Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the functioning of the Kazakhstan Branch of Lomonosov Moscow State University
The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties,
guided by the provisions of the Agreement on Cooperation on the Formation of a Single (common) Educational Space of the Commonwealth of Independent States dated January 17, 1997, the Agreement between the Government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Russian Federation and the Government of the Republic of Tajikistan on mutual Recognition and equivalence of educational documents, academic degrees and titles dated November 24, 1998 G. and the Agreement on the establishment and Operation of branches of higher education institutions in the member States of the Agreement on the Customs Union and the Single Economic Space of February 26, 1999, concluded in Minsk on May 23, 2000.,
in the interests of long-term cooperation and deepening cooperation in the field of higher education
have agreed on the following:
Article 1
By this Agreement, the Parties fix the terms of operation of the Kazakhstan Branch of the Lomonosov Moscow State University (hereinafter referred to as the branch).
Article 2
The authorized bodies and organizations responsible for the implementation of this Agreement are:
from the Kazakh Side - the Ministry of Education and Science of the Republic of Kazakhstan, L.N. Gumilyov Eurasian National University (hereinafter – the Eurasian University);
from the Russian Side - the Ministry of Education and Science of the Russian Federation, Federal State Budgetary Educational Institution of Higher Education "Lomonosov Moscow State University" (hereinafter – Moscow University).
Article 3
The branch operates as a separate structural subdivision of Moscow University on the property base of the Kazakh Side in accordance with the Charter of Moscow University and the regulations on the branch, approved in accordance with the established procedure.
The Kazakh Side transfers the property of the Eurasian University to Moscow University for free use without its withdrawal and transfer to third parties, necessary for the functioning of the branch.
The transfer for gratuitous use of the property assigned to the Kazakh Side, including that assigned to the Eurasian University, is carried out under the terms of an agreement concluded in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
The branch's activities, with the exception of educational activities carried out in accordance with the federal state educational standards of the Russian Federation and educational standards developed and independently approved by Moscow University, are carried out in accordance with the legislation of the Republic of Kazakhstan.
The branch is being liquidated in accordance with the legislation of the Republic of Kazakhstan.
Article 4
Licensing and state accreditation of educational activities of the branch is carried out in accordance with the legislation of the Russian Federation.
The state certification of the branch is not carried out by the Kazakh Side.
Article 5
Education at the branch is conducted on the basis of federal state educational standards and educational standards independently developed and approved by Moscow University in the fields of mathematics, applied mathematics and computer science, philology, ecology and environmental management, economics, with compulsory study of the history of Kazakhstan and the Kazakh language.
Taking into account the needs of the labor market of the Republic of Kazakhstan for qualified personnel, the authorized bodies of the Parties may coordinate additional training areas in the branch.
Education at the branch is carried out in full-time and part-time forms of education.
The training in the branch is conducted in Russian.
Article 6
The rules of admission to study at the branch are regulated by the legislation of the Russian Federation, and in the part not regulated by it, by the charter of Moscow University.
The educational process for students at the branch can take place directly at the Moscow University in accordance with the procedure established by the local act of the Moscow University.
The training at the branch is carried out with the participation of the faculty of Moscow University in conducting lectures, seminars and other types of educational work.
Moscow University and the Eurasian University cooperate in scientific, educational and other fields of mutual interest.
Article 7
Students of the branch who have successfully passed the state final certification are given documents on education and (or) qualifications, which are recognized in the territory of the Republic of Kazakhstan without undergoing the recognition and nostrification procedure. Samples of the specified documents on education and (or) qualifications are established by the Moscow University.
The procedure for compulsory training by graduates of Moscow University who have completed their studies at the branch on the basis of the state educational order of the Republic of Kazakhstan is determined in accordance with the legislation of the Republic of Kazakhstan.
Article 8
The branch's activities are financed from the republican budget of the Republic of Kazakhstan allocated for the training of specialists with higher and postgraduate education within the framework of the state educational order, as well as from other sources not prohibited by the legislation of the Republic of Kazakhstan.
Provision of the branch with the material and technical base for conducting business is carried out at the expense of the Kazakh Side in accordance with the requirements stipulated by the legislation of the Republic of Kazakhstan.
Expenses related to the operation of engineering communications (electricity, heat, water supply, sewerage) and the maintenance of educational, auxiliary, sports facilities and dormitories provided for free use are covered at the expense of the branch's funds received under the state educational order of the Republic of Kazakhstan, as well as from other sources not prohibited. the legislation of the Republic of Kazakhstan.
Article 9
In the field of personnel training, the branch develops cooperation and interaction with business entities of the Republic of Kazakhstan on the terms and principles of public-private partnership provided for by the legislation of each of the states of the Parties.
Article 10
The authorized bodies and organizations of the Parties shall establish an Interdepartmental Commission consisting of an equal number of members from both Sides to ensure the implementation of the provisions of this Agreement.
The interdepartmental commission carries out a joint audit of the educational and financial and economic activities of the branch for the implementation of the goals and objectives of this Agreement and the use by the branch of the property assigned to the Kazakh Side.
A joint inspection of the branch's activities is carried out no more than once every 3 years.
Other inspections are carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
When violations are detected in the activities of a branch, the authorized bodies of the Parties take measures in accordance with the laws of the States of the Parties.
Article 11
Disputes between the Parties related to the application or interpretation of the provisions of this Agreement are resolved through consultations and negotiations.
Article 12
By agreement of the Parties, amendments may be made to this Agreement, which are formalized in separate protocols and are an integral part of it.
Article 13
This Agreement does not affect the rights and obligations of the Parties arising from other international treaties to which their States are parties.
Article 14
This Agreement shall enter into force on the date of receipt of the last written notification through diplomatic channels that the Parties have completed the internal procedures necessary for its entry into force.
The activities of the branch are subject to compliance with the provisions of this Agreement from the date of its entry into force.
Article 15
This Agreement is concluded for an indefinite period.
This Agreement may be terminated by either Party by sending a written notification to the other Party through diplomatic channels of its intention to terminate it. In this case, this Agreement shall terminate upon the expiration of 10 months from the date of receipt by the other Party of such notification.
Done in Chelyabinsk, on November 9, 2017, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic.
In case of discrepancies between the texts of this Agreement, the Parties shall refer to the text in Russian.
