On the Approval of the Rules for the Use of Restricted-Access Areas and Adjacent Territories
Resolution No. 166 of the Government of the Republic of Kazakhstan dated March 12, 2026
In accordance with paragraph 2 of Article 89 of the Construction Code of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan RESOLVES:
1. To approve the attached Rules for the Use of Restricted-Access Areas and Adjacent Territories.
2. To declare certain decisions of the Government of the Republic of Kazakhstan invalid, in accordance with the annex to this resolution.
3. This resolution shall come into force on July 1, 2026, and shall be subject to official publication.

Rules for the Use of Zones of Restricted Territories and Adjacent Areas
Chapter 1. General Provisions
1. These Rules for the Use of Restricted‑Access Areas and Adjacent Territories (hereinafter referred to as the Rules) have been developed in accordance with paragraph 2 of Article 89 of the Construction Code of the Republic of Kazakhstan, state regulatory documents, and define the procedure for the use of restricted‑access areas and adjacent territories.
2. The following terms are used in these Rules:
1) protected facilities – buildings, structures and facilities intended for the stay of protected persons, other buildings, structures and facilities protected by the State Security Service of the Republic of Kazakhstan, as well as the adjacent territory and water area;
2) defense facilities – real estate assigned on the right of operational management to state institutions of the Armed Forces, other troops and military formations;
3) important facilities subject to state protection – facilities protected by the internal affairs bodies and the National Guard.
4) zones of restricted areas – areas within populated areas designated for the placement of military and other facilities, for which a special regime is established;
5) areas adjacent to zones of restricted areas – areas directly adjacent to the boundaries of zones of restricted areas in accordance with the requirements of these Rules.
3. The requirements of these Rules apply to all entities engaged in architectural, urban planning, and construction activities within the boundaries of restricted areas and adjacent territories established in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning, and construction activities.
Chapter 2. Procedure for the use of restricted areas and adjacent territories
4. The zones of restricted territories and adjacent areas include territories within populated areas designated for the placement of military and other facilities for which the legislation establishes a special regime and procedure for their use; the boundaries of these zones include sanitary protection areas (zones) around special‑purpose facilities that may pose a threat to the safety of living and the health of the population.
5. The zones of restricted territories are territorial objects subject to special regulation and urban planning regulation for the placement of defense facilities, protected facilities, and important facilities subject to state protection.
6. The restricted‑use zones intended for the placement of protected facilities in populated areas are the areas bounded by a perimeter at a distance of 100 (one hundred) meters, and outside populated areas — 1 (one) kilometer from the external boundaries of the territory.
7. The standards for distance, height, and number of storeys in the construction of new facilities located in areas adjacent to restricted‑use zones are defined in state regulatory documents.
8. When designing and constructing construction facilities located in the adjacent zone of sensitive areas (facilities) protected by the State Security Service of the Republic of Kazakhstan, the following parameters must be observed:
within a radius of 500 meters – height not exceeding 7 meters;
within a radius of 1000 meters – height not exceeding 16 meters;
within a radius of 1500 meters – height not exceeding 28 meters.
9. The use of restricted‑use zones and adjacent territories, as well as the construction and operation of construction facilities located in restricted‑use zones, shall be carried out in accordance with approved urban planning projects (master plans and detailed layout projects) in compliance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.
