     To ratify Protocol between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on amendments and Additions to the Protocol between the Republic of Kazakhstan and the Republic of Turkey on the Transfer to the Republic of Kazakhstan of property located in Kemer County, Antalya Province, dated December 13, 1993, made in Ankara on April 16, 2012.

  Protocol between the Government of the Republic of Kazakhstan and the Government of the Republic of Turkey on amendments and additions to Protocol between the Republic of Kazakhstan and the Republic of Turkey on the transfer to the use of the Republic of Kazakhstan of property located in the Kemer district of Antalya Province, dated December 13, 1993

     The Republic of Turkey and the Republic of Kazakhstan, in order to further develop the existing relations, further strengthen friendship and brotherhood, based on the provisions of The Protocol between the Republic of Kazakhstan and the Republic of Turkey on the transfer to the Republic of Kazakhstan of property located in Kemer County, Antalya Province, dated December 13, 1993 (hereinafter referred to as the 1993 Protocol), to determine the principles of use of the land plot, the transfer of which is determined by the 1993 Protocol, agreed as follows:

  Article 1

     Article 1 of the 1993 Protocol shall be worded as follows:

"Article 1

     This Protocol covers the provisions related to the transfer to the use of the Republic of Kazakhstan of a forest plot with a total area of 67256 square meters, located in the village of Beldibi, Kemer county, Antalya province.".

  Article 2

     Article 2 of the 1993 Protocol shall be worded as follows:

"Article 2

     A part of the mentioned land plot, with an area of 22,302 square meters, transferred to the use of the Kazakh side, will be used only for recreational and recreational purposes. Subject to compliance with these objectives, the Republic of Kazakhstan provides the received specified part of the site for use by officials and government agencies of the Republic of Kazakhstan.       The other part of the land plot with an area of 4,4954 square meters can be used until December 31, 2010 without payment, and from January 1, 2011 - for tourist purposes. Since January 1, 2011, the payment of taxes, fees and other mandatory payments related to the use of the specified site for tourist purposes is determined by the laws of the Republic of Turkey and other provisions provided for in the relevant legislation.       The mentioned part of the land plot, with an area of 4,4954 square meters, allocated for use for tourist purposes, may be transferred by the Kazakh side to third parties for use for tourist purposes.       Within the provided territory, construction is carried out within the framework of an approved project, subject to coverage of any costs by the Republic of Kazakhstan and compliance with legislation and other related legislative acts of the Republic of Turkey.       The Kazakh side provides the Turkish side with two land plots for a period of 49 years in Aktau with an area of 7000 square meters and in Almaty with an area of 1,500 - 2,000 square meters for the construction of government buildings due to fees for the use of the site and landscaping, contributions for the development of the social life of forestry workers, erosion control and landscaping, a share of total annual income, as well as taxes, duties and other mandatory fees accumulated over the period from February 16, 2001 to On December 31, 2010, related to the areas transferred for commercial use for tourist purposes.       The distribution procedure must be completed within one year from the date of entry into force of this Protocol.".

  Article 3

     Add the following part to Article 3: Part four:       "At the end of the term, the provision is resumed for the same period.".

  Article 4

     The provisions of the 1993 Protocol, not modified by this Protocol, remain in force.

  Article 5

     Article 6 of the 1993 Protocol shall be worded as follows:

"Article 6

     Buildings located on the leased territory do not have the immunity and inviolability provided for by The Vienna Convention on Diplomatic Relations of April 18, 1961, except in cases of their use for diplomatic purposes.".

  Article 6

     This Protocol is an integral part of the 1993 Protocol and shall enter into force on the date of receipt, through diplomatic channels, of the last written notification by the parties that the internal procedures necessary for its entry into force have been completed.       This Protocol was completed and signed in Ankara on April 16, 2012 in two main copies in Kazakh and Turkish, each of the two texts of which are equally valid.
