On the procedure for resolving issues related to the spelling of surnames and patronymics of persons of Kazakh nationality

Decree of the President of the Republic of Kazakhstan dated April 2, 1996 No. 2923.

Taking into account the numerous appeals of citizens of the Republic of Kazakhstan, in order to bring the practice of writing Kazakh surnames and patronymics in line with the historically established traditions of the Kazakh people, I decree:

     1. Persons of Kazakh nationality, at their request, have the right to change the spelling of their surnames and patronymics with the exception of affixes unusual in the Kazakh language, but with the preservation of the root bases of surnames and patronymics. At the same time, the endings "uly" or "kyzy" are added to the father's name when writing the patronymic, depending on the gender of the person.

     2. To establish that the spelling of surnames and patronymics provided for in paragraph 1 of this Decree is carried out in a simplified manner by the authorized state body in the field of documentation when issuing passports and identity cards of a citizen of the Republic of Kazakhstan without making changes to the records of civil status.

     3. A change in the spelling of a person's surname and patronymic does not affect his legal personality, that is, it is not a reason for the termination or modification of his rights and obligations acquired under the surname and patronymic in the previous spelling.

     4. All other issues related to the change of surnames, first names, patronymics are resolved in accordance with the regulatory legal acts of the Republic of Kazakhstan.

     5. The Government of the Republic of Kazakhstan should ensure that its regulatory legal acts and acts of the central executive bodies of the Republic are brought into line with this Decree.

     6. This Decree shall enter into force from the date of publication, with the exception of paragraph 2, which shall enter into force on May 1, 1996.
