On Ratification of the Protocol on Amendments and Additions to the Agreement on the Customs Union Commission of October 6, 2007

     To ratify the Protocol on Amendments and Additions to the Agreement on the Customs Union Commission of October 6, 2007, signed in Moscow on December 9, 2010.

  PROTOCOL on amendments and additions to the Commission Agreement Customs Union dated October 6, 2007

     The Republic of Belarus, the Republic of Kazakhstan and the Russian Federation, hereinafter referred to as the Parties, in accordance with Article 15 of the Agreement on the Customs Union Commission dated October 6, 2007 (hereinafter referred to as the Agreement)       have agreed on the following:

  Article 1

     Add the following paragraph to article 6 of the Agreement:       "In order to ensure the effective functioning of the Customs Union and its bodies, the Commission has the right to establish coordinating and advisory bodies to consider proposals and coordinate the positions of the member States of the Customs Union on certain issues, as well as to prepare appropriate recommendations for the Commission."

  Article 2

     To state article 8 of the Agreement in the following wording:

"Article 8

     The Commission's binding decisions come into force thirty calendar days after the date of their official publication, and in exceptional cases requiring prompt resolution, the Commission's decision may specify a different date for its entry into force, but not earlier than the date of the official publication of such a decision."

  Article 3

     Disputes between the Parties related to the interpretation and (or) application of this Protocol are resolved through consultations and negotiations of the Parties concerned, and in case of failure to reach an agreement, either Party has the right to refer the dispute to the Court of the Eurasian Economic Community.

  Article 4

     This Protocol is subject to ratification and is provisionally applicable from the date of signature.       This Protocol shall enter into force on the date of receipt by the depositary through diplomatic channels of the last written notification on the completion by the Parties of the internal procedures necessary for the entry into force of this Protocol.

     Done in Moscow on December 9, 2010, in one original copy in the Russian language.       The original copy of this Protocol shall be kept at the Customs Union Commission, which, as the depositary of this Protocol, will send each Party a certified copy thereof.

     I hereby certify that this text is a complete and authentic copy of the Decision of the Interstate Council of the EurAsEC (the Supreme Body of the Customs Union) No. 68, signed on December 9, 2010 in Moscow.:       from the Republic of Belarus - by the President of the Republic of Belarus A.G. Lukashenko, from the Republic of Kazakhstan - by the President of the Republic of Kazakhstan N.A. Nazarbayev, from the Russian Federation - by the President of the Russian Federation D.A. Medvedev.       The original copy is kept in the Commission of the Customs Union.

A total of 4 sheets are laced, signed and stamped.
