 I DECREE:

     1. Approve the attached documents:

     1) amendments and additions to some decrees of the President of the Republic of Kazakhstan;

Amendments and additions to some decrees of the President of the Republic of Kazakhstan

     1. To the Decree of the President of the Republic of Kazakhstan dated April 1, 1996 No. 2922 "On Approval of the Regulations on the National Security Committee of the Republic of Kazakhstan":

     The Regulation on the National Security Committee of the Republic of Kazakhstan, approved by the above-mentioned Decree, should be amended in accordance with the annex to these amendments and additions.

     2. To the Decree of the President of the Republic of Kazakhstan dated December 10, 1999 No. 282 "Issues of the Border Service of the National Security Committee of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1999, No. 54, Article 533; 2006, No. 1, Article 2):

     in the Regulation on the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, approved by the above-mentioned Decree:

     The second part of paragraph 3 should be worded as follows:

     "Regional administrations of associations, formations and units of the Border Guard Service are legal entities.";

     The second paragraph of subparagraph 7) of paragraph 5 should be worded as follows:

     "methodological guidance of the Academy of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan;";

Regulations on the National Security Committee of the Republic of Kazakhstan

     These Regulations, in accordance with the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan "On Special State Bodies of the Republic of Kazakhstan", "On National Security Bodies of the Republic of Kazakhstan" and other regulatory legal acts of the Republic of Kazakhstan, determine the status, powers and organization of activities of the National Security Committee of the Republic of Kazakhstan.

1. General provisions

     1. The National Security Committee of the Republic of Kazakhstan (hereinafter referred to as the National Security Committee) is a special state body directly subordinate and accountable to the President of the Republic of Kazakhstan.

     The National Security Committee manages, within the limits of its powers, the unified system of national security bodies of the Republic of Kazakhstan (hereinafter referred to as the national security bodies), intelligence, counterintelligence, operational search activities, protection of the State Border of the Republic of Kazakhstan (hereinafter referred to as the State Border), implementation of the tasks of the Special Information Service, as well as interdepartmental coordination in the areas of activity assigned to its competence.

     The National Security Committee has departments, subordinate organizations, territorial and other bodies.

     2. The National Security Committee carries out its activities in accordance with the Constitution, laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan, as well as these Regulations.

     3. The National Security Committee is a legal entity in the organizational and legal form of a state institution, has valid and conditional names, its symbols and insignia, seals and stamps with its name in the state language, letterheads of the established sample, as well as accounts with treasury bodies of the Ministry of Finance of the Republic of Kazakhstan and banks, including currency, in accordance with the legislation of the Republic of Kazakhstan.

     4. The National Security Committee enters into civil law relations in accordance with the legislation of the Republic of Kazakhstan.

     5. The National Security Committee has the right to act as a party to civil law relations on behalf of the state in accordance with the legislation of the Republic of Kazakhstan.

     6. The structure of the National Security Committee is approved by the President of the Republic of Kazakhstan on the proposal of the Chairman of the National Security Committee.

     The full-time number of employees, military personnel and employees of the National Security Committee is established by the Chairman of the National Security Committee within the limit of the full-time number of national security bodies approved by the President of the Republic of Kazakhstan on the proposal of the Chairman of the National Security Committee.

     7. The legal address of the National Security Committee is: 20 Syganak Street, Astana, 010000, Republic of Kazakhstan.

     8. The activities of the National Security Committee are financed from the national budget.

     9. The full name of the National Security Committee is the state institution "National Security Committee of the Republic of Kazakhstan".

     This Regulation is the founding document of the National Security Committee.

2. The main tasks of the National Security Committee

     11. The main tasks of the National Security Committee are:

     1) participation in the development and implementation of state policy in the field of ensuring the security of individuals, society and the state;

     2) obtaining intelligence information in the interests of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan "On Foreign Intelligence";

     3) identification, prevention and suppression of intelligence-subversive and other activities of special services, foreign and international organizations, as well as individuals associated with undermining the economic and defense potential and (or) causing other damage to the security of the Republic of Kazakhstan;

     4) identification, prevention and suppression of terrorist and other activities aimed at forcibly changing the constitutional order, violating the integrity and undermining the security of the Republic of Kazakhstan;

     5) identification, suppression, disclosure and investigation of crimes attributed by law to the jurisdiction of national security agencies;

     6) providing the President of the Republic of Kazakhstan, government agencies, the Armed Forces, other troops and military formations of the Republic of Kazakhstan with government communications in peacetime and wartime;

     7) organization of encryption work in government agencies, organizations, the Armed Forces, other troops and military formations of the Republic of Kazakhstan and their representative offices abroad;

     8) ensuring the protection and protection of the State Border of the Republic of Kazakhstan;

     9) other tasks determined by the laws and acts of the President of the Republic of Kazakhstan.

3. The main functions and rights of the National Security Committee

     12. The National Security Committee, in accordance with the procedure established by the legislation of the Republic of Kazakhstan and within its competence, performs the following functions::

     1) participates in the formation of state policy in the field of national security;

     2) develops, within the framework of state policy, strategic areas of activity, goals, objectives, target indicators and a strategy for the development of the system of national security agencies for the medium and long term;

     3) participates in the development and implementation of state (sectoral) programs to ensure national security;

     4) develops a unified policy of legal, personnel, scientific and methodological, scientific and technical, financial and logistical support for the system of national security agencies to solve assigned tasks and achieve strategic goals;

     5) monitors the achievement of strategic goals, as well as the process of implementing the strategy for the development of the national security system;

     6) form mechanisms in the system of national security agencies for detecting and resolving problems that hinder the achievement of strategic goals;

     7) participates in the preparation of international treaties concluded by the Republic of Kazakhstan, as well as in the development of draft laws and other regulatory legal acts affecting the national security of the Republic of Kazakhstan;

8) establishes, maintains and develops contacts with special services, law enforcement agencies, government and special communications agencies of foreign states, international law enforcement organizations on the basis of international treaties of the Republic of Kazakhstan;

     9) participates in the work of international, interstate and other organizations in accordance with international treaties of the Republic of Kazakhstan, ensures interaction and international cooperation with special services, law enforcement agencies, government and special communications agencies of foreign states, international security structures and law enforcement organizations in areas of activity within the competence of national security agencies;

     10) provides the President of the Republic of Kazakhstan and government agencies with information necessary for decision-making in the field of national security;

     11) organizes and carries out counterintelligence activities to protect the foundations of the constitutional order, the economic and defense potential of the Republic of Kazakhstan from the intelligence and subversive activities of the enemy;

     12) determines the procedure for the implementation of counterintelligence activities by national security agencies, as well as the procedure for the use of secret methods and means in their implementation;

     13) develops and implements measures to counter terrorism and extremism, other activities aimed at forcibly changing the constitutional order, violating the integrity and undermining the security of the Republic of Kazakhstan, carries out interdepartmental coordination of the activities of interested state bodies, ensures interaction and international cooperation in these areas. Participates in conducting anti-terrorist operations, ensuring the legal regime of anti-terrorist operations;

     14) contributes to improving the level of anti-terrorist protection of facilities vulnerable to terrorism by informing their managers about the nature and specifics of terrorist threats, developing recommendations on countering terrorism and anti-terrorist protection, conducting practical exercises and implementing other measures;

     15) monitors the implementation by government agencies of a set of measures to strengthen security systems and readiness to neutralize terrorist threats, as well as the state of anti-terrorist protection of facilities vulnerable to terrorism, and the fulfillment by their managers of the requirements provided for by law.;

     16) organizes and directly carries out operational-investigative and counterintelligence activities, inquiry and preliminary investigation in accordance with the procedure established by law;

     17) provides assistance to state bodies in preventing and suppressing the activities on the territory of the Republic of Kazakhstan of illegal paramilitary formations, political parties and trade unions of other states, parties based on religion, as well as financing of political parties and trade unions by foreign legal entities and citizens, foreign states and international organizations;

     18) provides assistance to special state and law enforcement agencies, the Armed Forces, other troops and military formations of the Republic of Kazakhstan in ensuring public safety, legality, law and order, the country's defense capability, and solving other tasks assigned to them;

     19) participates in the development and implementation of measures to ensure the safety of defense facilities, nuclear energy, transport and communications, life support facilities in the regions and other strategic facilities, the list of which is determined by the Government of the Republic of Kazakhstan;

     20) participates in the development and implementation, with authorized bodies, of measures to localize and neutralize external and internal factors that create conditions for the enemy to conduct intelligence and subversive actions, including in the field of countering transnational criminal communities, illegal migration, illicit trafficking in weapons, ammunition, explosives and toxic substances, narcotic drugs, psychotropic substances, etc. precursors, special technical means and electronic devices designed to secretly obtain information;

     21) organizes and carries out, within its competence, intelligence activities in the interests of the Republic of Kazakhstan;

     22) carries out interaction with state bodies, as well as other organizations, on issues related to the competence of national security agencies;

     23) carries out information and analytical work in order to implement the tasks assigned to the national security agencies;

     24) develops and implements measures for the counterintelligence protection of information constituting state secrets in government agencies and organizations, as well as controls their activities in this area;

     25) implements measures related to conducting a special check of citizens of the Republic of Kazakhstan who are being processed (re-registered) for access to information constituting state secrets, as well as issuing permits to organizations for activities related to the use of information constituting state secrets, the creation of means to protect state secrets, as well as events and (or) the provision of State secrets protection services;

     26) participates, within the limits of its powers, in resolving issues related to admission to and withdrawal from citizenship of the Republic of Kazakhstan, departure of citizens of the Republic of Kazakhstan from its borders and entry of foreign citizens and stateless persons into the Republic of Kazakhstan, their departure from its borders, the regime of their stay in the territory of the state, granting them political asylum in the Republic Kazakhstan, as well as their stay on the territory of Kazakhstan;

     27) carries out activities to counteract technical intelligence;

     28) ensures the detection and suppression of radio emissions from transmitting electronic devices, the operation of which poses a threat to the security of the Republic of Kazakhstan;

     29) organizes encryption work in government agencies, organizations, the Armed Forces, other troops and military formations of the Republic of Kazakhstan;

     30) organizes the operation of government communications;

     31) organizes its own secure communication system for the needs of national security agencies;

     32) organizes centralized accounting, transportation and maintenance of encryption facilities by rail, air, water and road transport in the territory of the Republic of Kazakhstan and abroad in accordance with the legislation of the Republic of Kazakhstan, establishes the procedure for accounting, distribution, transportation, maintenance and handling of encryption facilities;

     33) carries out licensing of types of activities in accordance with the legislation of the Republic of Kazakhstan;

     34) exercises control over the turnover of special technical means designed (developed, adapted, programmed) for the secret receipt of information in the course of operational investigative activities;

     35) organizes the certification of technical, including cryptographic, means of protecting information that constitutes state secrets;

     36) participates in carrying out activities aimed at ensuring the security of foreign institutions of the Republic of Kazakhstan and their staff, as well as citizens of the Republic of Kazakhstan abroad;

     37) takes measures in cooperation with other competent authorities to ensure the security of representative offices of foreign States and international organizations in the territory of the Republic of Kazakhstan;

     38) participates, on the instructions of the President of the Republic of Kazakhstan, together with other government agencies, in ensuring the security of heads of state, governments of foreign countries and heads of international organizations during their stay in the Republic of Kazakhstan, as well as important socio-political events held in the country.;

     39) organizes and conducts mandatory special inspection of citizens of the Republic of Kazakhstan who enter and serve in the civil service, in accordance with the procedure and limits established by the legislation of the Republic of Kazakhstan;

     40) implements measures to ensure its own security, including preventing technical penetration of information from national security agencies that constitute state secrets;

     41) implements measures to encrypt employees and military personnel of national security agencies, departmental affiliation of institutions, premises and vehicles;

     42) organizes and ensures the protection of employees, military personnel and employees of national security agencies, as well as confidential assistants of national security agencies;

     43) ensures the safety of persons subject to state protection in accordance with the legislation of the Republic of Kazakhstan on state protection of persons involved in criminal proceedings;

     44) provides mobilization training and mobilization of national security agencies, as well as civil defense measures;

     45) organizes fundamental and applied scientific research in the field of theory and practice of ensuring national security, as well as on topical issues of operational and official activities of national security agencies;

     46) establishes the procedure and organizes the training, retraining and advanced training of personnel for national security agencies;

     47) provides guidance, coordination and ensures consistency of actions of the bodies that are part of the unified system of national security agencies, determines the tactics of their activities, provides them with practical and methodological assistance.;

48) organizes combat, technical, material, financial, scientific, informational, legal, social, military medical (medical) and other types of support for national security agencies, including meals for employees, military personnel and employees, capital construction and reconstruction, repair of buildings and structures, housing and barracks housing construction, renovation;

     49) organizes and carries out departmental control over operational-service, combat, operational-investigative, financial, economic and military-medical activities of departments of the National Security Committee and other bodies included in the unified system of national security agencies;

     50) carries out, within the competence of the national security authorities, the reception and consideration of appeals from individuals and legal entities;

     51) establishes the procedure for documentation and documentation management, organization and record keeping, organization of archival work in national security agencies, creates and uses information systems for these purposes;

     52) organizes decryption work in the system of national security agencies;

     53) determines the procedure for conducting polygraphic and psychophysiological examinations by national security agencies, and the requirements for compliance with the state of health of persons serving in national security agencies.;

     54) conducts a military medical examination, including a psychophysiological examination, to establish the fitness for health reasons to serve in the national security agencies, to determine the causal relationship of diseases, injuries (wounds, injuries, contusions) and death of citizens in connection with the passage (performance of duties) of their service in the national security agencies, and as well as polygraph, psychological and sociological research and drug testing;

     55) organizes and ensures, in accordance with the legislation, the detention of detainees, suspects, accused of committing a crime in temporary detention facilities, pre-trial detention facilities, and guardhouses of national security agencies, establishes the procedure for their functioning and the implementation of operational investigative activities in them, as well as the procedure for the protection and supervision of persons in pre-trial detention facilities national security agencies;

     56) considers cases of administrative offenses and imposes administrative penalties in accordance with the procedure established by the Code of the Republic of Kazakhstan on Administrative Offenses;

     57) ensures the protection of the interests of the individual, society and the state at the State Border in the general system of ensuring the security of the state;

     58) organizes the development and implementation of measures to prevent and suppress illegal changes of the State Border on the ground, maintain the regime of the State Border, as well as comply with the border regime and the regime at checkpoints across the State Border;

     59) participates in the activities of international organizations on issues related to the protection and protection of the State Border, in the implementation of a set of measures for the international legal registration of the State Border, in international negotiations on the organization of interaction with the border agencies of foreign states;

     60) ensures law and order in the divisions, bodies and departments of the National Security Committee;

     61) organizes and carries out work on the development and expansion of the sphere of use of the state language in the national security agencies;

     62) organizes research and development work in the field of the development of special communications, information systems, weapons and equipment, including special technical and other means;

     63) interacts with the on-duty services of the state bodies concerned in order to receive timely information about events and facts affecting the interests of national security.;

     64) ensures the functioning of the official Internet resource of the National Security Committee and its participation in the "electronic government" of the Republic of Kazakhstan, organizes and coordinates the activities of national security agencies to fill the official Internet resource of the National Security Committee with information materials;

     65) performs other functions assigned to its jurisdiction by laws and acts of the President of the Republic of Kazakhstan.

     13. The National Security Committee has the right to perform its assigned tasks and functions in accordance with the procedure established by law.:

     1) to carry out general and special operational-search and counterintelligence activities, forensic, psychological, sociological and polygraphic studies in order to identify, prevent, suppress and disclose crimes, the investigation of which is attributed by law to the jurisdiction of national security agencies;

     2) infiltrate special services and organizations of foreign states, criminal groups whose goals and actions are aimed at undermining the security of the state, violating the territorial integrity of the Republic of Kazakhstan, and forcibly changing the constitutional order;

     3) to interact with the subjects of the foreign intelligence service of the Republic of Kazakhstan in the conduct of intelligence activities, including the use of electronic and special technical means;

     4) resolve, jointly with authorized state bodies, issues related to the closure of entry and expulsion from the Republic of Kazakhstan of foreign citizens and stateless persons who, by their actions, pose a threat or damage the security of society and the state;

     5) when detecting, suppressing, uncovering and investigating crimes attributed by law to the jurisdiction of national security agencies, give binding instructions to other bodies within the limits provided for by criminal procedure legislation.;

     6) summon citizens to the national security agencies based on materials in production, receive explanations, certificates, documents from them and make copies of them; bring in persons who evade appearing on a call;

     7) in accordance with the legislation, to verify the identity documents of citizens upon reasonable suspicion of committing crimes. To detain persons suspected of committing crimes, carry out document checks, personal searches of detainees and their vehicles, as well as the seizure of their belongings and documents;

     8) when participating in an anti-terrorist operation and ensuring the legal regime of an anti-terrorist operation, apply the measures and time restrictions provided for by the Law of the Republic of Kazakhstan "On Countering Terrorism";

     9) use means of communication, vehicles belonging to the Armed Forces, other troops and military formations, as well as other organizations, to prevent crimes, prosecute and detain persons who have committed or are suspected of committing crimes, deliver detained persons to their place of detention, as well as to travel to the scene and deliver those in urgent need medical care of citizens in medical institutions. At the request of owners of communication facilities and vehicles, the bodies of the National Security Committee shall compensate for the actual damage caused as a result in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;

     10) involve citizens of the Republic of Kazakhstan on a voluntary basis as freelance operational staff in accordance with the procedure established by the Chairman of the National Security Committee;

     11) submit mandatory submissions to state bodies and organizations on the elimination of causes and conditions that contribute to the implementation of threats to the security of the Republic of Kazakhstan, the commission of crimes, the investigation of which is attributed by the legislation of the Republic of Kazakhstan to the jurisdiction of national security agencies;

     12) to carry out administrative detention of persons who have committed offenses related to attempts to enter and enter specially protected territories of special-regime and other facilities. To check their identity documents, receive explanations from them, carry out their personal search, inspection and seizure of belongings and documents;

     13) use, on a contractual basis, office premises, transport and other technical facilities of the Armed Forces, other troops, military formations and other organizations, as well as residential and other premises, vehicles and other property of individuals and legal entities;

     14) have temporary detention facilities, pre-trial detention facilities, and guardhouses for holding persons in respect of whom arrest or detention by national security agencies on suspicion of committing crimes, as well as administrative detainees and administrative detainees, has been chosen as a preventive measure in accordance with the procedure established by the legislation of the Republic of Kazakhstan. In some cases, in coordination with the national security authorities, detained by law enforcement agencies, as well as convicted;

     15) have medical institutions and units for organizing military medical support and conducting military medical examination in accordance with the procedure established by law;

     16) conclude cooperation agreements with special services, law enforcement agencies, government and special communications agencies of foreign states, international law enforcement organizations on the basis of international treaties of the Republic of Kazakhstan;

17) conclude contracts, agreements with organizations, and issue joint orders with government agencies of the Republic of Kazakhstan necessary to fulfill the tasks and functions assigned to the National Security Committee.;

     18) to monitor, provide methodological and practical assistance in matters of ensuring the safety of state secrets, commercial, banking and other legally protected secrets, the security of special-purpose telecommunications networks, the activities of the encryption service in government agencies, the Armed Forces, other troops and military formations, as well as in other organizations. Suspend, in accordance with the established procedure, the work of encrypted communications network units until the identified violations are eliminated, as well as the activities of any networks and means of communication in case they are used for criminal purposes that harm the interests of individuals, society and the state.;

     19) to prevent the use of transmitting radio-electronic devices on the territory of the Republic of Kazakhstan, used in violation of the established rules or legislation of the Republic of Kazakhstan on the protection of state secrets;

     20) receive, free of charge and in compliance with the requirements established by legislative acts of the Republic of Kazakhstan for the disclosure of information constituting commercial, banking and other legally protected secrets from government agencies, the Armed Forces, other troops, military formations and organizations, information necessary to perform tasks assigned to national security agencies;

     21) to send employees, military personnel and employees of the National Security Committee, including outside the Republic of Kazakhstan;

     22) to store and use archival operational, investigative and other materials related to the activities of national security agencies;

     23) to conduct scientific research on the problems of ensuring the security of the Republic of Kazakhstan, to cooperate with scientific research institutions, educational institutions and organizations of the Republic of Kazakhstan and foreign countries on the basis of international agreements;

     24) to develop, create, acquire and use special communications, information systems, weapons and equipment, including special technical and other means. To this end, organize and conduct research and development work, conclude agreements, contracts with bodies and organizations of the Republic of Kazakhstan, special services and organizations of foreign states;

     25) to organize training, retraining and advanced training of personnel for state bodies of the Republic of Kazakhstan, as well as special and other bodies of foreign states in accordance with international treaties;

     26) to allow individuals and legal entities to work on the maintenance of facilities of the National Security Committee after conducting a study and verification;

     27) to check the identity documents of individuals at the entrance (entrance) to the facilities and premises of the National Security Committee and at the exit (exit) from them, to inspect their belongings (with the exception of protected persons);

     28) to carry out control, organize inspections of the state of work to ensure the secrecy regime, the safety of state secrets, the organization and management of office work in the national security agencies;

     29) in order to encrypt the identity of employees and military personnel of national security agencies, the departmental affiliation of their units, premises and vehicles, use documents of other government agencies and organizations, the procedure for manufacturing and (or) registration of which is determined by joint regulatory legal acts.;

     32) perform other functions stipulated by the laws and acts of the President of the Republic of Kazakhstan.

4. Organization of the activities of the National Security Committee

     14. The National Security Committee is headed by the Chairman of the National Security Committee, who is appointed by the President of the Republic of Kazakhstan with the consent of the Senate of the Parliament of the Republic of Kazakhstan and dismissed by the President of the Republic of Kazakhstan.

     15. The Chairman of the National Security Committee has deputies, including one first. The Deputy Chairmen and heads of departments of the National Security Committee, upon the proposal of the Chairman, are appointed and dismissed by the President of the Republic of Kazakhstan in coordination with the Head of the Presidential Administration of the Republic of Kazakhstan.

     16. Chairman of the National Security Committee:

     1) organizes the work of the Committee, manages the activities of the national security agencies and is personally responsible for the fulfillment of the tasks assigned to them;

     2) submits proposals to the President of the Republic of Kazakhstan on the structure of the National Security Committee, the formation, abolition and reorganization of departments and territorial bodies of the National Security Committee, as well as state institutions subordinate to the National Security Committee;

     3) approves the structure and staff of structural divisions, departments, and territorial bodies of the National Security Committee, as well as state institutions subordinate to the National Security Committee, approves the regulations (charters) on them, with the exception of departments whose regulations are approved by the President of the Republic of Kazakhstan on the proposal of the Chairman of the National Security Committee;

     4) within the limits of its competence, issues normative legal acts regulating the activities of national security bodies, repeals legal acts that contradict the norms of the Constitution and legislation of the Republic of Kazakhstan, adopted by officials subordinate to it.;

     5) makes proposals to the President and the Government of the Republic of Kazakhstan on issues of ensuring national security, organizational, staff, personnel, military-medical and logistical support of national security bodies;

     6) represents the National Security Committee in relations with government agencies of the Republic of Kazakhstan, as well as special services, government and special communications agencies of foreign states and international organizations;

     7) in accordance with the Law of the Republic of Kazakhstan "On Countering Terrorism", he is the head of the republican operational headquarters for conducting anti-terrorist operations to prevent an act of terrorism, while from the beginning of the anti-terrorist operation until its completion, he becomes its head and chief for all military personnel, employees and specialists of government agencies of the Republic of Kazakhstan involved in its conduct;

     8) sends official representatives of the National Security Committee to foreign institutions of the Republic of Kazakhstan in coordination with special services, law enforcement agencies, government and special communications agencies of other states, as well as with the Ministry of Foreign Affairs of the Republic of Kazakhstan in order to increase the effectiveness of combating crimes of an international nature, as well as to organize interaction on issues defined by international treaties of the Republic of Kazakhstan;

     9) determines the powers of the Deputy Chairmen, heads and officials of departments, structural divisions, territorial bodies and subordinate organizations of the National Security Committee in resolving organizational, personnel, staff, financial, production, economic and other issues;

     10) appoints and dismisses the heads of structural divisions of the National Security Committee, departments of the Committee on Regions, cities of republican significance and the capital of the Republic and other bodies of the National Security Committee in accordance with the procedure determined by the President of the Republic of Kazakhstan, and also establishes the procedure for appointing and dismissing certain officials of national security bodies;

     11) approves the nomenclature of positions of the National Security Committee, the list of positions filled by officers and military personnel of the rank and file and soldiers (sailors), sergeants (sergeants), officers of junior and senior staff, employees, and also determines the number of officers of the active reserve;

     12) confers the first special or military rank of an officer and the rank of "colonel" ("captain of the first rank"), and as a reward - an extraordinary special or military rank ahead of schedule and one step higher than the special or military rank provided for by the military position held, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     13) determines the procedure for enlisting employees and military personnel in the active reserve of national security agencies and their service, as well as decides on the replacement of positions in government agencies and organizations by officers of the active reserve of national security agencies in coordination with their leadership.;

     14) centralizes and distributes the financial resources provided for the maintenance of national security agencies within the approved funding plans;

     15) approves the list of information to be classified in the national security agencies;

     16) approves the list of facilities vulnerable to terrorism;

     17) encourages and disciplines employees, military personnel, and employees of the National Security Committee and its subordinate bodies.;

18) submits proposals to the President of the Republic of Kazakhstan on awarding higher special and military ranks and awarding employees, military personnel and employees of national security agencies with state awards, as well as on awarding honorary titles;

     19) awards departmental awards to employees, military personnel and employees of national security agencies;

     20) determines the procedure and conditions for awarding bonuses, providing financial assistance and establishing allowances for official salaries of employees, military personnel, and employees by saving funds provided for maintenance under the budget program (subprogram) financing plan in accordance with the procedure established by the Government of the Republic of Kazakhstan.;

     21) approves the description of the service certificates of employees, military personnel, employees and pension certificates of recipients of pension payments from among employees and military personnel of national security agencies, and also determines the procedure for their issuance and use;

     22) approves the Regulations on the Military Council of the Border Guard Service of the National Security Committee, its size and composition;

     23) approves the lists of atypical positions of employees and military personnel of the national security agencies, equivalent to the positions indicated in the registers, established by the legislation of the Republic of Kazakhstan.;

     24) determines the procedure and conditions for calculating the length of service for employees and military personnel of national security agencies in order to establish coefficients in determining official salaries;

     25) determines the procedure and conditions for enlisting in the length of service of certain categories of employees and military personnel of the national security agencies of their work experience before enlisting in special state bodies or military service for calculating official salaries and assigning pension payments;

     26) approves lists of atypical positions of officers and their corresponding marginal special or military ranks;

     27) enlists candidates, conscripts with higher or secondary specialized education, and those liable for military service in the reserve for service or military service in the national security bodies, removes them from the general military register, appoints, dismisses and dismisses them from service or military service, assigns special and military ranks and moves them to positions in accordance with the procedure established by law. established by the legislation of the Republic of Kazakhstan;

     28) determines the List of officials who have the right to issue orders on the conclusion of a contract, appointment, transfer, release, dismissal of employees, military personnel and those liable for military service, as well as awarding them a special or military rank;

     29) determines the Procedure for assigning, upgrading, reducing and removing class qualifications to employees and military personnel of national security agencies;

     30) determines the procedure for the implementation of measures for the organization and conduct of certification of employees, military personnel and employees of national security agencies;

     31) seconds employees and military personnel of national security agencies to state bodies, as well as other organizations with the consent of their heads in accordance with the established procedure, while remaining in service in special state bodies and military service. Employees and military personnel of national security agencies may be seconded to international organizations on the basis of international treaties of the Republic of Kazakhstan.;

     32) carries out access to the state secrets of the Republic

     Kazakhstan in the scope of training programs at training, retraining and advanced training courses for national security agencies, as well as in the scope of training programs at training, retraining and advanced training courses for special and other bodies of foreign states in accordance with international treaties, as well as government agencies of the Republic of Kazakhstan;

     33) organizes the activities of the duty service of the National Security Committee, ensures its interaction with the duty services of departments, territorial and other bodies of the National Security Committee;

     34) approves the Rules for the Organization of Scientific research activities in the national security agencies;

     35) approves the Regulations of the National Security Committee;

     36) approves the Rules for the Organization of International Cooperation of the National Security Committee;

     37) approves the Rules for conducting analytical Research in the national security agencies;

     38) approves the Rules for informing State institutions by national security agencies;

     39) approves the Instructions on secret and unclassified office work in the national security agencies;

     40) approves the Rules for the organization and functioning of the electronic document management system in the national security agencies;

     41) approves the Model Regulation on the division of Secret and Unclassified Records Management in the national security agencies;

     42) Approves the Regulations on the permanent commission of the National Security Committee for the Protection of State Secrets;

     43) approves the Rules for the use of seals, stamps and forms of strict accountability in the system of national security agencies;

     44) approves the Regulations on the Commission for the Control of Accounting and Registration Discipline in the national Security Agencies;

     45) approves the Instructions for the organization of round-the-clock duty in the national security agencies;

     46) approves the Rules for ensuring access and on-site security at facilities of national security agencies;

     47) approves the Rules and procedures for the information and propaganda work of national security agencies;

     48) approves the Rules for the provision of medical care in the medical units of the national security agencies;

     49) approves the composition and Regulations on military medical commissions of national security agencies;

     50) approves the Instruction on the procedure for providing sanatorium-resort treatment to employees, military personnel and pensioners of national security agencies;

     51) approves the Rules of diving, airborne and high-altitude training;

     52) Approves samples of badges of employees and military personnel of national security agencies and the procedure for their issuance and use, as well as the description and form of the internal distinctive details (additional chevrons, emblems and unified coloring of special vehicles) of individual units of the National Security Committee;

     53) determines the procedure and conditions for crediting seniority on preferential terms for awarding pensions to employees and military personnel of the service:

     in flight work in aviation, including jet and turboprop aviation;

     in the positions of divers who perform work in conditions of prolonged stay under water or pressure chambers;

     in positions where the performance of duties is associated with systematic skydiving;

     in special forces units;

     at outposts, posts, commandant's offices, offices of checkpoints, maneuver groups with shifts, on ships and boats serving on the protection of the State Border, and in other units of the border troops;

     in high-altitude areas at an altitude of 1000 meters to 1500 meters above sea level, and in exceptional cases below;

     in formations, military units and subunits that performed tasks to protect public order and ensure state security in emergency situations related to mass antisocial manifestations;

     related to the performance of tasks by employees and military personnel in special services and organizations of foreign countries, as well as in criminal groups;

     operational personnel who are directly on duty, as well as those serving in special forces units;

     54) approves the Rules for the Organization of Technical Operation of special-purpose telecommunications networks in national security agencies, as well as the Rules for their Construction;

     55) approves the Instructions on the appointment of retirement benefits for employees and military personnel, one-time funeral payments and benefits to the family of a deceased pensioner of the national security agencies;

     56) approves the Instructions on official business trips of employees, military personnel and employees of the National Security Committee;

     57) approves the Rules for registration of military transportations and payments for them in the national security agencies;

     58) approves the Rules for providing monetary allowances to employees and military personnel of national security agencies;

     59) approves the Instruction on remuneration of employees who are not employees or military personnel of state institutions of national security bodies;

     60) form a permanent departmental budget commission, approve the regulations on it, determine its composition;

     61) approves the procedure for the creation and implementation of a unified automated financial and accounting system in the national security agencies;

     17. In the absence of the Chairman of the National Security Committee, his duties are performed by the First Deputy or one of the deputies on behalf of the Chairman.

     18. A board is formed in the National Security Committee to ensure coordination of the activities of national security agencies, consider the most important issues of operational and personnel management, and make coordinated decisions on them.

     The board consists of the Chairman of the National Security Committee (Chairman of the Board), the First Deputy and Deputy Chairmen (ex officio), heads of departments and structural divisions by decision of the Chairman of the National Security Committee.

     The tasks, powers and procedures of the board are regulated by the Regulations approved by the Chairman of the National Security Committee.

     19. To develop a unified policy of scientific and technical support for the system of national security agencies, an advisory body is being created - the Scientific and Technical Council of the National Security Committee. The tasks, composition, powers and procedure of the Scientific and Technical Council are regulated by the Regulations approved by the Chairman of the National Security Committee.

     20. The facilities of the National Security Committee are classified as high-security or special-regime facilities in the Republic of Kazakhstan.

5. Property of the National Security Committee

     21. The National Security Committee has a separate property on the right of operational management.

     The property of the National Security Committee is formed at the expense of property transferred to it by the state, and consists of fixed assets and working capital, as well as other property, the value of which is reflected in the balance sheet.

     22. The property assigned to the National Security Committee belongs to republican ownership.

6. Reorganization and liquidation of the National Security Committee

     23. The reorganization and liquidation of the National Security Committee are carried out in accordance with the legislation of the Republic of Kazakhstan.
