's service (the opinion of the immediate supervisor about the serviceman is indicated, corresponds to the position he holds or does not correspond, and recommendations for further use of the serviceman or recommendations for improving service and combat activities in the assigned area of work). 8. Other information (results of testing for knowledge of the legislation of the Republic of Kazakhstan, passing standards for combat training, as well as psychological and sociological research).
