To ratify the Protocol on Amendments to the Protocol to the Agreement between the Republic of Kazakhstan and the Russian Federation on the Delimitation of the Bottom of the Northern Part of the Caspian Sea in order to Exercise Sovereign Rights to Subsurface Use dated July 6, 1998, signed in St. Petersburg on January 25, 2006.

protocol on amendments to the Protocol to the Agreement between the Republic of Kazakhstan and the Russian Federation on the Delimitation of the Bottom of the Northern Part The Caspian Sea for the purpose of exercising sovereign rights to subsurface use dated July 6, 1998

The Republic of Kazakhstan and the Russian Federation, hereinafter referred to as the Parties, based on their mutual interest in the joint development of hydrocarbon resources of the geological structures Kurmangazy (Kulalinskaya), Tsentralnaya and Khvalynskoye fields located in the northern part of the Caspian Sea, have agreed as follows: 1. To set out paragraph 3 of Article 6 of the Protocol to the Agreement between the Republic of Kazakhstan and the Russian Federation on the Delimitation of the Bottom of the Northern Part of the Caspian Sea for the Purpose of Exercising Sovereign Rights to Subsurface Use dated July 6, 1998 (hereinafter - Protocol), signed on May 13, 2002, in the following wording: "Enterprises established by authorized organizations of the Parties in accordance with Articles 3, 4 and 5 of this Protocol are granted the right to use the subsurface areas within which the Kurmangazy (Kulalinskaya) and Tsentralnaya structures are located, as well as the depositKhvalynskoye", on the terms of production sharing, without the need to include these sites in the lists of subsurface areas, the right to use which can be granted on the terms of production sharing, and also without holding any tenders or auctions confirming the absence of the possibility of geological exploration, exploration and extraction of minerals in these subsurface areas under other conditions for the use of subsurface resources other than the conditions of production sharing. In relation to these subsurface areas, production sharing agreements are concluded with these enterprises without holding auctions for the right to conclude production sharing agreements." 2. This Protocol shall apply provisionally from the date of signature and shall enter into force on the date of receipt of the last written notification by the Parties of the completion of the internal procedures necessary for its entry into force. This Protocol is an integral part of the Agreement between the Republic of Kazakhstan and the Russian Federation on the Delimitation of the Bottom of the Northern Part of the Caspian Sea for the Purpose of Exercising Sovereign Rights to Subsurface Use dated July 6, 1998. Done in In St. Petersburg on January 25, 2006, in two copies, each in Kazakh and Russian, both texts being equally authentic.
