To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on the regulation of the activities of the International Center for Industrial Cooperation "Central Asia", signed in Tashkent on November 9, 2023.

Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on the regulation of the activities of the International Center for Industrial Cooperation "Central Asia"

     The Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan, hereinafter referred to as the Parties,

  Realizing the need to stimulate and develop the sustainability of the industrial development of the two states, increase the competitiveness and innovation activity of economic entities, integrate into regional and international value chains, as well as create a favorable investment environment,

  Recognizing the crucial role of direct industrial cooperation between the economic entities of the two countries on the basis of market relations and export support, ensuring favorable conditions for the establishment and development of industrial, scientific and technical cooperation between the economic entities of the Parties,

  have agreed on the following:

Chapter 1. Legal status and governing bodies of the International Center for Industrial Cooperation "Central Asia"

Article 1

     The International Center for Industrial Cooperation "Central Asia" (hereinafter referred to as the Center) is a complex of industrial cooperation, economic and investment cooperation, consisting of Kazakh and Uzbek parts, with a legal and economic regime, the terms of which are determined by the provisions of this Agreement, other bilateral international treaties, as well as the legislation of the states of the Parties.

Article 2

     The Kazakh part of the Center is under the jurisdiction of the Republic of Kazakhstan.

  The Uzbek part of the Center is under the jurisdiction of the Republic of Uzbekistan.

Article 3

     The management of the Kazakh and Uzbek parts of the Center is carried out by the authorized bodies of the states of the Parties.

  The authorized body for the management of the Kazakh part of the Center is the Ministry of Trade and Integration of the Republic of Kazakhstan.

  The authorized body for managing the Uzbek part of the Center is the Ministry of Investment, Industry and Trade of the Republic of Uzbekistan.

  In the event of a change in the official name or transformation of authorized bodies, the Parties shall immediately notify each other through diplomatic channels.

  The Parties, in order to manage and ensure the functioning of the Center, attract investments, provide comprehensive services to business entities, coordinate the work of government agencies of the States of the Parties to implement administrative, licensing and other procedures (services) in the Center on a "one-stop shop" basis, and provide other services, in accordance with this Agreement and the legislation of their states, create and/or They determine the Management companies in their part of the Center's territory.

Chapter 2. The layout, boundaries of the territory and the area of the Center

Article 4

     The Center is located on the border territories of the states of the Parties, on both sides of the State Border line between the Republic of Kazakhstan and the Republic of Uzbekistan (hereinafter referred to as the State Border), directly next to the checkpoints "Atameken" (Republic of Kazakhstan) and "Gulistan" (Republic of Uzbekistan).

  The Kazakh and Uzbek parts of the Center are located outside the border strips from the State Border line, in accordance with the requirements of the legislation of the States of the Parties and the provisions of this Agreement.

  The management of the Center and the activities of economic entities on its territory are carried out strictly within its borders.

  Each of the Parties undertakes to take effective measures to protect it.

Article 5

     The total area of the Center is 1 square kilometer, of which the area of the Kazakh part is 0.5 square kilometers, the area of the Uzbek part is 0.5 square kilometers.

  The geographical coordinates, layout and boundaries of the Center's territory are given in the Annex, which is an integral part of this Agreement.

  Each Side will establish an internal checkpoint in its parts of the Center to ensure control over the movement of persons, goods (cargo) and vehicles.

Chapter 3. Types of activities, functions and tasks of the Center

Article 6

     In accordance with the laws of the States of the Parties, economic entities may carry out activities on the territory of the Center aimed at developing industrial cooperation between the States of the Parties.

  In case of disagreement on issues related to the implementation of activities on the territory of the Center, the authorized bodies hold joint consultations.

Article 7

     The tasks of the Center include:

  - creation of favorable conditions for the development of interstate cooperative ties and the integration of small and medium-sized industrial enterprises of the States of the Parties into the international value chain;

  - improving the efficiency of using the production base of the border territories;

  - optimization of production processes and increasing the competitiveness of industrial enterprises established on the territory of the Center;

  - carrying out technological modernization and development of innovative and high-tech industries, integration with modern technologies;

  - optimization of enterprise costs through outsourcing of maintenance of manufactured industrial products;

  - expansion of industrial cooperation between the states of the Parties by involving industrial enterprises operating on the territory of the Center in the production process and establishing the production of import-substituting products;

  - organization of the production of industrial products, performance of works and provision of services at the industrial cooperation site in accordance with the business plan, as well as plans for the development of industrial cooperation;

  - involvement of design and construction organizations in the process of creating and ensuring conditions for the operation of industrial cooperation, in accordance with the legislation of the states of the Parties and this Agreement.

Chapter 4. Taxation, currency regulation and currency control, banking and insurance activities on the territory of the Center

Article 8

     Taxation on the territory of the Center is carried out in accordance with the laws of the States of the Parties and international treaties to which their States are parties.

Article 9

     Currency control in the territories of the Kazakh and Uzbek parts of the Center is carried out in accordance with the legislation of the states of the Parties.

Article 10

     Payments and money transfers when operating on the territory of the Center are made in compliance with the principle of free conversion for current transactions determined in accordance with the legislation of the States of the Parties.

Article 11

     The opening of bank branches in the territories of the Kazakh and Uzbek parts of the Center, as well as their activities are carried out, regulated and subject to control and supervision in accordance with the procedure established by the legislation of the States of the Parties.

Article 12

     At enterprises, institutions and organizations located on the territory of the Center, insurance contracts are concluded in accordance with the procedure established by the legislation of the State in part of the territory of the Center of which they are located.

Chapter 5. Building regulations on the territory of the Center

Article 13

     Financing of design, construction and repair works for the creation of transport infrastructure, water supply, electricity, telecommunications, engineering protection and other utilities, a control point, infrastructure for monitoring and inspection, administrative management, as well as fencing on the territory of each part of the Center is carried out at the expense of each of the Parties, including from any non- sources prohibited by their legislation.

  Financing of construction, various business premises, terminals and other facilities for entrepreneurial activity on the territory of the Center is carried out by business entities at their own expense in accordance with the legislation of the States of the Parties.

  The application of international building codes, rules, and standards is allowed on the territory of the Center, taking into account the legislation of the States of the Parties.

  The development of the Center's territory is carried out on the basis of master plans. The development of master plans for each part of the Center, making changes and additions to them, is carried out in accordance with the procedure established by the legislation of the States of the Parties.

Chapter 6. Operating mode, procedure for controlling the movement of persons, goods (cargo) and vehicles

Article 14

     Border, customs and other types of control of persons, vehicles, goods, goods and animals moving from one part of the Center to another are carried out at the Atameken (Republic of Kazakhstan) and Gulistan (Republic of Uzbekistan) checkpoints open to international traffic in accordance with the laws of the States of the Parties and international treaties to which the Parties are parties. are their states.

  Citizens of the States of the Parties, third countries and stateless persons may enter, leave and temporarily stay in the territory of the Center of one of the States of the Parties through existing checkpoints with valid documents.

  The Kazakhstan part of the Center is open every day from 10:00 to 19:00.

  The Uzbek part of the Center is open every day from 9:00 to 18:00.

Chapter 7. Ensuring security and legal order on the territory of the Center

Article 15

The Parties may place on the territory of their parts of the Center state bodies for ensuring security and protecting public order, as well as, if necessary, organizations engaged in security activities on a contractual basis, having the appropriate permission (license) of their state.

Article 16

     The functions of government agencies to ensure security and protect public order located on the territory of the Center include:

  - ensuring security and law and order on the territory of the Center;

  - prevention and combating of various types of offenses and crimes in accordance with the legislation of the States of the Parties;

  - monitoring and patrolling within its frequency Center.

  In order to ensure security and law and order on the territory of the Center, the state bodies of the Parties will establish an appropriate mechanism for interaction at the interdepartmental level.

Article 17

     In order to conduct effective control, the Parties will install a special fence around the perimeter of the Center, equipped with a monitoring system and lighting devices.

Chapter 8. State control over the territory of the Center

Article 18

     The Parties on the territory of the Center shall carry out appropriate sanitary and epidemiological, veterinary, phytosanitary and state control in the field of technical regulation, as well as other types of control in accordance with the legislation of the States of the Parties.

Article 19

     The competent authorities of the States of the Parties should implement and strengthen mutual cooperation in the field of control of infectious diseases, quarantine of plants and animals, as well as inform each other about the epizootic and phytosanitary conditions, the epidemiological situation and timely measures taken to eliminate them.

Chapter 9. Issues of labor activity on the territory of the Center

Article 20

     Citizens carry out their work activities on the basis of the legislation of the host State.

Chapter 10. Entry into force, termination and amendment

Article 21

     In case of disagreements in the interpretation and application of this Agreement, the Parties will resolve them through consultations and negotiations.

  By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are its integral parts and are formalized in separate protocols.

Article 22

     This Agreement shall be concluded for an indefinite period and shall enter into force upon the expiration of 30 (thirty) calendar days from the date of receipt through diplomatic channels of the last written notification on the completion by the Parties of the internal procedures necessary for its entry into force.

  Each of the Parties may terminate this Agreement by notifying the other Party in writing through diplomatic channels. In this case, this Agreement shall terminate upon the expiration of 90 (ninety) calendar days from the date of receipt of such notification.

  Done in Tashkent on November 9, 2025, in two copies, each in the Kazakh, Uzbek and Russian languages, all texts being equally authentic.

  In case of a discrepancy between the texts, the Parties refer to the text in Russian.
