Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on the provision of gratuitous military assistance

The Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan (hereinafter referred to as the Parties), wishing to strengthen existing friendly relations and cooperation in the military field, guided by The Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on military-technical cooperation dated December 16, 1999, taking into account the provisions of The Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on military cooperation dated December 16, 1999, agreed on the following:
Article 1
In order to assist in the formation of the Armed Forces of the Republic of Tajikistan, the Kazakh Side will provide gratuitous military assistance to the Tajik Side.
Article 2
In order to implement this Agreement, the Parties appoint authorized bodies: on the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan; on the Tajik Side - the Ministry of Defense of the Republic of Tajikistan. In case of a change in the name or functions of the authorized bodies, the Parties shall immediately notify each other through diplomatic channels.
Article 3
Gratuitous military aid is provided in the form of financial assistance. The list and quantity of transferred assets are defined in the Annex, which is an integral part of this Agreement.
Article 4
The Kazakh Side ensures the delivery of property by air transport of the Armed Forces of the Republic of Kazakhstan from the territory of the Republic of Kazakhstan to the territory of the Republic of Tajikistan (the city of Dushanbe), where representatives appointed by the Parties will make their proper reception and transfer. At the same time, transportation costs to the city of Dushanbe are paid by the Kazakh Side. The Tajik Side assumes the costs and is responsible for customs clearance in the Republic of Tajikistan. Customs clearance of the transferred property in the Republic of Kazakhstan is carried out in accordance with the legislation of the Republic of Kazakhstan.
Article 5
The Tajik Side does not transfer the property received from the Kazakh Side or the right to use it to a third party without obtaining the prior written consent of the Kazakh Side.
Article 6
By agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocol. Any disagreements that arise during the implementation of this Agreement will be resolved through negotiations and consultations.
Article 7
This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement shall terminate upon the full transfer to the Government of the Republic of Tajikistan of the material assistance provided in accordance with this Agreement.
Done in Dushanbe on November 10, 2009, in two original copies, each in the Kazakh, Tajik and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
