     To ratify the Protocol on Amendments to the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Bulgaria on Mutual Promotion and Protection of Investments, signed in Sofia on July 24, 2006.

Protocol   on amendments to the Agreement between the Government   Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Bulgaria on mutual Promotion and Protection of Investments

     The Government of the Republic of Kazakhstan and the Government of the Republic of Bulgaria, hereinafter referred to as the "Contracting Parties", have agreed to make the following amendments to the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Bulgaria on Mutual Promotion and Protection of Investments, signed on September 15, 1999 in Sofia, Republic of Bulgaria (hereinafter referred to as the Agreement): 1) paragraph 4 Articles 3 of the Agreement should be worded as follows: "4. The provisions of the regime provided by this Agreement should not apply to all existing or future benefits provided by any Contracting Party by virtue of its membership in a customs, economic or monetary union, common market or free trade area, economic communities or other similar organizations to national investors, investors of the member States of such union, organization, common market or a free trade zone or any other third country. Also, such a regime should not apply to any advantage that any of the Contracting Parties provides to investors of a third state on the basis of a Double taxation Agreement or other agreements on a reciprocal basis related to taxation."; 2) in the first paragraph of paragraph 1 of Article 6, the word "Each" should be replaced by the words "Without prejudice to the measures taken by the European Commission, each ...".         This Protocol is an integral part of the Agreement and shall enter into force on the date of receipt of the last written notification on the completion by the Contracting Parties of the internal procedures necessary for its entry into force.             Done in Sofia on July 24, 2006, in two original copies in the Kazakh, Bulgarian and Russian languages, all texts being equally authentic.         In case of disagreement in the interpretation of the provisions of this Protocol, the Contracting Parties will refer to the text in Russian.
