       To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the establishment and operating conditions of information and cultural centers, signed in Almaty on October 12, 1998.              President of the Republic of Kazakhstan    

                               AGREEMENT between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the establishment and operating conditions of information and cultural centers

       The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, taking into account the interest of the peoples of the Republic of Kazakhstan and the Russian Federation in mutual familiarization with historical and cultural values, preservation and development of traditional ties between them, based on the Declaration between the Republic of Kazakhstan and the Russian Federation on Eternal Friendship and Alliance Oriented towards the 21st Century, signed in Moscow July 6, 1998,        Attaching great importance to raising public awareness of their countries about the development of political, economic, cultural, scientific and educational processes in the Republic of Kazakhstan and the Russian Federation, striving to promote the development of bilateral humanitarian, cultural, scientific, technical and information relations in the spirit of the Treaty of Friendship, Cooperation and Mutual Assistance between the Republic of Kazakhstan and the Russian Federation dated May 25 1992 and the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on cooperation in the field of culture, Science and Education of March 23, 1994, agreed on the following:                                    

Article 1          The Parties establish, on the basis of reciprocity, the Cultural Center of the Republic of Kazakhstan in Moscow and the Russian Center for Science and Culture in Astana, hereinafter referred to as the Centers.                                   

Article 2 The Cultural Center of the Republic of Kazakhstan in Moscow carries out its activities under the general supervision of the Head of the Diplomatic mission of the Republic of Kazakhstan in the Russian Federation.        The Russian Center for Science and Culture in Astana operates under the general supervision of the Head of the Diplomatic Mission of the Russian Federation in the Republic of Kazakhstan, as well as the Russian Center for International Scientific and Cultural Cooperation under the Government of the Russian Federation.    

                               Article 3            In order to carry out their activities, the Centers can establish direct links with ministries, other government agencies and organizations, local authorities and officially registered societies, associations, foundations, as well as with individual citizens of the host State.    

                               Article 4            The main objectives of the Centers are: - participation in the implementation of bilateral cooperation programs in the development of humanitarian, cultural, scientific, technical and information relations; - familiarization of the public of the host state with the history and culture, domestic and foreign policy of their state, with its achievements in the field of culture, science, education and economics.;        - assistance in establishing contacts and expanding cooperation between creative, cultural, educational, scientific, professional and sports organizations of the two states; - assistance in learning the languages of the peoples of the two states; - assistance in developing contacts through international, regional and national governmental and non-governmental organizations; - using the information capabilities of the Centers in order to create favorable conditions for the expansion of cultural and scientific and technical cooperation between the two states;        - assistance in establishing and developing partnerships between the cities and regions of the Republic of Kazakhstan and the Russian Federation; - organization of information and advertising work in the field of culture, science and technology.  

                                Article 5 The centers, in accordance with the tasks assigned to them: - create information and reference funds and data banks on cultural, educational, scientific, technical, socio-political and economic development of their states, hold conferences, symposiums, seminars, consultations on problems of international humanitarian, cultural, scientific and business cooperation;        - provide information and consulting services to interested organizations and individual citizens of the host state on establishing contacts with cultural, educational, scientific, educational and professional organizations of their states; - carry out cultural, educational and informational work among compatriots permanently residing in the host state, maintain links with their associations, whose activities do not contradict the legislation of the state stay;        - organize performances by art groups and individual performers, television and film screenings; - hold exhibits, photo exhibitions, exhibitions of works of art and folk art, book exhibitions; - organize courses in the host state to study the languages and cultures of the peoples of their states, training internships for citizens of the host state, provide methodological assistance to researchers and teachers of the language and literature of the peoples of their states who work in local scientific and educational institutions;        - assist in the selection and referral of citizens of the host State to study and internship in their countries; - facilitate the work of associations and clubs of graduates of educational institutions of their state in the host State, contribute to the maintenance of links between such associations and clubs with these educational institutions, and also organize seminars on advanced training for graduates in the host State; - ensure the work of libraries and other information services in the Centers for interested organizations and individual citizens of the host State;        - cooperate with associations and friendship societies, educational, cultural and scientific institutions of the host state, cultural and information centers of third countries to hold joint events.        The centers may carry out other types of activities that meet the objectives of this Agreement, taking into account the legislation of the host State.  

                                Article 6 The centers enjoy the rights of a legal entity in accordance with the legislation of the host State.  

                                 Article 7            The Parties, on the basis of reciprocity and in accordance with the legislation of the host State, shall take the necessary measures to ensure the safety of the personnel and premises of the Centers, as well as their activities.  

                                 Article 8 The activity of the Centers is carried out on a non-commercial basis.        In order to partially reimburse their costs, the Centers may: - charge for attendance at individual events that they organize, for language courses and other activities.;        - distribute periodicals, catalogs, posters, programs, books, paintings and reproductions, discs, records, audiovisual and didactic materials, regardless of the method of recording information, as well as other items not prohibited by the legislation of the host State and directly related to the events they organize, provided that these items are not to be distributed through the trading network of the host state and that this will not harm the rules of trading activities, as well as will not violate the rights of intellectual property owners.;        - to have bookstores, catering establishments and souvenir kiosks in the premises of the Centers for serving visitors, as well as hotel rooms for temporary accommodation of guests of the Centers; - to lease premises belonging to the Centers.  

                                   Article 9            The parties will mutually assist each other in the provision of land, as well as in the lease, acquisition or construction of buildings (premises). under the Centers in accordance with the legislation of the host State.        The work on the design, construction and arrangement of the Centers, after obtaining permission for their construction, will be carried out by the sending Party in accordance with the rules of urban planning of the host state. At the same time, the sending Party has the right to independently appoint contractors to carry out the relevant work.  

                                Article 10 Taxation of the Centers and the income of employees sent to work in them is regulated by the legislation of the host State.  

Article 11            Each of the Parties appoints the staff of its Center, which may consist of citizens of the sending State, the receiving State or a third State. In the latter case, the appointment must be coordinated with the relevant authorities of the host State.        The directors of the Centers and their deputies may be members of the diplomatic staff of the diplomatic mission of the sending State.        The number of staff of the Centers is established by mutual agreement.        The Parties will inform each other about the recruitment of the staff of the Centers, as well as about the assumption of office and termination of their work in the Centers.  

                                 Article 12          The staff of the Centers and their family members who are citizens of the sending State and do not permanently reside in the receiving State are subject to the labor legislation and social security regime of the sending State.  

                                 Article 13            Each Party, on the basis of reciprocity, provides members of the staff of the Center of the other Party, as well as members of their families living with them, with benefits provided for by the legislation of its State in matters of obtaining a residence permit in the host State.  

                                 Article 14            Each Party, if necessary, will assist the other Party in finding suitable living quarters for the staff of its Center.  

                                 Article 15            Issues arising in connection with the interpretation and application of this Agreement will be resolved through negotiations.  

                                 Article 16 This Agreement shall enter into force on the date of the last written notification confirming that the Parties have completed the relevant domestic procedures necessary for its entry into force.        This Agreement is concluded for a period of five years and will be automatically extended for subsequent five-year periods, until one of the Parties notifies the other Party in writing, at least six months before the expiration of the relevant period, of its intention to terminate it.  

    Done in Almaty on October 12, 1998, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic.
