Decree of the President of the Republic of Kazakhstan dated May 19, 2025 No. 879.

In accordance with paragraph 4 of Article 59 of the Budget Code of the Republic of Kazakhstan and in order to monitor the targeted, legitimate and effective use of funds allocated from the National Fund of the Republic of Kazakhstan, I HEREBY DECREE:

1. To establish a Commission for monitoring the expenditure of funds allocated from the National Fund of the Republic of Kazakhstan (hereinafter referred to as the Commission).

2. Approve the attached documents:

1) the position and working procedure of the Commission;

2) the composition of the Commission.

3. To invalidate certain acts of the President of the Republic of Kazakhstan in accordance with the annex to this Decree.

4. This Decree shall enter into force from the date of its signing.

THE POSITION AND PROCEDURE of the Commission for monitoring the expenditure of funds allocated from the National Fund of the Republic of Kazakhstan

Chapter 1. General provisions

1. The Commission for Monitoring the Expenditure of Funds Allocated from the National Fund of the Republic of Kazakhstan (hereinafter referred to as the Commission) is an advisory body for monitoring the use of funds from the National Fund of the Republic of Kazakhstan.

2. In its activities, the Commission is guided by the Constitution, laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, as well as these Regulations and working procedures.

3. The Commission's decisions are advisory in nature.

4. The task of the Commission is to monitor on an ongoing basis the targeted, legitimate and effective use of funds allocated from the National Fund of the Republic of Kazakhstan, including through monitoring and auditing the financial part of critical facilities, projects of national importance and other projects funded by the National Fund of the Republic of Kazakhstan (hereinafter – the National fund), including through bond borrowing.

5. The Commission has the right to:

1) involve external experts (auditors) to monitor the implementation and audit of the financial part of critical facilities, projects of national importance and other projects funded by the National Fund;

2) send materials to resolve the issue of disciplinary and other liability of officials of relevant state bodies and organizations with the participation of the state;

3) send information to law enforcement and national security agencies for consideration in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

6. The members of the Commission are obliged to:

1) to carry out, within its competence, interim monitoring based on the results of the first half of the year and an annual assessment of the expenditure of funds allocated from the National Fund;

2) participate in the preparation of the Commission's annual report;

3) to submit the results of the monitoring carried out within its competence to the Working Body of the Commission.

7. Members of the Commission, in accordance with the procedure established by the legislation of the Republic of Kazakhstan and within their competence, have the right to request the necessary reports, information, documents and other materials from government agencies, organizations with state participation and officials, including oral and written explanations from relevant officials.

Chapter 2. Organization and working procedure of the Commission

8. The Commission is headed by the Chairman.

Chairman of the Commission:

1) carries out the general management of the Commission's activities;

2) determines the agenda, place and time of the Commission meetings;

3) preside over the meetings of the Commission. In the absence of the Chairman, one of the members of the Commission shall preside at the meetings on his instructions.;

4) distributes tasks among the members of the Commission and, if necessary, gives them mandatory monitoring instructions within their competence.;

5) submits the annual report of the Commission to the President of the Republic of Kazakhstan no later than June 1 of the year following the reporting year.

9. The meetings of the Commission are held at least once a year and are recorded by the minutes. On behalf of the Chairman of the Commission, it is allowed to submit and consider unscheduled issues by initiating absentee voting.

A meeting is considered valid if at least half of the total number of Commission members participate in it. Members of the Commission may not delegate their powers to other officials.

10. The Commission makes decisions by a majority vote of the total number of Commission members participating in the meeting. In case of equality of votes, the decision voted for by the Chairman of the Commission is considered adopted.

11. The Commission's decisions, if necessary, are sent to the relevant government agencies and organizations.

12. The working body of the Commission is the Supreme Audit Chamber of the Republic of Kazakhstan.

The Working Body provides organizational support for the Commission's activities and monitors the implementation of its decisions.

13. In order to effectively organize the activities of the Commission, a secretary is appointed.

14. The Secretary of the Commission is a representative of the working body of the Commission. The Secretary is not a member of the Commission and does not have the right to vote when the Commission makes decisions.
