To ratify the Protocol on Amendments to the Agreement on Free (Special, Special) Economic Zones in the Customs Territory of the Customs Union and the Customs Procedure of the Free Customs Zone dated June 18, 2010, signed in Moscow on October 19, 2021.

PROTOCOL on Amendments to the Agreement on Free (Special, Special) Economic Zones in the Customs Territory of the Customs Union and the Customs Procedure of the Free Customs Zone dated June 18, 2010
The Member States of the Eurasian Economic Union, hereinafter referred to as the Member States,
based on the Treaty on the Eurasian Economic Union of May 29, 2014,
Taking into account the provisions of the Agreement on the Customs Code of the Eurasian Economic Union dated April 11, 2017,
have agreed on the following:
Article 1
To make the following amendments to the Agreement on Free (Special, special) Economic Zones in the Customs Territory of the Customs Union and the Customs procedure of the Free Customs zone dated June 18, 2010:
1) by text:
Replace the words "Customs Union Commission" in the appropriate case with the words "Eurasian Economic Commission" in the appropriate case, with the exception of the second paragraph of the preamble and the final part.;
replace the words "member State of the Customs Union" in the appropriate number and case with the words "Member State" in the appropriate number and case, with the exception of the preamble;
2) in article 1:
in paragraph 1:
In subparagraph 1, replace the words "territories of a member State of the Customs Union" with the words "territories of a member State of the Eurasian Economic Union (hereinafter, respectively, the member State, the Union)";
In subparagraph 3, the word "(customs)" should be deleted.;
subparagraph 4 after the word "participant" add the word ", subject";
to invalidate paragraph 2;
In paragraph 3, the words "By the Customs Code of the Customs Union, which is an integral part of the Agreement on the Customs Code of the Customs Union of November 27, 2009 (hereinafter referred to as the Customs Code of the Union)" should be replaced by the words "By the Customs Code of the Eurasian Economic Union (hereinafter referred to as the Customs Code of the Union)";
3) in the title of Article 3, replace the words "in the customs territory of the Customs Union" with the words "in the territories of the member States";
4) in article 5:
in the second paragraph, the second sentence should be deleted;
in the third paragraph, replace the word "territories" with the word "territories";
5) in article 6:
Add the word ", subjects" to the name after the word "participants".;
in paragraph 1:
Add the word ", subject" to the first paragraph after the word "participant".;
In the second paragraph, the words "payment of customs duties and taxes" should be replaced by the words "performance of duties of a resident of a port or logistics FEZ, and the amount and procedure for its provision and application may also be established";
in the third paragraph of paragraph 3, the words "periodic publication, including the use of information technology" should be replaced by the words "posting on the official website of the Union";
6) in the first paragraph of paragraph 2 of Article 7, the words "agreement on the implementation (conduct) of activities on the territory of the FEZ (agreement on conditions of activity in the FEZ, investment declaration)" should be replaced by the words "agreement (agreement) on the implementation (conduct) of activities on the territory of the FEZ (agreement on conditions of activity in the FEZ, investment declaration, an entrepreneurial program)";
7) Article 9 should be worded as follows:
"Article 9 The territory of the FEZ and the application of the customs procedure of the free customs zone on it
1. The territory of the FEZ is part of the customs territory of the Union.
2. The borders of the port and logistics FEZ are the customs border of the Union.
3. The territory of the FEZ (all or part of it) on which the customs procedure of the free customs zone is applied is determined in accordance with the legislation of the member state on whose territory this FEZ is established.
4. On the territory of the FEZ where the customs procedure of the free customs zone is applied, foreign goods and goods of the Union may be located (placed) and (or) used, placed (placed) under the customs procedure of the free customs zone in accordance with the Customs Code of the Union, as well as other foreign goods and goods of the Union, with the exception of foreign goods, and (or) goods of the Union, and (or) categories of such goods, which, in accordance with the legislation of the member state on whose territory the FEZ was established, are prohibited from being located (placed) on the territory of the FEZ., where the customs procedure of the free customs zone is applied.
5. The customs procedure of the free customs zone is applied in accordance with the Customs Code of the Union.";
8) to recognize Article 10 as invalid;
9) Articles 25 and 26 should be worded as follows:
"Article 25 Making changes
This Agreement may be amended, which are formalized in separate protocols and are an integral part of this Agreement.
Article 26 Dispute resolution
Disputes related to the interpretation and (or) application of this Agreement are resolved in accordance with the procedure established by the Treaty on the Eurasian Economic Union of May 29, 2014.".
Article 2
This Protocol shall enter into force on the date of receipt by the depositary, through diplomatic channels, of the last written notification on the completion by the Member States of the internal procedures necessary for the entry into force of this Protocol.
Done in Moscow on October 19, 2021, in one original copy in the Russian language.
The original copy of this Protocol shall be kept in the Eurasian Economic Commission, which, as the depositary of this Protocol, will send a certified copy to each Member State.
