On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Cabinet of Ministers of the Kyrgyz Republic on the provision of military and technical assistance in ensuring the Security of the Central Asian region

      To ratify the Agreement between the Government of the Republic of Kazakhstan and the Cabinet of Ministers of the Kyrgyz Republic on the provision of military and technical assistance in ensuring the security of the Central Asian region, signed in Nur-Sultan on December 7, 2021.

Agreement between the Government of the Republic of Kazakhstan and the Cabinet of Ministers of the Kyrgyz Republic on the provision of military and technical assistance in ensuring the security of the Central Asian region

     (Entered into force on June 28, 2022, Bulletin of International Treaties of the Republic of Kazakhstan 2022, No. 3, Article 12)    

      The Government of the Republic of Kazakhstan and the Cabinet of Ministers of the Kyrgyz Republic (hereinafter referred to as the Parties),  

      Desiring to strengthen the existing friendly relations and cooperation in the military field,  

      Considering the provisions of the Agreement between the Republic of Kazakhstan and the Kyrgyz Republic on Military Cooperation dated April 8, 1997,  

      have agreed on the following:  

Article 1

     In order to ensure the security and defense potential of the Central Asian region, the Kazakh Side provides military and technical assistance to the Kyrgyz Side in the form of a gratuitous transfer of military equipment.

     The names and amounts of military equipment are agreed through diplomatic channels by the authorized bodies of the Parties within 2 months after the signing of this Agreement.

     The Kyrgyz Side uses the military equipment received from the Kazakh Side solely for the purposes of this Agreement, does not transfer to a third party and does not use it against the member States of the Commonwealth of Independent States.

Article 2

     The authorized bodies for the implementation of this Agreement are:

     from the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan;

     from the Kyrgyz Side - the Ministry of Defense of the Kyrgyz Republic.

     In case of a change in the name or functions of the authorized bodies, the Parties shall immediately notify each other through diplomatic channels.

Article 3

     The Kazakh Side ensures the delivery of military property by road from the territory of the Republic of Kazakhstan to the territory of the Kyrgyz Republic (Koi-Tash settlement), where representatives appointed by the authorized bodies of the Parties will receive and transfer military property with the registration of an act. Transportation costs to the settlement of Koi-Tash are paid by the Kazakh Side.

Article 4

     By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocols, which are an integral part of this Agreement.

Article 5

     Disputes related to the application and interpretation of the provisions of this Agreement are resolved through mutual consultations and negotiations between the Parties.

Article 6

     This Agreement is temporarily applied from the date of its signing and enters into force from the date of receipt by the Kyrgyz Side through diplomatic channels of a written notification from the Kazakh Side on the completion of internal procedures necessary for its entry into force.

     This Agreement shall terminate upon the full transfer to the Kyrgyz Side of military equipment provided in accordance with this Agreement, which is confirmed by the Parties through diplomatic channels.

     Done in the city of Nur-Sultan on December 7, 2021, in two copies, each in the Kazakh, Kyrgyz and Russian languages, all texts being equally authentic.

     In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
