On measures to strengthen the national security of the Republic of Kazakhstan and further improve intelligence activities

Decree of the President of the Republic of Kazakhstan dated February 17, 2009 No. 739.

 In order to implement the main provisions of the National Security Strategy of the Republic of Kazakhstan for 2007-2012, strengthen national security and optimize the structure of the special services of the Republic of Kazakhstan in accordance with subparagraph 5) of Article 44 of the Constitution of the Republic of Kazakhstan, subparagraph 3) I HEREBY DECREE paragraph 2 of Article 17-1 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan":

     1. To establish the Foreign Intelligence Service of the Republic of Kazakhstan "Syrbar" (hereinafter referred to as the "Syrbar" Service) as a state body directly subordinate and accountable to the President of the Republic of Kazakhstan, having entrusted her with the functions of an authorized body in the field of foreign intelligence.

     2. To abolish the Barlau Service of the National Security Committee of the Republic of Kazakhstan.

     3. The Syrbar Service:

     1) within one month, submit for approval to the President of the Republic of Kazakhstan a draft Regulation on the Syrbar Service, its structure and total staffing;

     2) within three months, together with the National Security Committee of the Republic of Kazakhstan, to make proposals on bringing the acts of the President of the Republic of Kazakhstan in line with this Decree;

     3) take other measures resulting from this Decree.

     4. To the Government of the Republic of Kazakhstan:

     1) jointly with the National Security Committee of the Republic of Kazakhstan, within two months, in coordination with the Administration of the President of the Republic of Kazakhstan, ensure the transfer of staff, buildings, documentation, financial, logistical and other assets, including a special educational institution for training intelligence personnel, to the Syrbar Service in accordance with the scope of its tasks; and functions;

     2) jointly with interested state bodies, within a three-month period, develop and submit for consideration by the Mazhilis of the Parliament of the Republic of Kazakhstan draft laws of the Republic of Kazakhstan "On Foreign Intelligence" and "On Amendments and additions to certain legislative acts of the Republic of Kazakhstan on national security issues", taking into account the provisions of this Decree;

     3) together with the Syrbar Service, bring Government acts in line with this Decree;

     4) take other measures resulting from this Decree.

     5. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     6. This Decree shall enter into force from the date of signing.
