On signing an Agreement between the Government of the Republic of Kazakhstan and the Government of Montenegro on Economic Cooperation

Resolution of the Government of the Republic of Kazakhstan dated June 16, 2026 No. 508

THE Government of the Republic of Kazakhstan DECIDES:

     1. To approve the attached draft Agreement between the Government of the Republic of Kazakhstan and the Government of Montenegro on economic cooperation.

     2. To authorize Serik Makashevich Zhumangarin, Deputy Prime Minister and Minister of National Economy of the Republic of Kazakhstan, to sign an Agreement on economic cooperation between the Government of the Republic of Kazakhstan and the Government of Montenegro on behalf of the Government of the Republic of Kazakhstan, authorizing amendments and additions that are not fundamental.

     3. This resolution shall enter into force from the date of its signing.

Agreement between the Government of the Republic of Kazakhstan and the Government of Montenegro on Economic Cooperation

     The Government of the Republic of Kazakhstan and the Government of Montenegro, hereinafter referred to as the Parties,

     Desiring to develop long-term relations and to continue strengthening the existing friendly and traditional relations between the States of the Parties,

     in order to develop and strengthen their economic cooperation on a mutually beneficial basis,

     Recognizing that the deepening of the contractual framework creates favorable conditions and a compatible basis for further cooperation,

     within the framework of the current legislation of the States of the Parties and in accordance with the principles of international law,

     have agreed on the following:

Article 1 Purpose

     The objectives of this Agreement are to promote and strengthen bilateral economic cooperation between the Parties on the basis of equality and mutual benefit in accordance with their respective laws and regulations.

Article 2 Areas of cooperation

     The parties are making efforts to develop bilateral economic cooperation, in particular in the following areas::

     Encouraging trade and investment;

     infrastructure;

     energy industry;

     engineering and mechanical engineering;

     electronic industry and telecommunications;

     agriculture and food industry;

     health and social development;

     cooperation between small and medium-sized enterprises;

     tourism;

     Information technology;

     Research and innovation;

     environment;

     the aerospace industry;

     other areas of economic cooperation that may be mutually agreed upon on the basis of this Agreement.

Article 3 Economic cooperation

     The Parties shall make efforts to expand and strengthen their cooperation through the following measures::

     developing ties and strengthening cooperation between the Parties;

     to promote the establishment of new and expansion of existing ties between the business circles of the States of the Parties, encouraging visits, meetings and other interactions between individuals and enterprises;

     exchange of information of mutual interest between business circles, encouragement of participation in fairs and exhibitions, organization of business events, seminars, symposiums and conferences in accordance with the legislation of the states of the Parties;

     promoting more active participation of small and medium-sized enterprises in bilateral economic relations;

     cooperation that will allow for technology transfer, technical assistance, expert training and joint documents;

     encouragement of investment activity, creation of joint ventures, establishment of representative offices of companies and branches.

Article 4The Joint Commission for Economic Cooperation

     The Parties shall establish a Joint Commission on Economic Cooperation (hereinafter referred to as the Commission) to develop and promote economic cooperation between the Parties and monitor the implementation of this Agreement.

     The Commission's activities are carried out in the following areas:

     exchange of views on the development of bilateral economic relations;

     identification of new opportunities for greater development of future economic cooperation;

     proposals to improve the conditions of economic cooperation between institutions and companies of both Sides;

     recommendations for the implementation of this Agreement.

     The Commission consists of representatives of the competent authorities of both Parties.

     Each Party appoints its own co-chairman (hereinafter referred to as the Co-Chairman). Each Co-Chairman appoints a secretary of his part of the Commission.

     Meetings of the Commission are held as necessary, alternately in the Republic of Kazakhstan and Montenegro, at the request of one of the Parties.

Article 5 About the competent authorities

     The competent authorities for the implementation of this Agreement are:

     from the Kazakh Side – the Ministry of National Economy of the Republic of Kazakhstan;

     On the Montenegrin Side, the Ministry of Economic Development of Montenegro.

     In the event of a change in the official name and functions of the above-mentioned competent authorities, the Parties shall immediately inform each other about this through diplomatic channels.

Article 6 Expenses

     The Parties shall independently bear the costs of implementing this Agreement within the limits of the funds provided for by the legislation of the States of the Parties, unless a different procedure is agreed in each specific case.

Article 7 Dispute resolution

     Any disputes concerning the interpretation or application of the provisions of this Agreement shall be resolved through consultations and negotiations between the Parties through diplomatic channels.

Article 8references

     The Parties may amend this Agreement by mutual agreement in the form of separate protocols, which are its integral parts.

Article 9International obligations

     The provisions of this Agreement are without prejudice to the international obligations of the Parties and cannot be interpreted in such a way as to invalidate the rights and obligations arising from Montenegro's future membership in the European Union.

     This Agreement does not affect any rights and obligations arising from other existing agreements concluded by Montenegro or the Republic of Kazakhstan with third parties, as well as the rights and obligations arising from the membership of both countries in regional and international organizations.

Article 10 Final provisions

     This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.

     This Agreement is concluded for a period of 5 (five) years. The validity of this Agreement is automatically extended for subsequent five-year periods, unless either Party notifies the other Party through diplomatic channels at least 6 (six) months before the expiration of the current five-year period of its intention to terminate this Agreement.

     Committed in _______________ " "___________ 20__ in two original copies, each in Kazakh, Russian, Montenegrin and English, all texts being equally authentic. In case of disagreement in the interpretation of this Agreement, the Parties will refer to the English text.
