     To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on State border crossing points, signed in Astana on December 25, 2003.

Agreement between the Government of the Republic of Kazakhstan and the Government of of the Kyrgyz Republic on State border checkpoints (Bulletin of International Treaties of the Republic of Kazakhstan, 2009, No. 5, Article 32) (Entered into force on September 22, 2009)

      The Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic, hereinafter referred to as the Parties,  

      in furtherance of the Treaty of Eternal Friendship between the Republic of Kazakhstan and the Kyrgyz Republic dated April 8, 1997, the Agreement on Cooperation of Border Troops in the Field of Border control at Checkpoints across the Borders of the Member States of the Commonwealth of Independent States with Non-member States dated November 25, 1998 and the Agreement between the Government of the Republic of Belarus, the Government of the Republic of Kazakhstan, by the Government of the Kyrgyz Republic, The Government of the Russian Federation and the Government of the Republic of Tajikistan on mutual visa-free travel of citizens dated November 30, 2000,  

      in order to create favorable conditions for the development of good-neighborly relations, friendship and cooperation between the Republic of Kazakhstan and the Kyrgyz Republic,  

      proceeding from the vital interests of ensuring mutual economic security,  

      Guided by the desire to create conditions for the full development of cooperation and trade based on the principles of equality and mutual benefit, the need to improve the procedure for the passage of persons, goods and vehicles across the Kazakh-Kyrgyz state border in order to identify and suppress illegal migration, smuggling of weapons, ammunition, narcotic drugs, psychotropic and toxic substances and precursors,  

      have agreed on the following:  

Article 1

      For the passage of persons, goods and vehicles across the Kazakh-Kyrgyz state border, the Parties decided to establish multilateral and bilateral checkpoints across the state border (hereinafter referred to as checkpoints) specified in the Annex, which is an integral part of this Agreement.  

      In accordance with the national laws of their States, the Parties may establish separate checkpoints for citizens of the States of the Parties.  

      Multilateral checkpoints carry out the passage of persons, goods and vehicles of the States of the Parties and other States.  

      Bilateral checkpoints carry out the passage of persons, goods and vehicles of the States of the Parties.  

      The procedure for the operation of checkpoints is established by agreement between the border, customs and other interested authorities of the States of the Parties.  

Article 2

      The mode of operation of the checkpoints of the States of the Parties is established in accordance with the Annex to this Agreement.  

      Control over compliance with the regime and operating procedures of checkpoints is established in accordance with the national laws of the States of the Parties, international treaties to which they are parties.  

Article 3

      Border, customs and other types of control of persons, goods and vehicles (hereinafter referred to as control) are carried out at checkpoints in accordance with the national laws of the States of the Parties and international treaties to which they are parties.  

      If necessary, the Parties create conditions for joint control. The order of organization and implementation of joint control will be determined by separate agreements between the border, customs and other interested authorities of the States of the Parties.  

Article 4

      To ensure the proper operation of checkpoints, each of the Parties creates the necessary infrastructure on the territory of its State.  

      If it is possible to carry out joint control at checkpoints, the design and construction of checkpoints are carried out by mutual agreement of the Parties.  

Article 5

      The opening and closing of checkpoints or a change in their status shall be agreed upon by the Parties through diplomatic channels and formalized in separate protocols, which will form integral parts of this Agreement and enter into force in accordance with Article 10 of this Agreement.  

Article 6

      In exceptional cases, the border and customs authorities of the States of the Parties may, by mutual agreement, allow persons, goods and vehicles to pass through the state border outside the existing checkpoints in compliance with the established control procedure, or stop traffic through the checkpoints.  

      The Party that imposes such restrictions or establishes movement outside the checkpoints shall notify the other Party through diplomatic channels no later than 24 hours before the planned time of their introduction, indicating the reasons and duration of their validity.  

      The Parties will inform each other about restrictions or traffic stops at individual checkpoints across the state border in connection with planned repairs (reconstruction) of checkpoints or communication facilities, no later than 30 days before the start of work.  

Article 7

      This Agreement does not affect the rights and obligations of the Parties under other international treaties to which they are parties.  

Article 8

      By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols that are integral parts of the Agreement and enter into force in accordance with the procedure provided for in Article 10 of this Agreement.  

Article 9

      In case of disputes and disagreements on the application and interpretation of the provisions of this Agreement, the Parties will resolve them through negotiations or consultations.  

Article 10

      This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.  

      This Agreement is valid for five years and will be automatically renewed each time for a further five years, unless one of the Parties notifies the other Party of its desire to terminate it no later than 6 months before the expiration of the next five-year period.  

      This Agreement will terminate upon the expiration of six months after one of the Parties receives a corresponding written notification from the other Party.  

      Done in Astana on December 25, 2003, in two originals, each in the Kazakh, Kyrgyz and Russian languages, all texts being equally authentic.  

      For the purposes of interpreting the provisions of this Agreement, the text in Russian is used.
