In accordance with Article 33 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan", I HEREBY DECREE:

 

     1. To establish the republican state institution "Kogamdyk kelisim" under the President of the Republic of Kazakhstan in Astana (hereinafter referred to as the institution).

2. Approve the attached charter of the institution.

3. Establish the staffing of the institution in the amount of 58 units.

4. To determine the Administration of the President of the Republic of Kazakhstan as the authorized body in relation to the institution.

5. To establish that the director of the institution is appointed and dismissed by the President of the Republic of Kazakhstan.

6. To the Government of the Republic of Kazakhstan:

1) take measures to liquidate the republican state institution "House of Friendship - Center for Interethnic Relations" of the Ministry of Culture of the Republic of Kazakhstan with the transfer of its property to the institution;

2) ensure the state registration of the institution within one month;

3) to ensure the financing of the institution from the national budget;

4) in accordance with the procedure established by the legislation of the Republic of Kazakhstan, ensure the establishment of official salaries (rates) of managers, specialists and employees of the institution using an increasing coefficient of 1.72;

5) take other measures resulting from this Decree.

7. The Ministry of Finance of the Republic of Kazakhstan, together with the Office of the President of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, to ensure the allocation of premises for the institution in Astana.

8. To make additions to the following decrees of the President of the Republic of Kazakhstan:

1) abrogated by Decree of the President of the Republic of Kazakhstan dated December 29, 2015 No. 150 (effective from 01.01.2016);

2) to the Decree of the President of the Republic of Kazakhstan dated March 29, 2002 No. 828 "On certain issues of personnel policy in the system of public authorities" (SAPP of the Republic of Kazakhstan, 2004, No. 17, Article 212; No. 21, Article 265; 2005, No. 29, Article 362; 2006, No. 23, Article 229; 2007, No. 42, Article 479; 2009, No. 34, Article 321; 2010, No. 51, Article 466; 2011, No. 39, Article 472; No. 41, Article 518; No. 48, Article 646; No. 51, Article 685; 2012, No. 35, art. 457; No. 74, art. 1067; No. 80, art. 1178; 2013, No. 24, art. 379, art. 381; No. 29, art. 439; No. 31, art. 465; No. 33, art. 497; No. 43, art. 633; 2014, No. 1, Article 1; No. 3, Article 17):

The Charter of the Republican state Institution "Kogamdyk kelisim" under the President of the Republic of Kazakhstan 1. General provisions

1. The Republican State Institution "Kogamdyk Kelisim" under the President of the Republic of Kazakhstan (hereinafter referred to as the institution) is a non-profit organization with the status of a legal entity established in the organizational and legal form of a state institution to carry out the functions of ensuring the activities of the Assembly of People of Kazakhstan (hereinafter referred to as the Assembly) and holding its events.

2. Type of state institution: republican.

3. The founder of the institution is the President of the Republic of Kazakhstan.

4. The authorized body in relation to the institution is the Administration of the President of the Republic of Kazakhstan (hereinafter referred to as the authorized body).

The rights of a subject of republican ownership in relation to the property of an institution are exercised by the authorized body for state property of the Republic of Kazakhstan (hereinafter referred to as the authorized body for state property).

5. Name of the institution:

1) Full:

in the official language - Kazakhstan Republikasyn Presidenti zhanindagi "Kogamdyk kelisim" republikalyk memlekettik mekemesi;

in Russian - the Republican State Institution "Kogamdyk kelisim" under the President of the Republic of Kazakhstan;

2) Abbreviated:

in the official language - "Kogamdyk kelisim" RMM;

in Russian - the Russian State University "Kogamdyk kelisim".

6. Location of the institution: 6 Mangilik El Avenue, Nur-Sultan, Yessil district, 010000, Republic of Kazakhstan.

2. Legal status of the institution

7. An institution is considered established and acquires the rights of a legal entity from the moment of its state registration.

8. The institution has an independent balance sheet, bank accounts in accordance with the legislation of the Republic of Kazakhstan, letterheads, seals with the image of the State Emblem of the Republic of Kazakhstan and the name of the institution.

9. An institution may not create or act as a founder (participant) of another legal entity.

10. The institution is liable for its obligations with the money at its disposal. If the institution does not have enough money, the Republic of Kazakhstan bears subsidiary responsibility for its obligations.

11. Civil law transactions of the institution come into force after their mandatory registration in the territorial divisions of the Treasury of the Ministry of Finance of the Republic of Kazakhstan.

3. The subject and objectives of the institution's activities

12. The subject of the institution's activities are:

1) organizational and logistical support for the work of the Assembly;

2) organization of scientific, expert, informational, and analytical support for the activities of the Assembly;

3) organization of support to ethnocultural and other public associations and organizations in the work aimed at the implementation of the Assembly's objectives.

13. The purpose of the institution's activities is to create an effective system of organizational, financial and logistical support for the functioning of the Assembly.

14. In order to achieve the goal, the institution carries out the following activities::

1) organization of meetings of the Session, the Council of the Assembly and other events of the Assembly;

2) maintenance of the Assembly Friendship House in Almaty;

3) creation of conditions for the work of republican ethnocultural associations;

4) organization and holding of mass socio-political, cultural, scientific and other events aimed at the realization of the goals and objectives of the Assembly;

5) ensuring the activities of the Republican Methodological Council of the Assembly's Friendship Houses, the Scientific and Expert Council of the Assembly, and the Journalists' Club at the Assembly;

6) carrying out activities to implement the Assembly's Development Concept, including their planning;

7) ensuring the interaction of the Assembly with public associations and other institutions of civil society;

8) participation in the development and implementation of state programs in the field of state ethnopolitics;

9) preparation of analytical and predictive materials on the state of interethnic relations;

10) conducting monitoring, developing proposals and recommendations on interethnic and interfaith relations;

11) providing information support for the activities of the Assembly, ensuring the functioning of the printed and electronic mass media of the Assembly;

12) development and implementation of media plans of the Assembly;

13) ensuring the implementation of educational activities of the Assembly, conducting training seminars and trainings;

14) organization of scientific research in the field of state ethnopolitics, the study of interethnic and interfaith relations;

15) organization of the publication of scientific papers (articles, monographs, textbooks, etc.) and publishing activities of the Assembly, production of other information materials on the areas of activity of the Assembly;

16) organization of the international cooperation of the Assembly, its participation in the work of international and other events;

17) organization of the Assembly's work on the development of the state language and other languages of the people of Kazakhstan;

18) organization of work within the framework of the implementation of memoranda and agreements on cooperation of the Assembly;

19) carrying out other types of activities and making transactions that meet the requirements of the legislation of the Republic of Kazakhstan and do not contradict the charter of the institution.

It is prohibited for an institution to carry out activities, as well as to make transactions that do not meet the subject matter and objectives of its activities set out in the charter.

15. A transaction made by an institution in contradiction with the laws of the Republic of Kazakhstan or the constituent documents, or in violation of the statutory competence of the director, may be declared invalid at the request of the authorized body or the authorized body for state property or the prosecutor.

16. The actions of the director of the institution aimed at carrying out non-statutory activities by the institution are a violation of labor duties and entail the application of disciplinary and financial liability measures.

4. Management of a public institution

4. Management of a public institution

17. The general management of the institution is carried out by the authorized body.

18. The authorized body performs the following functions in accordance with the procedure established by the legislation of the Republic of Kazakhstan:

1) assigns property to the institution;

2) approves the individual financing plan of the institution;

3) monitors the safety of the institution's property;

4) approves the charter of the institution, amendments and additions to it;

5) determines the structure, procedure for the formation and term of office of the institution's governing bodies, and the procedure for making decisions by the institution;

6) determines the rights, duties and responsibilities of the head of the institution, the grounds for his dismissal from his post;

7) approves the structure of the institution;

8) approves the annual financial statements of the institution;

9) gives consent to the authorized body for state property for the withdrawal or redistribution of property transferred to the institution or acquired by it as a result of its own economic activities;

10) agrees to the establishment of branches and representative offices by the institution;

11) in coordination with the authorized body for state property, reorganizes and liquidates the institution;

12) performs other functions established by the legislation of the Republic of Kazakhstan.

18-1. By the decision of the authorized body, the Coordinating Council of the institution may be organized in the structure of the institution.

The Coordinating Council of the institution coordinates the main activities of the institution, as well as performs other functions determined by the authorized body.

The footnote. The Charter was supplemented by paragraph 18-1 in accordance with the Decree of the President of the Republic of Kazakhstan dated 07/22/2019 No. 76.

19. The Director of the institution (hereinafter referred to as the Director) is appointed and dismissed by the President of the Republic of Kazakhstan.

20. The Director organizes and directs the work of the institution, reports directly to the authorized body and is personally responsible for the fulfillment of the tasks assigned to the institution and the exercise of its functions.

21. The Director acts on the principles of unity of command and independently decides on the activities of the institution in accordance with its competence, determined by the legislation of the Republic of Kazakhstan and this charter.

22. When carrying out the activities of the institution, the director in accordance with the procedure established by the legislation of the Republic of Kazakhstan:

1) acts on behalf of the institution without a power of attorney;

2) represents the interests of the institution in government agencies and other organizations;

3) concludes contracts;

4) issues power of attorney;

5) approves the procedure and plans of the institution for business trips, internships, training of employees in Kazakh and foreign training centers and other types of professional development of employees;

6) opens bank accounts;

7) issues orders and gives instructions that are mandatory for all employees;

8) appoints and dismisses his deputies in agreement with the Secretariat of the Assembly.;

9) employs and dismisses employees of the institution;

10) applies incentive measures and imposes disciplinary penalties on the staff of the institution in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

11) determines the duties and terms of reference of his deputy (deputies) and other senior staff of the institution;

12) performs other functions assigned to it by the legislation of the Republic of Kazakhstan, this charter and the authorized body.

5. The order of formation of the property of the institution

23. The assets of a legal entity constitute the property of an institution, the value of which is reflected on its balance sheet. The property of the institution is formed by:

1) property transferred to him by the owner;

2) property (including monetary income) acquired as a result of own activities;

3) other sources not prohibited by the legislation of the Republic of Kazakhstan.

24. An institution shall not have the right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds allocated to it under the financing plan.

25. The activities of the institution are financed from the budget by the authorized body.

26. The institution maintains accounting records and submits reports in accordance with the legislation of the Republic of Kazakhstan.

27. The audit and revision of the financial and economic activities of the institution shall be carried out by the authorized body in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

6. Working hours of the institution

28. The working hours of the institution are established by the rules of the internal labor regulations and should not contradict the norms of the labor legislation of the Republic of Kazakhstan.

7. The procedure for making changes and additions to the founding documents of the institution

29. Amendments and additions to the constituent documents of the institution are made by decision of the President of the Republic of Kazakhstan.

30. Amendments and additions to the constituent documents of the institution are registered in accordance with the legislation of the Republic of Kazakhstan.

8. Reorganization and liquidation of the institution

31. The reorganization and liquidation of the institution are carried out in accordance with the decision of the President of the Republic of Kazakhstan.

9. Information about branches and representative offices of the institution

32. The institution has the right to have branches and representative offices in the territory of the Republic of Kazakhstan.
