On Ratification of the Protocol on Amendments to the Treaty on the Eurasian Economic Union of May 29, 2014 regarding pension provision for Officials and employees of the Eurasian Economic Commission and the Court of the Eurasian Economic Union who are citizens of the Russian Federation

To ratify the Protocol on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 regarding pension provision for Officials and Employees of the Eurasian Economic Commission and the Court of the Eurasian Economic Union who are Citizens of the Russian Federation, signed in Moscow on March 24, 2022.

PROTOCOL on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 regarding pension provision for Officials and employees of the Eurasian Economic Commission and the Court of the Eurasian Economic Union who are citizens of the Russian Federation
The member States of the Eurasian Economic Union, hereinafter referred to as the Member States,
guided by article 115 of the Treaty on the Eurasian Economic Union of May 29, 2014,
have agreed on the following:
Article 1
To make the following amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014:
1) add article 1061 to section XXVII as follows:
"Article 1061
Transitional provisions in relation to section XXVIII
The right to a long-service pension remains in accordance with the procedure provided for in paragraph 53 of the Regulation on Social Guarantees, Privileges and Immunities in the Eurasian Economic Union (Annex No. 32 to this Treaty), without taking into account changes in the length of public service experience introduced by the Protocol on Amendments to the Treaty on the Eurasian Economic Union of May 29, 2014. year in terms of pension provision for officials and employees of the Eurasian Economic Commission and the Court of the Eurasian Economic Union who are citizens of the Russian Federation, signed on March 24, 2022 (hereinafter referred to as the Protocol on Amendments):
for persons who have acquired the right to a long-service pension in accordance with paragraph 53 of the Regulation on Social Guarantees, Privileges and Immunities in the Eurasian Economic Union (Annex No. 32 to this Treaty) and have been dismissed from positions held in the Commission or Court of the Union before the date of entry into force of the Protocol on Amendments;
for persons who, as of the date of entry into force of the Protocol on Amendments to positions in the Commission or Court of the Union and who, as of that date, have at least 20 years of state civil service experience for awarding a service pension.;
for persons who, as of the date of entry into force of the Protocol on Amendments, hold positions in the Commission or Court of the Union, who, as of that date, have at least 15 years of state civil service experience for awarding a long-service pension and who, before the date of entry into force of the Protocol on Amendments, acquired the right to an old-age (disability) insurance pension in accordance with with the legislation of the Russian Federation.
To these categories of persons, a long-service pension is awarded in accordance with the conditions and in accordance with the procedure established by the legislation of the Russian Federation for federal government civil servants in force as of December 31, 2016.";
2) the first sentence of the first paragraph of paragraph 53 of the Regulation on Social Guarantees, Privileges and Immunities in the Eurasian Economic Union (Annex No. 32 to the said Treaty) should read as follows: "Officials and employees of the Commission and the Court of the Union who are citizens of the Russian Federation, who held positions in any period prior to working in the Commission and the Court of the Union civil service of the Russian Federation, dismissed from positions held in the Commission or Court of the Union (except in cases of dismissal related to culpable acts), persons who have completed state civil service in the relevant year for the duration established by the legislation of the Russian Federation for awarding a long-service pension to federal state civil servants are entitled to a long-service pension, which is awarded in accordance with the conditions and in accordance with the procedure established by the legislation of the Russian Federation for federal state civil servants, if immediately prior to their dismissal from the Commission or the Courts of the Union, they held positions in them for at least 3 years.".
Article 2
This Protocol shall enter into force on the date of receipt by the depositary, through diplomatic channels, of the last written notification that the Member States have completed the internal procedures necessary for its entry into force.
Done in Moscow on March 24, 2022, in one original copy in the Russian language.
The original copy of this Protocol shall be kept in the Eurasian Economic Commission, which, as the depositary of this Protocol, will send a certified copy to each Member State.
