On the establishment of the National Industrial Petrochemical Technopark Special Economic Zone

In accordance with the Law of the Republic of Kazakhstan dated July 6, 2007 "On Special economic zones in the Republic of Kazakhstan", I HEREBY DECREE:
1. To create a special economic zone "National Industrial Petrochemical Technopark" (hereinafter referred to as the FEZ) for the period until December 31, 2032.
2. Approve the attached documents:
1) Regulations on the FEZ;
2) target performance indicators and the critical level of failure to achieve the target indicators of the FEZ.

3. The Government of the Republic of Kazakhstan should take measures to ensure the operation of the FEZ.
4. This Decree shall enter into force from the date of signing.

Regulations on the special economic zone "National Industrial and Petrochemical Technopark"

1. General provisions
1. The Special Economic Zone "National Industrial Petrochemical Technopark" (hereinafter referred to as the FEZ) is located on the territory of Atyrau region according to the attached plan.
The territory of the FEZ is 3475.9 hectares and is an integral part of the territory of the Republic of Kazakhstan.
2. The FEZ is created in order to:
1) development and implementation of breakthrough investment projects for the creation and development of world-class petrochemical plants for the deep processing of hydrocarbon raw materials and the production of a wide range of competitive petrochemical products with high added value;
2) attracting investments in the construction and integrated development of petrochemical industries based on public-private partnership mechanisms;
3) construction of new interconnected, highly efficient and innovative petrochemical industries;
4) the integration of Kazakh petrochemical products into the global production and marketing system, the creation of innovative, competitive domestic petrochemical products in accordance with international standards (ISO);
5) development and implementation of scientific research and scientific and technical innovation projects for the creation and improvement of petrochemical industries and technologies for the purification and deep processing of hydrocarbon raw materials;
6) training and retraining of specialists for petrochemical industries in accordance with international standards.
3. The activities of the FEZ are regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special Economic Zones in the Republic of Kazakhstan", this Regulation and other regulatory legal acts of the Republic of Kazakhstan.
4. The types of activities on the territory of the FEZ are:
1) manufacturing industry, except for:
food production;
Beverage production;
production of tobacco products;
production of wooden and cork products, except furniture;
production of straw products and materials for weaving;
printing and playback of recorded materials;
Furniture production;
repair and installation of machinery and equipment;
2) construction and commissioning of facilities intended directly for carrying out the types of activities provided for in subparagraph 1) of this paragraph, within the limits of the design and estimate documentation;
3) construction and commissioning of infrastructure facilities in accordance with the design and estimate documentation.

2. FEZ management
5. The management of the FEZ is carried out in accordance with the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special economic zones in the Republic of Kazakhstan".
3. Taxation on the territory of the FEZ
6. Taxation on the territory of the FEZ is regulated by the tax legislation of the Republic of Kazakhstan.
4. Customs regulation
7. Customs regulation on the territory of the FEZ is carried out in accordance with the provisions of the customs legislation of the Customs Union and the Republic of Kazakhstan.
8. The customs procedure of the free customs zone may be applied on the territory of the FEZ or on part of its territory.
9. Goods intended for placement and (or) use on the territory of the FEZ by persons engaged in priority activities on the territory of the FEZ in accordance with the agreement on carrying out activities as a participant in the FEZ are placed under the customs procedure of the free customs zone.
10. The territory of the FEZ, where the customs procedure of the free customs zone is applied, is a customs control zone. The borders of the FEZ along its perimeter are equipped with special fences for the purpose of customs control.
11. Temporary storage facilities for goods may be established on the territory of the FEZ in accordance with the procedure established by the customs legislation of the Customs Union and the Republic of Kazakhstan.
12. Goods placed under the customs procedure of the free customs zone, as well as goods of the Customs Union that are not placed under the customs procedure of the free customs zone, and foreign goods placed under other customs procedures may be placed and used on the territory of the FEZ.
13. Goods imported into the territory of the FEZ and placed under the customs procedure of the free customs zone are considered to be located outside the customs territory of the Customs Union for the purposes of applying customs duties, taxes, and non-tariff regulatory measures.
14. Customs operations related to temporary storage, customs declaration, customs clearance and release of goods, as well as customs control on the territory of the FEZ, are carried out in accordance with the procedure established by the customs legislation of the Customs Union and the Republic of Kazakhstan.
5. Environmental protection
15. The activities of the FEZ in terms of environmental regulation are carried out in accordance with the environmental legislation of the Republic of Kazakhstan and are based on the rational and efficient use of natural resources by creating conditions for the transition to sustainable development and environmental protection based on a balance of economic, social and environmental aspects of improving the quality of life.
6. Final provisions
16. The conditions set forth in these Regulations may be changed by Decree of the President of the Republic of Kazakhstan.
17. The early abolition of the FEZ is carried out in accordance with the Law of the Republic of Kazakhstan dated July 21, 2011 "On Special economic zones in the Republic of Kazakhstan".
18. The activities of the FEZ, which are not regulated by this Regulation, are carried out in accordance with the current legislation of the Republic of Kazakhstan and the Customs Union.
