On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on the provision of gratuitous military-technical assistance

To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on the provision of gratuitous military-technical assistance, signed in Astana on March 17, 2011.

Agreement between the Government of the Republic of Kazakhstan and The Government of the Kyrgyz Republic on the provision of gratuitous military-technical assistance
The Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic (hereinafter referred to as the Parties),
Striving to further develop friendly relations and cooperation in the military field,
Guided by the Agreement between the Republic of Kazakhstan and the Kyrgyz Republic on Military Cooperation dated April 8, 1997,
based on the need to strengthen security in the Central Asian region,
in order to assist the development of the Armed Forces of the Kyrgyz Republic,
Desiring to create a legal framework for the provision of gratuitous military-technical assistance,
have agreed on the following:
Article 1
The Kazakh Side provides the Kyrgyz Side with gratuitous military-technical assistance in the form of a gratuitous transfer of military equipment specified in the Annex, which is an integral part of this Agreement.
Article 2
The authorized bodies of the Parties for the implementation of this Agreement are:
from the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan;
On the Kyrgyz Side is the Ministry of Defense of the Kyrgyz Republic.
Article 3
The authorized body of the Kazakh Side delivers military equipment from the territory of the Republic of Kazakhstan to the Ak-Zhol customs post in the territory of the Chui region of the Kyrgyz Republic, where representatives of the authorized bodies of the Parties will receive and transfer military equipment.
Article 4
No later than 30 days before crossing the state borders of the Parties, the authorized body of the Kazakh Side provides the authorized body of the Kyrgyz Side with a personal list of personnel delivering military equipment.
The personal list contains the following information: surname and initials, date of birth, military rank, position, name, series and number of the identity document. The nominal list is approved by the authorized body of the Kazakh Side.
Military personnel of the Kazakh Side cross the state borders of the Parties in accordance with the list of names, upon presentation of identity documents of a citizen of the Republic of Kazakhstan.
Article 5
The costs associated with the delivery of military equipment to the Ak-Zhol customs post are paid by the Kazakh Side.
The Kyrgyz Side bears the costs and is responsible for customs clearance and transportation of military equipment on the territory of its State.
Article 6
The Kyrgyz Side undertakes not to transfer military property received from the Kazakh Side under this Agreement or the right to use it to a third party.
Article 7
By agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocol.
Any disagreements that arise during the implementation of this Agreement will be resolved by the Parties through negotiations and consultations.
Article 8
This Agreement shall enter into force on the date of receipt by the Kyrgyz Side of a written notification through the diplomatic channels of the Kazakh Side on the completion of the internal procedures necessary for its entry into force.
This Agreement shall terminate upon the full transfer to the Kyrgyz Side of military equipment provided in accordance with this Agreement, which is confirmed by the Parties through diplomatic channels.
Done in Astana on March 17, 2011, in two copies, each in the Kazakh, Kyrgyz and Russian languages, all texts being equally authentic.
In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
