To ratify the Protocol on Amendments to the Protocol on the Conditions and Procedure for the Application in Exceptional Cases of Import Customs Duty Rates Other than the Rates of the Single Customs Tariff dated December 12, 2008, concluded in Moscow on August 24, 2012.

PROTOCOL on Amendments to the Protocol on the Conditions and Procedure for the Application in Exceptional Cases of Import Customs Duty Rates Other than the rates of the Single Customs Tariff, dated December 12, 2008
The Government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, have agreed as follows:
Article 1
To make the following amendments to the Protocol on the Conditions and Procedure for the Application in Exceptional Cases of import Customs duty rates other than the rates of the Single Customs Tariff dated December 12, 2008:
1. In Article 2, the words "Commission of the Customs Union" should be replaced by the words "Eurasian Economic Commission", the words "Commission" should be replaced by the words "Council of the Commission".
2. In article 4:
In paragraphs 1 and 2, the word "Commission" should be replaced by the words "Council of the Commission";
In paragraph 3, replace the word "Commission" with the words "Council of the Commission";
Paragraph 4 should be worded as follows:
"4. The period of application of a higher or lower rate by one of the Parties may not exceed six months, unless otherwise established by a relevant decision of the Council of the Commission.".
Article 2
This Protocol is subject to ratification.
This Protocol shall become temporarily applicable after 30 days from the date of signature and shall enter into force from the date of receipt by the depositary of the last written notification on the completion by the States of the Parties of the internal procedures necessary for its entry into force.
Done in Moscow, on August 24, 2012, in one original copy in the Russian language.
The original copy of this Protocol is kept in the Eurasian Economic Commission, which is its depositary.
The Depositary will send to each Party a certified copy of this Protocol.
