      To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on cooperation in the field of ecology and environmental protection, signed in Tashkent on December 22, 2022.

Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on cooperation in the field of ecology and environmental protection

     The Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan, hereinafter referred to as the Parties,

     Recognizing the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on cooperation in the field of environmental protection and Rational Use of Natural Resources dated June 2, 1997,

     Expressing their desire to strengthen friendly relations between the two countries and to develop cooperation on environmental protection,

     Convinced that the environment must be protected for the health and well-being of present and future generations,

     Recognizing that sustainable economic development requires environmentally sound management of natural resources,

     Fully aware that cooperation between the Parties is mutually beneficial and important in the light of the responsibility of the two States for the preservation of the global environment,

     Recognizing the importance of environmental policy and practice in terms of making adequate decisions on global environmental issues,

     Considering the priority of achieving economic growth and a higher standard of living based on the principles of sustainable development,

     have agreed on the following:

Article 1

     The Parties shall cooperate in the field of environmental protection on the basis of equality and mutual benefit in accordance with the laws and international treaties to which their States are parties.

Article 2

     The Parties cooperate in the following main areas:

     prevention and control of atmospheric air pollution;

     prevention and control of water pollution, including the mutual transmission of information on emergencies related to water pollution and the adoption of urgent measures to eliminate pollution;

     solid household waste management, including prevention and control of their illegal cross-border movements;

     management of hazardous wastes, including prevention of their illegal transboundary movement;

     conservation of biological diversity;

     protecting ecosystems from degradation and preventing sandstorms;

     environmental protection in the use of land resources;

     joint response to environmental emergencies;

     environmental monitoring, including joint water sampling, analysis and exchange of water quality data and regulatory documents;

     adaptation to climate change;

     conducting joint conferences, round tables, meetings, and working groups on joint research activities in the field of environmental monitoring (agreeing on rules and indicators acceptable to the Parties for monitoring the state of the environment and methods of their analysis);

     promoting the introduction and dissemination of environmentally friendly production technologies;

     launching joint educational programs, scientific research, as well as staff training and popularization of the results of joint activities in the field of the environment;

     cooperation in terms of state control over the transboundary movement of hazardous wastes and their disposal;

     development of joint measures to improve the environmental situation in the Aral Basin;

     coordination of measures for the protection of migratory animals, as well as animal species living on the territories of the States of the Parties;

     other areas of cooperation agreed by the Parties.

Article 3

     The Parties identify the following programs as priorities for the implementation of joint development:

     on the organization of the restoration of forests in the adjacent territories of the States of the Parties;

     to combat the degradation of soils and vegetation cover of the neighboring regions of Kazakhstan and Uzbekistan;

     on the organization and implementation of environmental monitoring.

Article 4

     The Parties will develop regulations for the exchange of information on the state of the environment in the border territories of the States of the Parties.

     The Parties shall establish a working mechanism for mutual information on emergency situations having a transboundary impact on the environment.

     The Parties, on the basis of mutual support, shall take the necessary measures to prevent emergencies harmful to the environment of the State of the other Party, as well as to maximize the elimination or reduction of transboundary environmental impacts.

Article 5

     The authorized bodies of the States of the Parties responsible for coordinating the activities for the implementation of this Agreement are:

     from the Kazakh side - the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan;

     The Uzbek side is represented by the State Committee of the Republic of Uzbekistan for Ecology and Environmental Protection.

     In case of appointment of other authorized bodies or changes in the name of the States of the Parties, the Parties shall immediately notify each other through diplomatic channels.

     The Parties are establishing the Kazakh-Uzbek joint commission for cooperation in the field of environmental protection (hereinafter referred to as the Commission), responsible for developing Regulations on its activities and resolving relevant issues related to the implementation of this Agreement. Meetings of the Commission are held at least once a year, alternately in the territories of the States of the Parties. The Commission's decisions are formalized in protocols.

Article 6

     This Agreement does not affect the rights and obligations of the Parties arising from other international treaties to which their States are parties.

Article 7

     The Parties shall independently bear the financial costs associated with the implementation of this Agreement, within the limits of the funds provided for by the laws of their States.

Article 8

     By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are its integral parts and formalized in separate protocols.

Article 9

     In case of disputes and disagreements in the interpretation or application of this Agreement, the Parties resolve them through consultations and negotiations.

Article 10

     This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.

     This Agreement is concluded for an indefinite period and remains in force until the expiration of 6 (six) months from the date of receipt by one of the Parties through diplomatic channels of a written notification by the other Party of its intention to terminate it.

     Done in Tashkent on December 22, 2022, in two copies, each in the Kazakh, Uzbek and Russian languages, all texts being equally authentic.

     In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will be guided by the text in Russian.
