On the approval of the rules governing the maintenance of the portal and digital systems for the organization of construction on the principle of "one window"

In accordance with subparagraph 51) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:
1. To approve the Rules defining the procedure for maintaining the portal and digital systems for the organization of construction on the principle of "one window" in accordance with the annex to this order.
2. Invalidate them:
1) Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated September 11, 2020 No. 465 "On approval of the Rules governing the maintenance of the portal and information systems for the organization of construction on the principle of "one window" (registered in the Register of State Registration of Regulatory Legal Acts No. 21224);
2) item 3 of the List of certain orders, which are amended and supplemented by the Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated December 30, 2022 No. 762 "On Amendments and additions to certain orders" (registered in the Register of State Registration of Regulatory Legal Acts No. 31542).
3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:
1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan.
4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.
5. This order will enter into force on July 1, 2026 and is subject to official publication.

The rules defining the procedure for maintaining the portal and digital systems for the organization of construction on the principle of "one window"
Chapter 1. General provisions
1. These Rules, which define the procedure for maintaining the portal and digital systems for organizing construction on the "one–stop shop" principle (hereinafter referred to as the Rules), have been developed in accordance with subparagraph 51) of Article 24 of the Construction Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and define the procedure for maintaining the portal and digital systems for organizing construction on the "one–stop shop" principle.one window."
2. The following concepts are used in these Rules:
1) the portal for the organization of construction on the principle of "one window" (hereinafter referred to as the Portal) is a centralized digital system that provides the collection, storage and processing of information arising during construction activities;
2) a digital system for organizing construction on the "one–stop shop" principle (hereinafter referred to as the CA) is a digital system integrated with the Portal, designed to automate operations related to the maintenance of construction documentation and control of facilities under construction in electronic form;
3) personal account is a component of the portal for organizing construction on the principle of "one window" and (or) a digital system, which allows the user of the portal for organizing construction on the principle of "one window" and (or) a digital system to upload information, access data on the state and statistical information of construction;
4) the Portal Operator is a legal entity that maintains the Portal;
5) the Portal User (hereinafter referred to as the User) is an individual or legal entity registered on the Portal, using its resources and components.;
6) the digital system operator (hereinafter referred to as the CA operator) is an individual or legal entity that maintains a digital system for organizing construction based on the "one window" principle, integrated with a portal for organizing construction based on the "one window" principle;
7) a digital document is an intangible digital representation of reliable information generated in a digital environment based on data contained in national registers at the time of request or presentation;
8) electronic document – an electronic document certified by means of an electronic digital signature of a person authorized to sign it.
Other concepts and terms used in these Rules are determined in accordance with the legislation of the Republic of Kazakhstan.
Chapter 2. The procedure for maintaining the portal for the organization of construction on the principle of "one window"
3. In order to automate procedures and operations related to construction, the Portal provides:
1) User Registration;
2) downloading and storing electronic and digital documents;
3) providing access to Users of information, electronic and digital documents in the organization of construction production during the construction of new, as well as reconstruction and repair of existing facilities (enterprises, buildings, structures and their complexes) of all sectors of the economy;
4) transfer of information about construction processes to the User, as well as their further storage;
5) information exchange with integrated Internet resources and CA.
4. To register on the Portal, the User, through the internal electronic document management system, sends a request to the department of the authorized body for Architecture, Urban Planning and Construction about the need to create accounts on the Portal and assign appropriate roles according to the functional responsibilities of the employee.
In the request, the User specifies a list of employees who need to be granted access to the Portal, indicating: last name, first name, patronymic (if any), individual identification number, position, and required role in the Portal.
The Department of the authorized body for Architecture, Urban Planning and Construction confirms or refuses the User's registration on the Portal within 5 (five) business days from the moment of receipt of the request.
5. The grounds for refusal to register on the Portal are false information specified in paragraph 4 of these Rules, as well as the presence of the User who applied in the list of previously registered Users of the Portal.
6. Confirmation of registration on the Portal is the creation of a User account and the assignment of the appropriate role according to the functional responsibilities of the employee.
7. To activate access, the employee independently logs into the Portal using an electronic digital signature (EDS).
8. After successful authentication via EDS, the user is automatically assigned a previously assigned role and is given access to the system's functionality in accordance with the authority of this role.
9. The user, from the date of registration on the Portal and before the commissioning of the facility, forms digital documents on new construction, as well as reconstruction and repair of existing facilities (enterprises, buildings, structures and their complexes) through his personal account and/or uploads electronic documents.
10. Uploaded electronic documents and (or) generated digital documents on the Portal are subject to EDS certification by the person authorized to certify this document.
11. Information about the progress of the construction process, as well as electronic and (or) digital documents signed by the Portal User using EDS, are sent by one Portal user to the personal account of another Portal user.
12. Electronic and digital documents posted on the Portal and certified by EDS are not subject to deletion, modification or replacement during their storage period on the Portal.
13. Information on the organization of construction, including relevant electronic and digital documents provided to the Portal or to the CA by its Users, is stored throughout the entire life of the facility.
Chapter 3. The procedure for maintaining digital systems for the organization of construction on the principle of "one window"
14. The developed CA complies with the provisions of the Digital Code of the Republic of Kazakhstan, as well as the technical parameters of the Portal.
To integrate digital systems with the Portal, it is necessary to conclude an agreement with the Portal operator.
The CA Operator pays the Portal operator for the technical support services provided to him.
15. One or more digital systems carry out:
1) downloading and storing electronic and digital documents;
2) transfer to the Portal of information on the progress of construction, executive and technical documents signed by the user of the Portal using EDS;
3) information exchange with integrated Internet resources and other CAS.
16. In order to fully implement the "one window" principle and eliminate duplication of functions, technological interaction between the CA and the Portal is based on the following end-to-end processes:
1) automatic end-to-end synchronization of government and departmental reference books, classifiers and registers used in the construction documentation process;
2) end-to-end identification of construction sites by a single unique object code (number) assigned by the Portal during registration;
3) ensuring continuous monitoring and logging of the status of the transfer of executive and technical documentation in real time with the recording of the delivery time.
17. Digital system operators carry out the following activities:
1) carry out maintenance, system maintenance and planned development of the CA hardware complex;
2) ensure the smooth functioning and proper information security of the CA in accordance with the legislation of the Republic of Kazakhstan on informatization and the provisions of these Rules;
3) provide operational technical support to the users of the CA in accordance with the terms of the contracts/agreements concluded with them.;
4) provide state bodies performing control and supervision functions with access to the CA in order to monitor the actions of users of the CA.
18. Data storage, protection and integrity assurance in the CA:
1) electronic and digital documents, data from accounting logs and information on the progress of construction specified in paragraph 15 of these Rules are subject to permanent storage in the CA with daily backup of data to prevent their loss, distortion or unauthorized modification.;
2) when data is transited from the CA to the Portal's government platforms, secure communication channels (cryptographic protocols) are used, eliminating the possibility of information compromise or unauthorized access by third parties.
