The note of the Ministry of Foreign Affairs of the Republic of Kazakhstan was deposited on November 9, 2000.          The Government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Russian Federation and the Government of the Republic of Tajikistan, which are participants Agreements on common conditions of transit through the territories of the States - the Parties of the Customs Union dated January 22, 1998, hereinafter referred to as the Parties, based on Article 11 of the Agreement on Common Conditions of Transit through the Territories of the Member States of the Customs Union dated January 22, 1998, taking into account Article 7 of the Agreement on Common Conditions of Transit through the Territories of the Member States of the Customs Union dated January 22, 1998, agreed on as follows:                                   

 

Article 1         The Parties, by mutual agreement, have the right to impose restrictions on the movement of certain categories of goods in transit through the territories of their States, including defining a list of checkpoints through which the movement of such goods is allowed.                                   

 

Article 2          Movement of ethyl alcohol (HS codes of the CIS 2207 10 000, 2207 20 000, 2208 90 910, 2208 90 990) In the cases established by Articles 3 and 4 of the Agreement on Common Conditions of Transit through the Territories of the Member States of the Customs Union of January 22, 1998, only railway transport is allowed through the territories of the States of the Parties.        The import of ethyl alcohol into the territory of the States of the Parties is carried out only by rail or sea transport, including vessels of mixed (river-sea) navigation, through certain checkpoints.        In the absence of direct railway communication between the member States of the Customs Union, the Parties, by mutual agreement on the basis of bilateral or multilateral agreements, may establish rules for the movement of ethyl alcohol that differ from the rules of this Protocol.                                   

 

Article 3         Each of the Parties will submit to the Integration Committee a list of checkpoints through which the movement of ethyl alcohol is allowed. This list is to be published in the Integration Development Bulletin issued by the Integration Committee.                                  

 

 Article 4         The Parties have the right to refuse entry into the territory of their states of ethyl alcohol transported in violation of the conditions established by this Protocol, or to take measures against it, in accordance with their national legislation.                                   

 

Article 5 This Protocol is an integral part of Agreement on Common Conditions of Transit through the Territories of the Member States of the Customs Union dated January 22, 1998.                                   

 

Article 6 This Protocol shall enter into force from the date of its signature, and for States that need to carry out internal procedures, from the date of deposit of the relevant notification with the depositary.                                  

 

 Article 7 This Protocol is valid for one year from the date of its signature and is automatically extended for the next year.        Either Party has the right to withdraw from this Protocol by sending a written notification of its intention to the depositary at least three months before withdrawal, having previously settled its obligations assumed in accordance with this Protocol.

     Done in Moscow on October 26, 1999, in one original copy in the Russian language.       The original copy is kept in The Integration Committee, which will send a certified copy to each Party.

                             Agreement on Common Conditions of Transit through the Territories of the Member States of the Customs Union  

Agreement       

 

The government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Russian Federation, hereinafter referred to as the parties, affirm their adherence to the principles of freedom of transit, taking into account the basics of the customs laws of the Commonwealth of Independent States of February 10, 1995, recognizing the need to facilitate international transportation by all modes of transport by harmonizing and identifying customs procedures without prejudice to the national interests of each state party to this Agreement,      considering that the improvement of transport conditions is one of the most important factors in the development of cooperation, confirming the principles enshrined in the agreements on the customs union of 1995, they agreed on the following:                                  

 Article 1 this agreement uses names determined in accordance with the customs laws of the member states of the Commonwealth of Independent States of February 10, 1995.                                  

Article 2 goods transported through the territory of the states parties to this agreement must: - remain in the same state as a result of natural wear or decline under normal conditions of transportation and storage; - not be used for any purpose other than Transit; - be delivered to the customs authority of delivery, leaving the capabilities of the vehicle, the established route and other conditions of transportation, within the time limits established by the sending customs authority, but not exceeding the maximum period determined by two thousand kilometers per month.                                    

Article 3 Goods, as well as vehicles transporting the goods specified in this article (hereinafter referred to as transit goods): from third states through the territory of one of the other states parties to this agreement to the territory of any state party to this agreement; from the territory of any state party to this agreement through the territory of;        when moving from one state party to this agreement through the territory of one state party to another state party to this agreement to another state party to this Agreement, the transit states party to this Agreement are exempt from paying customs duties, taxes and fees for customs clearance, as well as applying economic policy measures to goods.                                    

Article 4 The customs authorities of the parties have the right to apply measures to ensure compliance with national laws to transit goods transported between States not participating in this Agreement through the territory of even more than one of the States Parties to this Agreement.                                    

 

Article 5 the sale of goods specified in Annex 1 to this agreement through the territory of any party is prohibited.        The goods specified in Annex 2 to this Agreement shall be allowed to transit through the territory of any state party to this agreement on the condition that they have transit permits issued by the authorized bodies of all states parties to this agreement, through which the transportation route passes.        The customs authorities of the parties have the right to apply measures to ensure national customs laws during the transit of goods through the territory of their states.                                    

Article 6 the means and services necessary to ensure transit shall be provided to carriers in cases not less than the means and services provided to their exporters, importers or carriers in the transit states.                                    

Article 7 the passage of transit goods and vehicles transporting them across the borders of the States Parties to the customs union is permitted in places agreed with the competent authorities in the field of transport of the states parties to this Agreement and determined by the customs authorities of these states.        The parties instruct the customs authorities to exchange the list of designated places of crossing the borders of the States Parties to the customs union of transit goods and vehicles transporting them within three months from the date of signing this Agreement.        Transit of goods through the territory of any state party to this Agreement may be carried out by any routes and routes, unless otherwise established by the national laws of this state.                                    

Article 8 transshipment of transit goods to other means of transport, including disassembly of batches, is carried out in places determined in each case by the customs authorities of the states parties to this Agreement.        The customs authorities of the states parties to this agreement mutually recognize the means of distinguishing transit goods, as well as the documents necessary for the control of transit goods and vehicles. The parties instruct the customs authorities of their states to exchange samples of means of distinguishing transit goods, as well as documents necessary for monitoring transit goods and vehicles within a three-month period.                                    

Article 9 in cases of suspension of transit due to the presence of a situation of destructive force, the procedure established by the norms of the national laws of the state party to this agreement in which the transit is suspended shall apply.                                  

 Article 10 the parties instruct their central customs authorities, within three months after signing this agreement, to develop and adopt the following quadratic documents: regulation on the procedure for customs clearance of goods transported under customs control through the territories of the States Parties to the Customs Union; regulation on customs carriers of the Customs Union; regulation on customs accompanying on the territory of the states parties to the Customs Union; Coordination of the work provided for by this article is assigned to the unification committee.                                  

Article 11 The Parties may, by mutual agreement, make additions and amendments to this Agreement, which will be formalized in the form of protocols and annexes that are an integral part of this Agreement.                                    

Article 12 disputes and disagreements in the interpretation and application of this agreement will be resolved through negotiations and consultations between the parties, if necessary, with their consideration by the unification committee, and if an agreement is not reached, by the Council of heads of government under the Interstate Council. To all parties, the decision of the Council of heads of government will be final and binding for application.                                  

Article 3 this agreement is open for accession to it to any state that has joined the agreement on the customs union, which at the time of accession recognizes the effective principles of this Agreement and expresses readiness to comply with them in full.                                  

Article 14 is temporarily valid from the date of signing this Agreement and comes into force from the date of depositary storage of the final statement on the implementation of all necessary statewide procedures by the parties.                                  

 Article 15 any party has the right to withdraw from this agreement by sending a written statement of intent to the depositary at least twelve months before its withdrawal, having previously settled its obligations assumed in accordance with this Agreement.           "22" of January 1998 was made in the city of Moscow in one original copy in Russian.      The original copy is kept by the Merger Committee, which sends a assured copy to each state party to this Agreement.
