Agreement between the Government of the Republic of Kazakhstan and the Government of the People's Republic of China on the development of the Trans-Caspian International Transport Route, including for China-Europe container trains
The Government of the Republic of Kazakhstan and the Government of the People's Republic of China, hereinafter referred to as the Parties,
Guided by the provisions of the Memorandum of Understanding between the Government of the Republic of Kazakhstan and the Government of the People's Republic of China on deepening the development of the Trans-Caspian International Transport Route for Container Trains between China and Europe dated May 17, 2023,
Taking into account the agreements of the two heads of state on strengthening the alignment of the "One Belt, One Road" initiative and the new economic policy "Nurly Zhol",
Considering the close trade relations between the two countries on cooperation for container trains between China and Europe and the countries located along the Trans-Caspian International Transport Route (hereinafter - TMTM),
Recognizing that the TMTM is one of the key projects of practical cooperation between the Republic of Kazakhstan and the People's Republic of China,
Desiring to stimulate the potential of international combined transport, increase trade and investment,
proceeding from the desire to create conditions for the conclusion of economically beneficial long-term contracts by interested business entities of the States of the Parties,
Based on the principles of equal partnership, mutual benefit and respect,
have agreed on the following:
Article 1
The objectives of this Agreement are to jointly promote cooperation between the Parties in the field of TMTM development and the development of container transportation along the China-Europe route, aimed at increasing the integration of transport links, improving transportation efficiency, promoting trade, economic and industrial cooperation, as well as creating favorable conditions for the transportation of goods from China to/through Asia and further to Europe.
Article 2
1. The competent authorities of the Parties coordinating the implementation of this Agreement (hereinafter referred to as the competent authorities) are:
from the Kazakh Side - the Ministry of Transport of the Republic of Kazakhstan;
From the Chinese Side, the State Committee for Development and Reforms of the People's Republic of China.
2. The Parties shall notify each other in writing through diplomatic channels about the change in the names of the competent authorities of the Parties referred to in paragraph 1 of this Article, as well as the assignment of these issues to the competence of other bodies.
The parties adhere to the principles of joint development, construction and use of TMTM, based on mutual trust and mutually beneficial cooperation, seeking common development and prosperity.
Each of the Parties will make efforts to ensure favorable conditions for cooperation in the development of TMTM in accordance with the current legislation of the States of the Parties and international treaties to which the States of the Parties are parties.
Article 3
In order to further develop the TMTM within the framework of this Agreement, the Parties strive to:
1) to cooperate and ensure coordination of actions in the following areas:
ensuring proper operational condition and sufficient capacity of transport infrastructure facilities in the territory of the States of the Parties;
ensuring increased capacity of main pipelines and port infrastructure;
joint formation of a favorable development environment to support the stable and unhindered functioning of TMTM;
implementation of targeted, practical and effective anti-epidemic measures on the route in both directions;
introduction of a mechanism for prior notification of the Parties to prevent downtime of freight vehicles and railway trains at international checkpoints, as well as facilitating the exchange of data on tracking rolling stock on the territory of the States of the Parties;
the study of optimal transportation options and the development by both Sides of transit cargo sources to facilitate the passage of trains or vehicles carrying out transit transportation within their own territories;
2) to develop cooperation on stimulating and increasing export-import and transit container traffic along the new Eurasian Continental Bridge, which means transport corridors through the territory of Kazakhstan within the framework of the "One Belt, One Road" initiative, with its further integration with the TMTM, by:
active coordination of activities aimed at attracting transit and foreign trade goods from China to Europe via TMTM and vice versa;
assistance in financing TMTM oil pipeline and port infrastructure projects;
facilitating the reduction of administrative barriers related to border and customs procedures and the processing of cargo and containers at ports and docking stations;
optimization of logistics and transport operations, reduction of transportation time, and improvement of the quality of services provided.
Article 4
The Parties shall establish a working group on the transportation of goods at the TMTM at the level of ministries in charge of the transport sector, as well as representatives of other bodies and organizations responsible for issues related to the implementation of this Agreement, as well as the development and increase of cargo volumes under the TMTM (hereinafter referred to as the working group).
The composition of the Kazakh and Chinese parts of the working group is approved by the Parties. The Working Group reviews and forecasts the potential annual volume of goods transported under the TMTM.
The Working Group meets at the initiative of the competent authority of one of the Parties. The place, dates of the meeting and its agenda are determined by agreement between the competent authorities.
The Working Group makes decisions, which are formalized in protocols. The rules (procedure) of the working group's work are set by it independently.
Article 5
In order to ensure the implementation of the agreements under this Agreement, as well as in the event of issues related to the organization of transportation, the Parties will carry out the necessary bilateral consultations to develop mutually acceptable solutions.
Article 6
By mutual agreement of the Parties, amendments may be made to this Agreement, which are an integral part of it and are formalized by separate protocols that enter into force in accordance with the procedure provided for in Article 8 of this Agreement.
Article 7
Issues and disagreements arising between the Parties in connection with the interpretation or application of this Agreement shall be resolved through negotiations and consultations between the competent authorities of the Parties, including through the use of diplomatic channels.
Article 8
This Agreement shall be concluded for an indefinite period and shall enter into force from the date of receipt through diplomatic channels of the last written notification by the Parties of the completion of the internal procedures necessary for its entry into force.
Each of the Parties may terminate this Agreement by sending a corresponding written notification to the other Party through diplomatic channels. In this case, this Agreement shall terminate upon the expiration of 6 (six) months from the date of receipt of such notification.
Done in Beijing on October 17, 2023, in two copies, each in the Kazakh, Chinese and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of this Agreement, the Parties will refer to the text in Russian.
