I DECREE:

     1. To approve the attached draft Protocol on amendments and Additions to the Agreement between the Republic of Kazakhstan and the Russian Federation on the use of the 4 State Central Training Ground (facilities and battlefields located on the territory of the Republic of Kazakhstan) Ministry of Defense of the Russian Federation dated January 20, 1995.

     2. To authorize Natalia Artemovna Korzhova, Minister of Finance of the Republic of Kazakhstan, to conclude on behalf of the Republic of Kazakhstan a Protocol on Amendments and Additions to the Agreement between the Republic of Kazakhstan and the Russian Federation on the use of the 4 State Central Training Ground (facilities and battlefields located on the territory of the Republic of Kazakhstan) Of the Ministry of Defense of the Russian Federation dated January 20, 1995, authorizing amendments and additions to it that are not of a fundamental nature.  <*>     The footnote. Paragraph 2 was amended by Decree of the President of the Republic of Kazakhstan dated April 3, 2006 No. 84.

     3. This Decree shall enter into force from the date of signing.

 Protocol on Amendments and Additions to the Agreement between the Republic of Kazakhstan and the Russian Federation on the Procedure for the Use of the 4 State Central Training Ground (facilities and Battlefields located on the Territory of the Republic of Kazakhstan) Ministry of Defense of the Russian Federation dated January 20, 1995

     The Republic of Kazakhstan and the Russian Federation, hereinafter referred to as the Parties, have agreed to amend the Agreement between the Republic of Kazakhstan and the Russian Federation on the use of the 4 State Central Training Ground (facilities and combat fields located on the Territory of the Republic of Kazakhstan). Ministry of Defense of the Russian Federation dated January 20, 1995 (hereinafter referred to as the Agreement) the following amendments and additions:      

1. In the title of the Agreement, in the third paragraph of the preamble and the first paragraph of Article 1, the words "4 State Central landfills" should be replaced by the words "4 State Central Interspecific landfills".      

2. In the second paragraph of the preamble: replace the words "year and" with the word "year," replace the word "Agreement" with the word "Agreement"; after the words "dated January 22, 1993," add the words "Agreement between the Russian Federation and the Republic of Kazakhstan on military-technical cooperation dated March 28, 1994,".      

3. Add the following third paragraph to Article 1: "The Landfill is headed by the head of the Landfill. The team of the 10th test site, stationed at the Sary-Shagan test site, and the 5580 testing support base located at the Emba test site report to the head of the test site.".      

4. Article 3 should be worded as follows: "1. The Republic of Kazakhstan transfers for temporary use to the Russian Federation on lease terms land plots with objects located on them, movable and immovable property of the Landfill.      2. The Russian Federation pays for the use of land plots by the Landfill in the interests of the Russian Federation during their lease period in accordance with the Lease Agreement for Facilities and Combat Fields of the 4th State Central Training Ground of the Russian Federation dated October 18, 1996.".      

5. In Article 4, after the word "sublease", add the words "to legal entities and individuals of the Parties or third countries".      

6. In Article 7: in the second sentence of paragraph 1, replace the words "by a separate agreement of the Parties" with the words "By the Agreement between the Russian Federation and the Republic of Kazakhstan on the status of military formations of the Russian Federation temporarily located on the territory of the Republic of Kazakhstan dated January 20, 1995 and other agreements of the Parties";      Paragraph 2 should be supplemented with the following sentence: "The President of the Russian Federation shall appoint the head of the Test Site in consultation with the President of the Republic of Kazakhstan on the proposal of the Minister of Defense of the Russian Federation, agreed with the Minister of Defense of the Republic of Kazakhstan."      

7. In Article 9: in the second paragraph of paragraph 1, the words "restoration and" should be deleted; in the tenth paragraph of paragraph 1, after the word "missiles", add the words "if necessary, in accordance with the procedure determined by agreement of the Parties"; add paragraph 6 as follows: "6. It is allowed to use land and airspace of the 4 State Central Interspecific Testing Ground of the Ministry of Defense of the Russian Federation when conducting test work in the interests of the 929 State Flight Test Center of the Ministry of Defense of the Russian Federation on the basis of annual plans for research and testing work provided for in Article 8 of this Agreement.".      

8. Paragraphs two and three of Article 11 should be worded as follows: "The management of the land cadastre and monitoring on the territory of the Landfill, control over the intended use of land is carried out by the authorized state body for land resources management of the Republic of Kazakhstan in accordance with the procedure and terms agreed with the command of the Landfill.      On the territory of the Landfill, the Russian Side undertakes not to carry out geological exploration and development of minerals, to hunt animals, fish and collect wild plants in accordance with the legislation of the Republic of Kazakhstan.".    

9. In article 13, the words "conscription" should be replaced by the words "conscription".      

10. In Annex 1 to the Agreement: after the word "central", add the word "interspecific"; replace the word "Urdinsky" with the word "Bokeyordinsky".      

11. In Annex 2 to the Agreement: after the word "central", add the word "interspecific"; the text of the annex should be worded in accordance with the annex to this Protocol.      All disputes and disagreements arising in the interpretation and application of the provisions of this Protocol will be resolved through mutual consultations and negotiations between the Parties.      If one of the Parties has any questions that require a joint solution, this Party shall notify the other Party in writing no later than 30 days before the start of negotiations.      This Protocol shall enter into force on the date of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.      This Protocol is an integral part of the Agreement between the Republic of Kazakhstan and the Russian Federation on the use of the 4th State Central Interspecific Training Ground (facilities and battlefields located on the territory of the Republic of Kazakhstan). The Ministry of Defense of the Russian Federation dated January 20, 1995 and is terminated simultaneously with this Agreement.
