I DECREE:
1. To approve the attached draft Protocol on Amendments and Additions to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998 in connection with the new status of the Republic of Bulgaria and Romania, which joined the European Union on January 1, 2007.
2. To authorize Serik Nygmetuly Akhmetov, Minister of Transport and Communications of the Republic of Kazakhstan, to sign on behalf of the Republic of Kazakhstan a Protocol on Amendments and Additions to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus Corridor - Asia, dated September 8, 1998, in connection with the new status of the Republic of Bulgaria and Romania, which joined the European Union on January 1, 2007, with the right to make amendments and additions to it that are not fundamental, with the following reservation: "The provisions of paragraph 5 of the Protocol on Amendments and Additions to the Main Multilateral Agreement on International Transport The regulations on the development of the Europe-Caucasus-Asia corridor of September 8, 1998, in connection with the new status of the Republic of Bulgaria and Romania, which joined the European Union on January 1, 2007, do not apply to the Republic of Kazakhstan.".
3. This Decree shall enter into force from the date of signing.

DRAFT Protocol on Amendments and Addenda to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998 in connection with the new status of the Republic of Bulgaria and Romania, which joined the European Union on January 1, 2007
In accordance with Article 11 of the Basic Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998 (hereinafter referred to as the Basic Agreement), taking into account the new status of the two Parties to the Basic Agreement - the Republic of Bulgaria and Romania, which joined the European Union on January 1, 2007, the Parties decided to introduce the following amendments and additions to the Basic Agreement and its technical annexes:
1. From the date of entry into force of this Protocol, the Republic of Bulgaria and Romania will not apply the provisions of paragraphs 2 and 3 of the Protocol on Amendments to the Basic Agreement signed at the third annual meeting of the TRACECA Intergovernmental Commission on October 9-10, 2003.; Article 4 of the Technical Annex to the Basic Agreement on Procedures for International Customs Transit along the Europe-Caucasus-Asia Corridor for the Carriage of Goods by Rail using the SMGS Consignment Note, adopted at the third annual meeting of the TRACECA Intergovernmental Commission on October 9-10, 2003; Article 8 of the Technical Annex to the Basic Agreement on International Road Transport; Technical Annex to the Basic Agreement on International Road Transport. agreement on customs procedures and document processing.
2. From the date of entry into force of this Protocol, the Republic of Bulgaria will not apply the provisions of note 2 to the Technical Annex to the Basic Agreement on International Railway Transport.
3. The Parties agreed to make the following amendments: 1) add paragraph 3 to Article 6 of the Basic Agreement as follows: "These provisions will not apply to the benefits provided by the Republic of Bulgaria and Romania by virtue of their membership in the European Union to the member States of this Union or any third country."; 2) Add paragraph 4 to article 9 of the Technical Annex to the Basic Agreement on International Commercial Shipping, as follows: "These provisions will not apply to the advantages granted by the Republic of Bulgaria and Romania to the member States of the European Union or to any third country that is not a party to the Basic Agreement by virtue of their membership in the European Union."; 3) in paragraph 3 of note 1 of the Technical Annex on International Railway Transport, replace the words "National Company Bulgarian State Railways" with the words "Ministry of Transport of the Republic of Bulgaria".
4. The Parties agreed that the participation of the Parties to the Basic Agreement, which are members of the European Union, in the development of the Europe-Caucasus-Asia transport corridor is limited by the legislation of the European Union.
5. The agreements of the European Union with third parties, namely with the member States of the Basic Agreement, with the exception of the Republic of Bulgaria and Romania, which have been concluded or will be concluded in the future, prevail over the Basic Agreement.
6. The provisions of the Basic Agreement and its technical annexes will not apply between the Parties to the Basic Agreement that are members of the European Union.
7. In the event of amendments and additions to the Main Agreement and/or its technical annexes, the Parties referred to in paragraph 5 of this Protocol reserve the right to express their position on non-participation in each specific case.
8. This Protocol shall enter into force in the manner prescribed by Articles 11 and 13 of the Basic Agreement. Done at the annual meeting of the TRACECA Intergovernmental Commission in the city ......... ...... in one original copy in Russian and English, both texts are equally authentic. In witness whereof, the undersigned Heads of delegation or their plenipotentiaries have signed this Protocol.
