AGREEMENT between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on the provision of gratuitous military-technical assistance

The Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan (hereinafter referred to as the Parties), wishing to strengthen existing friendly relations and cooperation in the military field, taking into account the provisions of The Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan on military cooperation dated December 16, 1999, agreed on the following:

Article 1

In order to assist in the formation of the Armed Forces of the Republic of Tajikistan, the Kazakh Side provides gratuitous military-technical assistance to the Tajik Side.

Article 2

In order to implement this Agreement, the Parties appoint authorized bodies: on the Kazakh Side - the Ministry of Defense of the Republic of Kazakhstan; on the Tajik Side - the Ministry of Defense of the Republic of Tajikistan. In case of a change in the name or functions of the authorized bodies, the Parties shall immediately notify each other through diplomatic channels.

Article 3

The Kazakh Side provides the Tajik Side with gratuitous military-technical assistance in the form of a gratuitous transfer of military equipment specified in the annex, which is an integral part of this Agreement.

Article 4

The Kazakh Side ensures the delivery of military equipment by an aircraft of the Armed Forces of the Republic of Kazakhstan from the territory of the Republic of Kazakhstan to the territory of the Republic of Tajikistan (the city of Dushanbe), where representatives appointed by the authorized bodies of the Parties will make their proper reception and transfer. At the same time, transportation costs to the city of Dushanbe are paid by the Kazakh Side. The Tajik Side assumes the costs and is responsible for customs clearance in the Republic of Tajikistan. By mutual agreement of the authorized bodies of the Parties, this property may also be exported by the Tajik Side from the territory of the Republic of Kazakhstan independently. Customs clearance of the transferred property in the Republic of Kazakhstan is carried out in accordance with the legislation of the Republic of Kazakhstan.

Article 5

The Tajik Side does not transfer the property received from the Kazakh Side, specified in the annex to this Agreement, or the right to use it to a third party.

Article 6

By agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by the relevant protocol. Any disagreements that arise during the implementation of this Agreement will be resolved through negotiations and consultations.

Article 7

This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement, with the exception of Article 5 of this Agreement, shall terminate upon the complete transfer to the Tajik Side of military equipment provided in accordance with this Agreement, which is confirmed by the Parties through diplomatic channels.

Done in Dushanbe on April 15, 2013, in two originals, each in the Kazakh, Tajik and Russian languages, all texts being equally authentic.

In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
