The Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic, hereinafter referred to as the Parties, striving to further develop friendly relations and cooperation in the military field, guided by The Agreement between the Republic of Kazakhstan and the Kyrgyz Republic on Military Cooperation dated April 8, 1997, based on the need to strengthen security in the Central Asian region, in order to assist the development of the Armed Forces of the Kyrgyz Republic, Desiring to create a legal framework for the provision of gratuitous military-technical assistance, we agreed on the following:
Article 1
The Kazakh Side provides the Kyrgyz Side with gratuitous military and technical assistance in the form of the transfer of military equipment specified in the annex, which is an integral part of this Agreement.
Article 2
The authorized bodies for the implementation of this Agreement are: from the Kazakh Side — the Ministry of Defense of the Republic of Kazakhstan; from the Kyrgyz Side - the Ministry of Defense of the Kyrgyz Republic. In case of a change in the name or functions of the authorized bodies, the Parties shall immediately notify each other through diplomatic channels.
Article 3
The Kazakh Side ensures the delivery of military property by road from the territory of the Republic of Kazakhstan to the territory of the Kyrgyz Republic (Koi-Tash settlement), where representatives appointed by the authorized bodies of the Parties will receive and transfer military property with the registration of an act. Transportation costs to the settlement of Koi-Tash are paid by the Kazakh Side. Customs clearance and declaration of transferred property in the Republic of Kazakhstan is carried out in accordance with the legislation of the Customs Union. The Kyrgyz Side bears the costs and is responsible for the clearance of customs procedures on the territory of its state.
Article 4
No later than 30 days before crossing the state borders of the states of the Parties, the authorized body of the Kazakh Side provides the authorized body of the Kyrgyz Side with a personal list of personnel delivering military equipment. The personal list contains the following information: surname and initials, date of birth, military rank, position, name, series and number of the identity document. The nominal list is approved by the authorized body of the Kazakh Side. Military personnel of the Kazakh Side cross the state borders of the states of the Parties in the military uniform of the Armed Forces of the Republic of Kazakhstan in accordance with the list of names, upon presentation of identity documents of a citizen of the Republic of Kazakhstan.
Article 5
The Kyrgyz Side does not transfer military property received from the Kazakh Side under this Agreement or the right to use it to a third party.
Article 6
By agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocol, which is an integral part of this Agreement. Any disagreements and disputes that arise during the implementation of this Agreement will be resolved by the Parties through negotiations and consultations.
Article 7
This Agreement shall enter into force from the date on which the Kyrgyz Side receives, through diplomatic channels, a written notification from the Kazakh Side on the completion of the internal procedures necessary for its entry into force. This Agreement shall terminate upon the full transfer to the Kyrgyz Side of military equipment provided in accordance with this Agreement, which is confirmed by the Parties through diplomatic channels. Upon termination of this Agreement, the obligations of the Kyrgyz Side provided for in Article 5 of this Agreement shall remain in force.
Done in Astana on June 24, 2015, in two copies, each in the Kazakh, Kyrgyz and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
